J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay for different types of cancer victims in the bankruptcy settlement. April 13th, 2023 update: the biggest story is that there’s an $8.9 billion over the next 25 year period settlement offered. Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc litigations in a definitive manner. Also, it believes it can pay less if there is a bankruptcy component that applies pressure to negotiate a settlement. Can talc contain asbestos. In a quest to cover 400 years of American time, the business believes that bankruptcy is beneficial to all parties because it distributes settlement payments more evenly and effectively than trial courts, where litigants are awarded significant settlements while others get nothing.
The gist of the 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an entity to assume the legal liability and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. Attorneys representing cancer victims who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared the lawyers representing victims call it the largest “fraudulent transaction ever in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.
April 10 2023 update: Bloomberg provides an insightful article about a new law of New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. February 25 2023 Update This morning, a Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J talc products have cost the government in the years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc product for decades while tax dollars were utilized to treat people injured by exposure to the products. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
