J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay for different types of cancer victims in bankruptcy settlement. Is talc safe in eyeshadow. J&J has declared that its talc products are safe and do not cause cancer. It’s trying for a second time to resolve more than 38,000 cases in bankruptcy, as well as prevent new lawsuits from coming forward in the near future.
The bankruptcy plan of LTL would pay $400 million into an additional trust to settle claims filed from state attorney generals alleging that J&J violated the state’s unfair commercial practices as well as consumer protection laws by misinforming consumers regarding the safety of its talc products.

A number of states had already initiated consumer protection actions against J&J prior to the first bankruptcy filing stopped these investigations from taking place in 2021. Is talc safe in eyeshadow. New Mexico and Mississippi had already brought suits in the past against Johnson & Johnson before then, and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative requests or subpoenas in LTL’s court filings.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy as well as cancer patients as well as their counterparts from the U.S. Justice Department’s bankruptcy watchdog, who argue that a profit-making firm like J&J can’t benefit from bankruptcy protections aimed at the struggling debtors.
The first time LTL attempted to settle the bankruptcy lawsuits was dismissed after similar arguments. The U.S. appeals court decided in favor of LTL did not have “financial difficulty” and thus not eligible under bankruptcy law. Is talc safe in eyeshadow. LTL made a new bankruptcy application in just two hours following the dismissal, saying that its second attempt was different in that it had less money available and had a greater chance of securing the settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s renewed bankruptcy violates state law enforcement authorities by attempting unilaterally to cap LTL’s liability to state consumer protection actions.

The filings of LTL’s latest bankruptcy proceedings also include more details on how the company would assess and pay cancer claims in the event that the bankruptcy plan is approved.

The largest amount of money under the settlement will be $500,000 to those diagnosed with cancer of the mesothelioma ovary before age 45, and $260,000 for people diagnosed with terminal ovarian cancer before age 45.

The proposed settlement offers discounts based on the nature and severity of the cancer, the person’s age, the history of talc use and other factors. Is talc safe in eyeshadow. For instance, a woman who used talc products on a weekly basis, who had an ovarian cancer family history, cancer and was diagnosed stage II ovarian cancer at age 55 may qualify to receive a payout of $21,125 under the settlement plan.

Judge decides J&J and talc oppositionists to engage in settlement talks.

After another round of hearings in Johnson & Johnson’s attempt to use a Texas Two-Step bankruptcy strategy for talc litigation and federal bankruptcy judge Michael Kaplan has ordered the company as well as those who oppose the move to conduct negotiations to settle the matter, Bloomberg reports.

In its second bankruptcy effort for LTL Management, a subsidiary set up by J&J to settle claims – the company made a settlement offer of $8.9 billion. Is talc safe in eyeshadow. While one firm representing plaintiffs agree with the proposal, another group opposes the deal.

In the last week, an opposition group, called”the Official Committee of Talc Claimants requested the bankruptcy court to dismiss this case saying that LTL can not be considered financially distressed.

“The filing is an incredibly legal and ineffective attempt by a small number of law firms to try to prevent claimants from voting on the resolution plan – a plan that the overwhelming majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc safe in eyeshadow. “The law firms behind the filing are pursuing financial interests which do not align with, differ from and contravene those of their clients. We’ll be submitting an answer before the court of appeals.”

Is talc safe in eyeshadow. Clay Thompson, a lawyer for MRHFM, which includes more than mesothelioma victims who have filed lawsuits against J&J and J&J, has said that J&J’s second bankruptcy attempt failed.

“J&J sends out press releases that boast about how amazing its plan is, while insisting that the plan’s details, including what each sick person will receive — be kept private,” Thompson said in an email. “What do J&J have to cover up?”

Kaplan has instructed both sides to create a restructuring plan, with supervision of two mediators.

As of February 2022 Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that would relieve J&J from the hundreds of thousands of claims related to its talcum-based products.

However, in January of this year, an appeals court in the United States overturned the ruling, ruling that the business could not be considered in “financial difficulty.”

The J&J’s plan to make an appeal before the U.S. Supreme Court was rejected the same month, J&J applied for its first bankruptcy just two hours after. In response, Kaplan froze the lawsuits for 60 calendar days to decide whether or not to accept the second bankruptcy.

J&J’s unstoppable profit machine sputters after $6.9B settlement charge for talc.

In the Two Chapter 11 attempts, J&J has gotten 19 months of which cases have been suspended. Is talc safe in eyeshadow. J&J wants the claimants to decide whether they want to accept the settlement. J&J would need 75% approval for the deal to pass.

