J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company intends to pay for different types of cancer patients in the bankruptcy settlement. April 12 2023 Update: People are asking how J&J is able to file for bankruptcy again. The answer is complicated and confusing. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. In other words, it thinks it will pay less in the event of a bankruptcy component that applies pressure for a settlement. King talc asbestos. Moving past more than 400 years in American history, the company asserts that bankruptcy benefits all parties by distributing settlement payments more evenly and effectively than trial courts, in which some litigants receive substantial award while others do not.

Hyperbole was not spared: victims’ lawyers call it the most significant “fraudulent transaction ever in United States history.”
In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way to push for this $8.9 billion settlement to keep pressure on plaintiffs.

Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) over talc products in exchange for a portion of any winnings. J&J is now offering the payment of $8.9 billion to settle all lawsuits.
The involvement of the funders is made public because of an New Jersey court rule requiring the disclosure of certain information about outside funding backers.
