J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company will pay various types of cancer patients in the bankruptcy settlement. Does all talc have asbestos. J&J has declared that its Talc products are safe, and don’t cause cancer. It is attempting for an additional time to conclude more than 38,000 cases in bankruptcy, and to prevent any new cases from coming forward in the future.
LTL’s bankruptcy plans would deposit $400 million to an additional trust to settle claims brought by state attorneys general alleging that J&J did not comply with state unfair business practices and consumer protection laws through misleading consumers regarding the security of its talc-based products.

A number of states had already initiated consumer protection actions against J&J before LTL’s first bankruptcy filing stopped those investigations from moving forward in 2021. Does all talc have asbestos. New Mexico and Mississippi had already filed suit against Johnson & Johnson before then as well as the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands according to court papers.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy in a joint move with cancer victims as well as the U.S. Justice Department’s bankruptcy watchdog. They argue that a profit-making firm like J&J can’t benefit from bankruptcy protections intended for those struggling with debt.
The first time LTL attempted to settle the bankruptcy-related lawsuits was dismissed following similar arguments, when a U.S. appeals court determined that LTL did not have “financial difficulty” and therefore not eligible for bankruptcy protection. Does all talc have asbestos. LTL had filed for bankruptcy again in just two hours following the dismissal, arguing its second attempt was different because it was able to borrow less and had more support for a settlement.

New Mexico and Mississippi said in their motion to dismiss that LTL’s latest bankruptcy violation of state law enforcement powers by trying to unilaterally cap the liability of the company in state consumer protection measures.

The filings of LTL’s latest bankruptcy proceedings also include additional details about how the company plans to evaluate and pay claims for cancer when the bankruptcy plan is approved.

The maximum amount under the settlement will be $500,000 for patients diagnosed with terminal mesothelioma before age 45 and $260,000 for patients diagnosed with cancer of the ovary before age 45.

From there, the proposed settlement offers discounts based on the severity and type of cancer, the patient’s age, history of the use of talc, and other aspects. Does all talc have asbestos. For instance, a woman who used talc products on a weekly basis, who had a family history of ovarian cancer and was diagnosed the stage 2 ovarian cancer at the age of 55 may be eligible to receive a payment of $21,125 under the program.

Judge ordains J&J and talc opponents participate in settlement talks.

Following another hearing in Johnson and Johnson’s efforts to use a Texas Two-Step bankruptcy strategy to settle talc lawsuits and federal bankruptcy judge Michael Kaplan has ordered the company as well as those who oppose the plan to hold settlement talks, Bloomberg reports.

With its second bankruptcy attempt for LTL Management–a subsidiary established by J&J to settle claims – the company made a settlement offer of $8.9 billion. Does all talc have asbestos. While one firm representing plaintiffs is in favor of the offer, another group opposes the move.

Earlier this week, the opposition group, called”the Official Committee of Talc Claimants requested the bankruptcy court for dismissal of the matter by arguing that LTL is not a factor in financial hardship.

“The filing is a desperate and legally deficient attempt by a handful of law firms to try to prevent claimants from voting on the resolution plan, a plan that the vast majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Does all talc have asbestos. “The law firms behind these filings have interests in finance that clash with, diverge from and are in opposition to the interests which their clientele. We’ll be submitting an answer to the appellate court.”

Does all talc have asbestos. Clay Thompson, a lawyer for MRHFM which includes more than mesothelioma patients who have filed lawsuits against J&J claimed that the second bankruptcy attempt of J&J will fail.

“J&J sends out press releases describing how fantastic its plans are, but is demanding that plan details–including what the individual sick individuals would be treated to,” Thompson said in a statement. “What is J&J’s plan to cover up?”

Kaplan has directed the parties to devise a second strategy for reorganization, under the oversight from two mediators.

The court in February of 2022 Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that will free J&J from the thousands of lawsuits over its talcum products.

However, in January of this year a federal appeals court ruled against the verdict, ruling that the company could not be considered in “financial financial distress.”

In the event that J&J’s request to appeal to the U.S. Supreme Court was rejected in April, J&J filed for its second bankruptcy roughly two hours after. In response, Kaplan froze the lawsuits for 60 calendar days to decide whether to grant another bankruptcy.

J&J’s unstoppable profit engine goes out of control after $6.9B the talc litigation cost.

With the Two Chapter 11 attempts, J&J has gotten 19 months of which cases have been suspended. Does all talc have asbestos. The company wants claimants to decide whether they want to accept the settlement. J&J needs 75% of the vote for the deal to pass.

