In a quest to cover 400 years of American history, the company claims that bankruptcy benefits all parties because it distributes settlements more equally and more efficiently than trial courts in which some litigants receive substantial award while others do not.
The main thrust of the 3rd Circuit decision was this is not a case of a profitable company making an entity to assume the legal responsibility and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. But it also said that the subsidiary was not in financial difficulty because J&J offered unlimited financing.
So J&J jumped on the unlimited funding aspect of the contract and didn’t promise to fund unlimited cases. The company claims that new financing agreements with its subsidiary address appeals court’s concerns, while providing funds for claims. The involvement of the funders is public knowledge because of a New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rules aim to tackle the growing demands for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine federal and state infant powder litigation. Third-party funding for mass tort lawsuits has pros and pros and. But there is no question that we are witnessing how third-party financing can help level the playing field between people and big companies in court.
April 4, 2023 Update: It’s pleasing to see the worm turn in this lawsuit. J&J took another hit this week when it was found that the Third Circuit denied J&J’s request to maintain the automatic stay in the meantime that J&J appeals an order granting bankruptcy at the U.S. Supreme Court.
