Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc lawsuits conclusively. It believes it can pay less when there is an element of bankruptcy that puts pressure for a settlement. Moving past more than 400 years in American history, the company argues that bankruptcy benefits everyone by dispersing settlements more fairly and efficiently than trial courts, where some litigants receive significant award while others do not.

Hyperbole is not exempt attorneys representing the victims claim this the biggest “fraudulent transaction of assets in United States history.”

In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023 Update Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on the funding of litigation in the Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of profits. J&J is now offering the payment of $8.9 billion to settle lawsuits.

The funders’ involvement is public knowledge due to an New Jersey court rule requiring the release of certain details about funders outside the state. This rule is intended to address the growing calls for the regulation of lawsuit funders.
