J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay for different types of cancer victims as part of the bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc-related lawsuits definitively. Going back to hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlement payments more evenly and efficiently than trial courts, where some litigants receive significant awards while others receive nothing.
The essence of this 3rd Circuit decision was this is not a case – a profitable company making an entity to assume the legal responsibility and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. However, it also stated the company was financially crisis because J&J promised unlimited funding.
Thus, J&J decided to go with the unlimited funding aspect of the holding but did not pledge to offer unlimited funding for the litigation. J&J claims that its revised financing arrangements with its subsidiary address the concerns of the appellate court, while providing funds for claims. It’s as if giving victims lower amounts of money would resolve the overarching problem.
Attorneys representing cancer patients who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed the lawyers representing victims call this the biggest “fraudulent transfer that has occurred in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of trying to push this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023, Update Bloomberg offers an informative report on a brand new law in New Jersey that is shedding new light on litigation funding in the Class action suit.
