Kaplan has directed the parties to devise a second strategy for reorganization, under supervision of two mediators.
In February 2022, Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that will free J&J from the tens of thousands of claims over its talcum products.
In January of this year, a federal appeals court ruled against the verdict, ruling that the business could not be considered in “financial difficulty.”
In the event that J&J’s request to contest the U.S. Supreme Court was turned down on April 1, J&J declared bankruptcy roughly two hours later. In response, Kaplan froze the lawsuits for 60 days, allowing the company to decide whether or not to approve an additional bankruptcy.

The US Trustee requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a formal response to the appeals court calling the request an “desperate and legally insufficient attempt” by a handful of law firms who have conflicts of financial interests.
May 1st 2023 Update: A common question that people ask is how could the plaintiffs’ lawyers and their clients turn around $8.9 billion. Of course, that’s an enormous amount of money. There are a lot of victims. Does all baby powder have talc. And these are really good arguments for plaintiffs. We have been reminded of this recently in two talc trials which resulted in big verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon ended in a verdict worth $18.1 million. In the same month, a different mesothelioma trial involving talc was held for trials on the other side of South Carolina and resulted in a verdict of $29 million in favor of plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc., one of the top suppliers of talc in the U.S.
April 30, 2023 Update: When J&J first tried to bring the talcum powder litigation into bankruptcy, it came with an offer to put aside $2 billion for settlements. The amount was absurdly low. The talc plaintiffs had not agreed with the proposal. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims accept a bankruptcy settlement and they have the support of a substantial segment of the talc plaintiffs as well as their lawyers. Does all baby powder have talc. However, 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans It’s a long and difficult process because of the number of lawyers who have huge inventories of baby powder litigations opposed in favor of the deal.
What could solve the impasse? More billions.
April 25 2023 Update: Talc plaintiffs have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Does all baby powder have talc. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible for bankruptcy relief as it failed to show financial trouble.
The claimants argue that LTL’s third Chapter 11 case is an fraud on the bankruptcy system and that it’s being pursued in bad good faith. J&J asserts that the bankruptcy settlement receives “significant backing” from firms representing around 60,000 claimants. It’s safe to say plaintiffs’ lawyers and the victims are split over their disagreement over the $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that the company sold a baby powder that contained a chemical that causes cancer. While trials in talc lawsuits are paused for a minimum of 60 days, new lawsuits can be filed, and lawyers are able to begin preparing their cases. Does all baby powder have talc. Judges expressed skepticism about J&J’s pathetic attempt to revive its strategy with a second bankruptcy trial.
April 13th 2023 update: the major announcement is an $8.9 billion over the next 25 years of settlement. Lawyers representing cancer victims in the MDL class action have promised to fight the settlement along with Talc claimants. Why? They argue that it’s not enough to pay for 70,000 victims who have cancer. Does all baby powder have talc. They argue that J&J should seek a bigger settlement or litigate individual claims if the latest bankruptcy is dismissed.
But there’s a separate group of lawyers that is not part of the top leadership in this class action. The lawyers collectively have accumulated hundreds of thousands of cases. This group wants to settle with what they believe is lower than what the victims should be paid. The argument they make is twofold. The first is that they claim the settlement of around 100 million dollars on average per plaintiff is fair.
This is an argument that is difficult to prove. However, their second argument has more substance: the victims will now not wait and they want to get their money right now.
April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy once more. The answer is complicated and complicated. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future lawsuits involving talc conclusively. In other words, it believes it can pay less should there be the bankruptcy element which applies pressure to negotiate a settlement. Does all baby powder have talc. In a quest to cover more than 400 years in American history, the firm believes that bankruptcy is beneficial to everyone by dispersing settlement payments more equitably and effectively than trial courts, which are where litigants get significant awards while others receive nothing.
The basic tenet of the 3rd Circuit decision was this isn’t a case that involves a profitable company making subsidiaries to meet the legal risk and declare bankruptcy – something Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled that the entity was in financial crisis due to the fact that J&J promised unlimited funding.
This is why J&J decided to go with the unlimited funding aspect of the agreement and didn’t promise that it would provide unlimited funds for litigation. The company claims that revised financing arrangements with its subsidiary address the concerns of the appellate court, while supplying funds for claim payments. As if providing victims with less money would solve the problem at hand.
Attorneys representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous decision. Hyperbole was not spared by the victims’ lawyers, who call this the biggest “fraudulent transaction of assets in United States history.”
Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023 Update: Bloomberg has an interesting report on a brand new law of New Jersey that is shedding new light on litigation funding in the plaintiffs in the class action. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) concerning talc products in exchange for a share of any profits. J&J is now offering an offer of $8.9 billion to settle all lawsuits.
The funders’ involvement is publicly available due to the New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to address the growing calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you take into account state and federal child powder-related lawsuits. Third-party funding for mass tort lawsuits has both pros and pros and. But there is no question that we are witnessing how third-party funding could level the playing field between people and big corporations in court.
April 4 2023 Update: It’s fun to watch the worm turn in this litigation. J&J suffered another setback this week, when an appeals court in the Third Circuit denied J&J’s request to maintain the automatic stay in the meantime that J&J appeals an appeal in the U.S. Supreme Court. It has frozen the cases of talcum powder in a number of years and prevented new lawsuits from getting filed ever since J&J initiated the controversial effort to spin the talc debts off into a bankrupt subsidiary more than a year back. Does all baby powder have talc. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal a few months ago, the stay was lifted. J&J wanted to see it remain in effect until an appeal to the SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that for the Supreme Court is willing even to hear the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay now officially lifted, the very first new cases have been filed and transferred into the talcum powder class action MDL within a year. Seven new talc cases were added to the MDL in the past month which brings the total number of cases pending to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now calling for be the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J talc products have cost the government over the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc product for long while tax dollars used to treat those who were injured through exposure to the chemicals. The suit comes just a few days after J&J’s loss to the 3rd Circuit Court of Appeals.
Does all baby powder have talc. J&J must begin making reasonable settlement proposals to victims, in order to put all of this behind. This is a disgrace to one of the greatest businesses.
February 14 , 2023 Update: At the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