In addition to the team of talc lawyers that criticized the bankruptcy of the company as well, the U.S. Trustee, an arm belonging to the U.S. Department of Justice, also filed an appeal to dismiss LTL’s second bankruptcy case.

In a filing this week, U.S. trustee Andrew R. Vara wrote that the doors of bankruptcy are “open to honest but unfortunate debtors.” The doors “are not accessible to those that do not have a legitimate goal or who seek to use the bankruptcy process to hinder or delay their creditors,” Vara continued.

In its own words, J&J maintains there is no proof conclusive that their Talc-based products, such as its popular baby powder cause cancer. J&J has taken the products of the market–first on North America in 2020–and the rest of the world next year.

J&J intends to steer clear of the cost of going to trial. The company has won the majority of cases decided at trial, but certain losses have been punitive.
A high-profile trial in Missouri ended in an $4.7 billion judgment against the drug manufacturer but was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine trial cases in talc which are appealing or concluded. Of the 41 trials, 32 have resulted in a win by J&J, a mistrial or plaintiff verdicts that were dismissed after appeal. Is talc safe in eyeshadow. In addition, J&J has announced plans to settle nearly 1,000 cases worth 100 million dollars, Bloomberg reported at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Safe In Eyeshadow

June 2 2023 Update: At an asbestos talc court trial held that took place in California yesterday, technical issues interrupted the opening statements made by defense attorneys. Is talc safe in eyeshadow. Jurors who were watching from their homes via Zoom and hearing the Johnson and Johnson’s lawyer express doubt about the science of the 70s asserting the presence of asbestos in their product before the trial was abruptly closed.

The plaintiff had the opportunity to introduce an initial witness Arthur Langer. Langer said that the presence of additional minerals along with the talc’s mineral content is inevitable. He testified that his team was notified by J&J in the year 1971 about the presence of chrysotile asbestos within the talc of the company, but at just 0.1 percent. He also uncovered more asbestos in the year 1976.

June 1st, 2023 Update Is talc safe in eyeshadow. First trial after J&J took the decision to disband its Talc division and declare bankruptcy is an important turning point for the ongoing lawsuit controversy. The trial started yesterday in the tragic trial of a young plaintiff, diagnosed with an aggressive and rare form of mesothelioma last year, an illness that lawyers on both sides acknowledge is a tragic loss.

Opening statements revealed stark differences in each side’s story. The plaintiff’s attorney took aim at Johnson & Johnson, alleging the use of deceitful strategies in its research practices as well as throughout the litigation process. As per the lawyer Johnson & Johnson attempted to alter the definition of asbestos despite internal documents dating back to between 1978 and 1994 that showed asbestos fibers found in plaintiff’s tissue are included.

Johnson &J’s tangled $8.9 billion settlement is hanging in the balance with the progression of this trial. Despite the unique nature of the mesothelioma trial and its distinct issues compared to other talcum powder lawsuits A verdict in favor of the plaintiff could result in a serious setback to J&J’s hopes for broad acceptance of their proposed settlement with plaintiffs.

May 31st 2023: Update from Johnson and Johnson’s bankrupt talc unit is defending the second Chapter 11 filing in the facing challenges from the talc injury plaintiffs. In a written objection to the New Jersey bankruptcy court, the subsidiary argued that the case differed fundamentally from the first filing. It emphasized the unprecedented commitment of $8.9 billion in settlement from J&J, the largest settlement ever in any bankruptcy case that involves mass tort. Is talc safe in eyeshadow. The issue is not discussed: whether this amount indicates that it is a fair settlement. J&J also claimed support from several plaintiffs’ legal companies representing over sixty thousand claimants. This is hard to verify but it’s likely to be false.

May 24 2023 Update: As of Johnson &J Johnson’s bankruptcy filing, the first trial concerning the cosmetic talc products it claims to comprised of asbestos is set to start jury selection on Monday, California within the Alameda County Superior Court, the most favored jurisdiction for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure resulting from J&J’s products and that the company denies. The trial also involves six retailers who are accused of selling talc-based products.

