Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc-related lawsuits definitively. It thinks it can get a lower rate if there is an element of bankruptcy that puts pressure for a settlement. Does all talc contain asbestos. Moving past 400 years of American time, the business believes that bankruptcy is beneficial to all parties because it distributes settlement payments more evenly and effectively than trial courts where some litigants receive significant awards while others receive nothing.
