In other words, it believes it can pay less when there is a bankruptcy element that creates pressure for a settlement. Can talc cause cancer. Moving past hundreds of years of American history, the firm claims that bankruptcy benefits everyone by dispersing settlement payments more equitably and efficiently than trial courts, in which some litigants receive substantial award while others do not.
The gist of this 3rd Circuit decision was this is not a case of the profit-making company that has subsidiaries to meet the legal risk and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, it also stated the company was financially difficulty due to the fact that J&J offered unlimited financing.
So J&J jumped on the unlimited funding part of the agreement and did not promise that it would provide unlimited funds for litigation. J&J is now offering to pay $8.9 billion to settle any lawsuits.
The involvement of funders is made public because of the New Jersey court rule requiring the release of certain details about funding sources outside of the. The rule aims to respond to the increasing calls for the regulation of litigation funders. J&J is facing more than 60,000 claims when you take into account state and federal Baby Powder lawsuits. Third-party funding in mass tort claims has its pros and cons. However, there is no doubt that we are witnessing the ways that third-party funding can even the playing field between people and big corporations in the courtroom.
April 4, 2023 Update: It is pleasing to see the worm turn in this legal battle. J&J suffered another setback this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals an order granting bankruptcy at the U.S. Supreme Court. Automatic stays have frozen thousands of talcum cases and stopped new lawsuits from arising ever since J&J began the controversial plan to spin the talc debts off into a bankrupt subsidiary more than a year in the past. February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J talc products have cost the government in the years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc product for years while tax dollars were spent treating those injured by exposure to the chemicals.