May 22, 2023 Update: Lawyers in the 2nd J&J talc bankruptcy are now in a dispute over who should be appointed to the role of a future claims representative, the role is crucially important to resolving the claims involving talc. Is talc safe in eyeshadow. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States, was appointed as the claims representative in the initial bankruptcy. J&J’s defense attorneys want Ellis to be appointed in that position again, but lawyers for the talc plaintiffs are objecting because Ellis has an unrelated conflict of interest which would prohibit her from assuming that position in the future. The issue stems from the issue that Ellis was reportedly involved in drafting the controversially contested second bankruptcy, raising doubts regarding her capacity to remain neutral. It’s true that the bankruptcy will be tossed out anyway.

May 17th, 2023 Update: The fake company J&J created to handle the bankruptcy of talc informed an New Jersey bankruptcy court that they had allocated $400 million to settle claims brought by states accusing the company of deceitful advertising for its talc products. Is talc safe in eyeshadow. That’s an $8.5 billion settlement for cancer victims. It is hard to imagine an eventuality where J&J could push the settlements of baby powder through in these figures. Although J&J’s $8.5 billion offer seems like a large sum at first, it does not look good after you calculate the figures. This settlement offer based on our rough calculations – would not provide victims with much more than $100,000 per instance. It’s not enough.

May 15, 2023 Update J&J might be facing lawsuit by an advocacy group representing cancer victims. Is talc safe in eyeshadow. The group contends that J&J intentionally withdrew a $61.5 billion funding agreement that it had with its company subsidiary LTL Management LLC, to create the appearance of financial hardship and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move is equivalent to a fraudulent transfer of right to compensation for victims. They plan to explore J&J’s actions in the wake of the dismissal of the first bankruptcy case of LTL.

May 10 2023 Update: The following week this week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to dismiss the second bankruptcy filing that was filed by J&J subsidiaries LTL Management. In the meantime, it has approved an order which requires both sides to participate in a second settlement mediation hoping that the global settlement can be reached.

May 5, 2023: Update on Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Is talc safe in eyeshadow. Over 2700 people have sued the firm and the company was paying $1 million per month to defend itself. The company’s latest $29 million verdict in South Carolina forced it to pursue bankruptcy protection, and arguing for a fair distribution of assets to talc claimants, rather than being confiscated by the receiver. Other suppliers of talc have filed for bankruptcy due to the litigation.

May 4, 2023 update: U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to resume talks on settlement with lawyers who rejected the company’s proposed $8.9 billion offer for settlement. The court in Trenton, New Jersey yesterday, the parties gathered in court to discuss next steps for another bankruptcy proceeding and Judge Kaplan was pushing for more settlement discussions.

This is the solution to settle these claims with J&J. A settlement for baby powder can be completed. Is talc safe in eyeshadow. But it will require more money – billions of dollars of Johnson & Johnson.

Lawyers have a split opinion on whether or not to accept the plan and not every client sees this issue the same way their lawyer does. A second bankruptcy proceeding is expected to be a failure and Judge Kaplan has set a date for a hearing in June to decide whether to close the case for the third time.

May 3 2023 Update The group of cancer victims who are suing Johnson & Johnson (J&J) requested for the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation surrounding talc-based products. The group representing the claimants submitted a motion on Tuesday, asking the Third Circuit to consider their appeal and return the case to a lower court with instructions to discharge the bankruptcy. Is talc safe in eyeshadow. They also requested that the stopped tort litigation against J&J continue to proceed.
LTL has filed for Chapter 11 protection once again following its bankruptcy filing that was denied in the Third Circuit earlier this year which offered the possibility of an $8.9 billion settlement. The committee argues that the recent decision allowing the second Chapter 11 to continue, in addition to halting trials against J&J and J&J, requires urgent Third Circuit review. The US Trustee has also requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a reply in the appeals court, saying that the filing is a “desperate and legally deficient move” by a few of law firms with conflicts of financial interests.
May 1st 2023 Update: One frequently asked question is how could plaintiffs and their lawyers turn on $8.9 billion. Of course, that is an immense amount of money. But there are a lot of victims. Is talc safe in eyeshadow. These are actually a good claims for plaintiffs. We have been reminded of this recently by two talc-related trials that led to huge verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in the verdict worth $18.1 million. A month later, another talc mesothelioma case went to the court at South Carolina and resulted in a verdict of $29million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc., one of the largest suppliers of talc in the U.S.
April 30 2023 Update: J&J initially tried to take the lawsuit over talcum powder into bankruptcy, it was met with an offer to reserve $2 billion for settlements. The amount was absurdly low. None of the talc plaintiffs agreed with the proposal. This time, however, J&J has increased the offer to $8.9 If the talc plaintiffs agree to a bankruptcy settlement and also has the support of a large segment of the talc plaintiffs and their attorneys. Is talc safe in eyeshadow. But 75% of the talc plaintiffs, which is required for bankruptcy plan approval is not an easy task due to the sheer number of lawyers with large inventory of baby powder lawsuits that are opposed against the proposed settlement.

