Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc lawsuits conclusively. Lawyers representing cancer victims who oppose the deal counter this with what you conclude is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s ruling. The hyperbole wasn’t spared by the victims’ lawyers, who call it the biggest “fraudulent move of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. But it is a way to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.

The involvement of the funders is made public because of the New Jersey court rule requiring the release of certain details regarding outside funding backers.
