Lawyers representing cancer victims who oppose the deal counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s ruling. Hyperbole is not exempt the lawyers representing victims call it the largest “fraudulent deal ever in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement to keep pressure on plaintiffs.