Alongside the group of talc lawyers who panned the company’s bankruptcy, the U.S. Trustee is an arm that is part of the U.S. Department of Justice is also submitting an appeal to dismiss LTL’s second bankruptcy.

In a filing this week, U.S. trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest, but naive debtors.” The doors “are not open to parties that do not have a legitimate purpose or that seek to abuse the bankruptcy process to hinder or delay their creditors.” Vara continued.

For its part, J&J maintains there is no definitive evidence to suggest that its products containing talc, such as its popular baby powder can cause cancer. J&J has taken its products off of the market–first for North America in 2020–and the rest of the world later this year.

J&J seeks to avoid the expense of going to court. It has won the majority of cases that have been decided through trial, though certain losses have been harsh.
A well-known trial in Missouri resulted in an $4.7 billion verdict against the drug maker but was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine talc trials that are either being appealed or concluded. Of the 41 trials, 32 ended with the favor of J&J as well as mistrials or verdict for a plaintiff that was dismissed upon appeal. Does all talc have asbestos. Additionally, the company has announced plans to settle nearly 1000 cases for $110 million. Bloomberg announced at that time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does All Talc Have Asbestos

June 2 2023 Update: At the asbestos talc trial in California yesterday, a few technical issues halted the opening statements made by defense lawyers. Does all talc have asbestos. Jurors watching from their homes via Zoom however, heard Johnson & Johnson’s lawyer expressing doubt about the science of the 70s that claimed asbestos was present in their product prior to the proceedings abruptly ended.

In the meantime, the plaintiff was able to introduce its first expert witness Arthur Langer. Langer explained that the occurrence of other minerals in the talc’s mineral content is inevitable. He also testified that his team advised J&J in the year 1971 of the presence of chrysotile asbestos the talc produced by the company, although at lower than 0.1 percent. He also discovered more asbestos in the year 1976.

June 1st, 2023 Update: Does all talc have asbestos. A trial for the first time since J&J took the decision to disband its talc division and declare bankruptcy is an important moment for the ongoing lawsuit saga. Trial began yesterday in the poignant case of a young 24 year-old plaintiff who was diagnosed with a rare and aggressive type of mesothelioma in the past year, an illness that lawyers on both sides believe is a harrowing tragedy.

Opening statements laid bare stark differences in each side’s story. The attorney for the plaintiff took aim on Johnson & Johnson, alleging the use of deceitful techniques in its research practices and throughout the litigation process. As per the lawyer Johnson & Johnson attempted to alter the definition of asbestos, in spite of internal documents from 1978 and 1994 showing that fibers discovered in the plaintiff’s tissue are included.

Johnson & Johnson’s precarious $8.9 billion settlement offer hangs in the balance with the progress of this trial. Despite the unique nature of this mesothelioma-related case and its distinct issues compared to most talcum powder lawsuits, a verdict favoring the plaintiff could cause a serious setback to J&J’s expectations of widespread acceptance of their settlement proposal among plaintiffs.

May 31st 2023: Update from Johnson & Johnson’s bankrupt talc division was able to defend the Second Chapter 11 filing in the facing challenges from talc injury claimants. In an appeal to the New Jersey bankruptcy court, J&J’s subsidiary claimed that the case differed fundamentally from the earlier filing. The subsidiary emphasized the record-breaking commitment of $8.9 billion in settlement from J&J the largest settlement ever made in any bankruptcy case that involves mass tort. Does all talc have asbestos. There was no mention of how the size of the settlement implies that it is an equitable settlement. J&J also claimed that it received support from various plaintiffs’ law firms that represent over 600,00 claimants. This is not easy to confirm but likely incorrect.

May 24 2023 Update: As of Johnson & Johnson’s 2021 bankruptcy filing, the very first trial involving its cosmetic talc products that are believed to with asbestos content is scheduled to commence jury selection on Monday, May 24, California with Alameda County Superior Court, which is a well-known location for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure resulting from J&J’s products, an allegation J&J is denying. The trial also includes six retailers who are accused of selling talc-based products.

May 22, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are battling over who should be appointed to the role of future claims representative. This is the role is crucially important to resolving the talc claims. Does all talc have asbestos. Randi Ellis, a lawyer who frequently appears in MDLs all over the nation was appointed as the claims representative during the first bankruptcy. J&J’s defense team would like Ellis to be appointed to that role and again, but attorneys for the plaintiffs in talc are arguing due to the fact that Ellis has conflicts of interest which would prohibit her from holding that position once more. This conflict is rooted in the reality that Ellis was believed to have been involved in drafting the controversially disputable second bankruptcy, raising doubts about her capacity to be neutral. It’s true that this bankruptcy is likely to be dismissed in the end.