What could solve the impasse? More billions.
April 25, 2023 Update Talc patients have demanded a judge dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc safe in eyeshadow. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible for bankruptcy relief since it failed to show financial trouble.

The plaintiffs argue that LTL’s second Chapter 11 case is an abuse of the bankruptcy system and that the case is being handled in bad faith. J&J states that the bankruptcy settlement has “significant support” from the firms that represent an estimated 60,000 plaintiffs. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over their disagreement over the $8.9 billion amount of settlement offered.

April 21, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that the company sold tainted baby powder causing cancer. Although the trials for the lawsuits involving talc are delayed for at least 60 calendar days however, new lawsuits may be filed and lawyers will begin preparing their cases. Is talc safe in eyeshadow. The judge expressed skepticism over J&J’s absurd attempt to revive its strategy by filing a second bankruptcy trial.

April 13 2023 update: the big update is about the $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer victims who are part of MDL class action MDL group action pledged to fight the settlement with those who claim talc. Why? They think it is not enough for more than 70,000 cancer victims. Is talc safe in eyeshadow. These lawyers believe that J&J should seek a bigger settlement or settle individual claims if the latest bankruptcy is dismissed.

However, there is a second group of lawyers outside of the top leadership in that class action. These lawyers have amassed hundreds of thousands of cases. They want to settle today for what is believed to be lower than what the victims should be paid. The argument they make is twofold. First, they argue that the settlement, which is about 100,000 dollars per plaintiff is fair.

That is a hard argument to prove. But their second argument has more teeth: victims can not afford to wait any longer and need their money today.

April 12 2023 Update: Some people are seeking out how J&J can go through bankruptcy again. The answer is complicated and complex. Let’s try to simplify it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc lawsuits conclusively. It believes it can pay less when there is an element of bankruptcy that puts pressure for a settlement. Is talc safe in eyeshadow. Moving past more than 400 years in American history, the company argues that bankruptcy benefits everyone by dispersing settlements more fairly and efficiently than trial courts, where some litigants receive significant award while others do not.

The gist of the 3rd Circuit decision was this is not a case – the profit-making company that has an affiliate to accept the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. But it also said that the entity was financially distress because J&J assured it of unlimited funding.
Then J&J took advantage of the funding unlimited part of the holding and didn’t make any promises to fund unlimited lawsuits. J&J claims that its modified financing arrangements with its subsidiary addresses the appeals court’s concerns, while providing funds for claims. As if offering victims less money would solve the overarching problem.

Attorneys representing cancer patients who do not agree with the agreement counter this with what you conclude is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt attorneys representing the victims claim this the biggest “fraudulent transaction of assets in United States history.”

In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023 Update Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on the funding of litigation in the Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of profits. J&J is now offering the payment of $8.9 billion to settle lawsuits.

The funders’ involvement is public knowledge due to an New Jersey court rule requiring the release of certain details about funders outside the state. This rule is intended to address the growing calls for the regulation of lawsuit funders. J&J faces over 60,000 claims when you combine state and federal infant powder litigation. Third-party funding of mass tort cases is not without its pros and cons. But there is no question that we are seeing how third-party financing can help level the playing field for individuals and large corporations in the courtroom.

April 4, 2023 Update: It is enjoyable to see the worm turning in this litigation. J&J took another hit this week, when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. The automatic stay has frozen thousands of talcum cases and stopped new lawsuits from getting filed ever since J&J began the controversial plan to spin talc-related liabilities into a bankrupt company over one year in the past. Is talc safe in eyeshadow. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid just a few months ago the stay was lifted. J&J wanted to see it continued pending the SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay being fully lifted, the first new cases were filed and incorporated into the Talcum Powder class action MDL in the space of a year. Seven new talc lawsuits have been joined to the MDL over the last month, bringing the total number of cases in the pending process up to 37,522.

February 25, 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J Talc products have cost the government in the years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of not recognizing the risks of its talc product for many years, while tax dollars were spent treating those injured by exposure to the product. The suit comes just a few days following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Is talc safe in eyeshadow. J&J has to begin making reasonable settlements to victims to the process of putting all this behind. This is a blemish on one of the most prestigious companies.

February 14 2023 Update: During an earlier hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
