April 12 2023 Update: Some people are looking for ways J&J could file for bankruptcy once more. The answer is complex and convoluted. However, let’s attempt to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future lawsuits involving talc conclusively. Also, it believes that it will be less expensive should there be an element of bankruptcy that puts pressure to settle. Does all talc have asbestos. Going back to 400 years of American past, the company claims that bankruptcy benefits everyone by dispersing settlements more equally and effectively than trial courts where some litigants receive significant awards while others receive nothing.

The essence of the 3rd Circuit decision was this is not a matter of a profitable company making an affiliate to accept the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, it also stated the company was in financial distress due to the fact that J&J assured it of unlimited funding.

They exchanged for a percentage of any settlements. J&J is now offering that it will pay $8.9 billion to settle all lawsuits.

The involvement of the funders is made public due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers.