May 17, 2023 Update: The pretend company J&J formed to settle the talc litigation bankruptcy has informed a New Jersey bankruptcy court that they had allocated $400 million to pay the claims of states that accuse the company of deceitful advertising regarding its talc products. Does all talc have asbestos. This amounts to an $8.5 billion settlement for cancer sufferers. It’s hard to imagine an eventuality where J&J can get the baby powder settlements given these numbers. While J&J’s $8.5 billion offer seems like a huge sum initially, it will not look good when you look at the numbers. This settlement proposal – by our estimates – will not provide victims with much more than $100,000 per case. That is not enough.

May 15th, 2023 update: J&J is potentially facing a lawsuit from an advocacy group that represents cancer patients. Does all talc have asbestos. The group claims J&J intentionally canceled the $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, in order to create a false sense of financial distress and validate the unit’s Chapter 11 bankruptcy filing. The group asserts this action could be interpreted as a fraudulent transfer of rights of compensation for victims. They plan to explore J&J’s actions in the wake of the decision to dismiss the first bankruptcy case of LTL.

May 10 2023 Update: Next week this week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy petition filed of J&J subsidiaries LTL Management. However, in the meantime LTL Management has filed an Order calling for both parties to participate in a new settlement mediation to see if an international settlement agreement can be been reached.

May 5, 2023 Update: The talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products cause cancer due to asbestos exposure. Does all talc have asbestos. Over 2700 people have sued the company and the company was spending $1 million a month for legal defense. The company’s recent $29million settlement at the Supreme Court of South Carolina forced it to apply for bankruptcy protection and argue that assets should be distributed in an equitable manner among talc claimants instead of being seized by the receiver. Other talc suppliers have also filed for bankruptcy due to the litigation.

May 4 2023 Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to reopen talks with lawyers who turned down the proposed $8.9 billion agreement. At Trenton, New Jersey yesterday the parties appeared in court to discuss next steps for another bankruptcy proceeding. Judge Kaplan encouraged further settlement talks.

This is the way to settle these claims with J&J. A baby powder settlement could get done. Does all talc have asbestos. But it will require more money, more billions of dollars of Johnson & Johnson.

Lawyers are divided over whether to take the proposal or not and not all clients see the issue in the same manner their lawyer does. The second bankruptcy case is bound to fail, the judge Kaplan has set a date for a hearing in June to determine if she will close the case for the third time.

May 3 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) asked that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt litigation regarding talc-related products. The group of talc claimants submitted a motion on Tuesday requesting that the Third Circuit to consider their case and then send it back to a lower court with instructions to discharge the bankruptcy. Does all talc have asbestos. They also asked that the stopped tort litigation against J&J be allowed to proceed.
LTL applied for Chapter 11 protection once again after its first bankruptcy filing was denied in the Third Circuit earlier this year with the possibility of an $8.9 billion agreement. The committee says that the recent ruling allowing LTL’s second Chapter 11 to continue, as well as halting the trials against J&J and J&J, requires immediate Third Circuit review. The US Trustee has also requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a statement to the appeals court characterizing the filing as an “desperate and legally insufficient attempt” by a small number of law firms who have different financial interests.
May 1, 2023 Update: One question people keep asking is how plaintiffs and their attorneys turn on $8.9 billion. That’s of course an immense amount of money. There are a lot of victims. Does all talc have asbestos. And these are really good cases for plaintiffs. We were reminded recently in two talc trials which resulted in big verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon ended in the verdict worth $18.1 million. The following month, a second talc mesothelioma case went to hearing at South Carolina and resulted in the verdict of $29 million to the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. one of the top producers of talc in the U.S.
April 30 2023 Update: When J&J initially attempted to pull the talcum powder lawsuit into bankruptcy, it did so with an offer to put aside $2 billion to settle the case. It was a ridiculously small amount. All of the talc plaintiffs believed in the proposal. However, this time, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and they have the support of a large section of the talc victims and their attorneys. Does all talc have asbestos. But with 75% of talc plaintiffs, which is required for bankruptcy plan approval is a difficult road with so many lawyers with massive inventories of baby powder lawsuits that are opposed against the proposed settlement.

What can be done to end the impasse? More billions.
April 25 2023 Update: Talc Cancer victims have requested a judge to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, insisting that the company is not financially troubled. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Does all talc have asbestos. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not a candidate to receive bankruptcy relief because it had not demonstrated financial stress.

The claimants assert that the third Chapter 11 case is an misuse of the bankruptcy system and that it’s being pursued in bad faith. J&J claims the bankruptcy settlement is backed by “significant backing” from the firms that represent approximately 60,000 people who are claiming. It is fair to say plaintiffs’ lawyers and victims ‘ lawyers are divided on the $8.9 billion offer for settlement.

April 21, 2023 Update: A bankruptcy judge decided the company Johnson & Johnson must face new lawsuits claiming that the company offered a baby powder with a contaminant that caused cancer. Although trials for Talc lawsuits are suspended for a minimum period of 60 days but new lawsuits can be filed and lawyers can begin preparing their cases. Does all talc have asbestos. The judge expressed skepticism over J&J’s attempt to relaunch its strategy in another bankruptcy case.

April 13, 2023 Update: biggest update is about the $8.9 billion over 25 years of settlement. Lawyers representing cancer patients within the MDL class action have pledged to fight the settlement along with talc claimants. Why? They believe it’s not enough to pay for 70,000 victims who have cancer. Does all talc have asbestos. These lawyers believe that J&J should negotiate a larger settlement or even litigate individual claims if the latest bankruptcy is dismissed.

But there’s a separate group of lawyers outside of the leadership in that class action. These lawyers have amassed many thousands of cases. This group wants to settle now in what many believe to be less than these victims deserve. Their argument appears to be two-fold. First, they argue that the settlement – which amounts to an average of $100,000 per plaintiff is fair.

This is an argument that is difficult to make. The second argument is more substance: the victims will now not wait and they want their money today.

April 12 2023 Update: Some people are looking for ways J&J could file for bankruptcy once more. The answer is complex and convoluted. However, let’s attempt to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future lawsuits involving talc conclusively. Also, it believes that it will be less expensive should there be an element of bankruptcy that puts pressure to settle. Does all talc have asbestos. Going back to 400 years of American past, the company claims that bankruptcy benefits everyone by dispersing settlements more equally and effectively than trial courts where some litigants receive significant awards while others receive nothing.

The essence of the 3rd Circuit decision was this is not a matter of a profitable company making an affiliate to accept the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, it also stated the company was in financial distress due to the fact that J&J assured it of unlimited funding.
Thus, J&J decided to go with the unlimited funding part of the holding and didn’t promise to fund unlimited litigation. The company claims that revised financing arrangements with its subsidiary addresses the concerns of the appellate court, while supplying funds for claim payments. In the hope that offering victims lower amounts of money would resolve the overarching problem.

Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is the legal argument. Does all talc have asbestos. They counter with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt by the victims’ lawyers, who call it the largest “fraudulent move of assets in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. It is however a method of trying to push this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023 Update: Bloomberg is running an intriguing report on a brand new law of New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a percentage of any settlements. J&J is now offering that it will pay $8.9 billion to settle all lawsuits.

The involvement of the funders is made public due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. This rule is intended to address the growing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you take into account state and federal baby powder lawsuits. Third-party funding of mass tort cases has its pros and pros and. But there is no question that we are witnessing the ways that third-party funding can even the playing field for individuals and big companies in court.

April 4 2023 Update: It’s fun to watch the worm turn in this lawsuit. J&J suffered another setback this week, when they were denied by the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals a bankruptcy decision at the U.S. Supreme Court. The automatic stay has halted hundreds of cases involving talcum powder and stopped new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc liabilities into a bankrupt subsidiary over one year earlier. Does all talc have asbestos. After it was decided that the 3rd Circuit ruled that this bankruptcy was not valid just a few months ago the stay was removed. J&J had hoped to have it continue in the meantime of its SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay being fully lifted, the first new cases were filed and incorporated into the talcum powder class action MDL in just over a year. Seven new talc cases were added to the MDL during the month of March, bringing the total number of cases in the pending process up to 37,522.

February 25 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J product containing talc has cost the government in the many years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the dangers of its talc products for years while tax dollars were used to treat those who were injured through exposure to the chemicals. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Does all talc have asbestos. J&J should begin to make reasonable settlement offers for victims in order the process of putting all this behind it. It is a stain on one of the most prestigious firms.

February 14 2023 Update: In an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
