Does cuticura talc contain asbestos. Randi Ellis, a lawyer who regularly appears in MDLs throughout the country was appointed as the claims representative in the initial bankruptcy. J&J’s defense team wants Ellis to be appointed to that role in the future, however lawyers representing the talc plaintiffs have raised objections to the claim that Ellis has an unrelated conflict of interest which would prohibit her from being appointed to that post once more. The conflict stems from the issue that Ellis was involved in the drafting of the highly contested second bankruptcy, which raises doubts about her ability to be neutral. Lawyers have a split opinion on whether or not to agree with the proposal and not all clients view the issue the same way their lawyer views it. LTL requested Chapter 11 protection once again after its first bankruptcy filing was denied by the Third Circuit earlier this year with an $8.9 billion payment. The US Trustee requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a statement to the appeals court calling the request an “desperate and legally flawed plan” by a select group of law firms that have competing financial interests.
May 1st 2023 Update: One frequently asked question is how could the plaintiffs’ lawyers and their clients turn on $8.9 billion. Of course, that is an immense amount of money. There are a lot of victims. Does cuticura talc contain asbestos. And these are really good case for plaintiffs. We were reminded recently by two talc-related trials that ended in large verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in an award of $18.1 million. In the same month, a different mesothelioma-related talc case went to hearing on the other side of South Carolina and resulted in the verdict of $29 million to the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc., one of the most prominent producers of talc in the U.S.
April 30 2023 Update: When J&J first tried to bring the talcum powder lawsuit into bankruptcy, they came with an offer to set aside $2 billion to settle the case. This was an absurdly low amount. All of the talc plaintiffs agreed with the proposal. However, this time, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and also has the backing of a significant portion of the talc plaintiffs and their lawyers. Does cuticura talc contain asbestos. But with 75% of talc plaintiffs, which is necessary for bankruptcy plan approval, it a tough road with so many lawyers with massive inventories of baby powder litigations opposed towards the agreement.
What can be done to end the impasse? More billions.
April 25 2023 Update Talc plaintiffs have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Does cuticura talc contain asbestos. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not eligible for bankruptcy relief since it did not show financial trouble.
The claimants argue that LTL’s 2nd Chapter 11 case is an misuse of the bankruptcy system and it’s being conducted in bad good faith. J&J claims the bankruptcy settlement is backed by “significant support” from the firms that represent approximately 60,000 plaintiffs. It’s safe to say plaintiffs’ lawyers and the victims are split over their disagreement over the $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge decided that Johnson & Johnson must face new lawsuits alleging that the firm offered a baby powder with a contaminant that caused cancer. Although trials for the lawsuits involving talc are delayed for a minimum of 60 days and new lawsuits are able to be filed and lawyers will begin preparing their cases. Does cuticura talc contain asbestos. The judge expressed skepticism over J&J’s absurd attempt to revive its plan with another bankruptcy case.
April 13, 2023 Update: The major announcement is an $8.9 billion over 25 years of settlement. Lawyers representing cancer patients who are part of MDL class action MDL collective action vowed to fight the settlement along with those who claim talc. Why? They believe it’s too little money for the those suffering from cancer who are 70,000. Does cuticura talc contain asbestos. The lawyers say that J&J should negotiate a larger settlement or pursue individual claims in the event that the latest bankruptcy is declared unconstitutional.
But there is another set of lawyers who are not part of the leadership group in group action. These lawyers have amassed tens of thousands of cases. The group is seeking to settle today with what they believe is less than the victims deserve. Their argument is twofold. They argue that the settlement – which amounts to 100,000 dollars per plaintiff is fair.
That is a hard argument to argue. The second argument is more force: victims should now not wait and they want their money today.
April 12 2023 Update: Many are seeking out how J&J is able to file for bankruptcy again. The answer is complex and confusing. However, let’s attempt to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc-related lawsuits definitively. In other words, it thinks it will pay less if there is an element of bankruptcy that puts pressure to negotiate a settlement. Does cuticura talc contain asbestos. Moving past 400 years of American past, the company claims that bankruptcy benefits all parties because it distributes settlement payments more evenly and more efficiently than trial courts where some litigants receive significant payouts, while others are left with nothing.
The gist in the 3rd Circuit decision was this is not a matter of a profitable company making an affiliate to accept the legal risk and declare bankruptcy, which is what Congress considered when it was drafting the Bankruptcy Code. It also clarified it was not financially distress because J&J offered unlimited financing.
Thus, J&J jumped on the funding unlimited part of the agreement and did not promise to fund unlimited litigation. The company claims that its modified financing arrangements with its subsidiary address appeals court’s concerns while still providing funds for claims. As if offering victims less money would solve the overall issue.
Attorneys representing cancer victims who do not agree with the agreement counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt attorneys representing the victims claim this the biggest “fraudulent transaction in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way to try and push the $8.9 billion settlement and keep pressure on plaintiffs.
April 10 2023 Update: Bloomberg provides an insightful piece on a law that has been passed that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any winnings. J&J is now willing the payment of $8.9 billion to settle all lawsuits.
The funders’ involvement is publicly available because of the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to address the rising calls for regulation of litigation funders. J&J faces over 60,000 claims when you include state and federal infant powder litigation. Third-party funding for mass tort lawsuits has pros and pros and. But there is no question that we are seeing how third-party financing can help level the playing field for individuals and large corporations in the courtroom.
April 4 2023 Update: It is pleasing to see the worm turning in this case. J&J has taken another blow this week, when they were denied by the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy ruling in the U.S. Supreme Court. Automatic stays have stopped hundreds of cases involving talcum powder and prevented new lawsuits from arising ever since J&J started the controversial process to spin the talc liability into a bankrupt company over one year earlier. Does cuticura talc contain asbestos. After the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was lifted. J&J wanted to see it stayed in place until the SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that of the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: with the bankruptcy stay having been in effect, the first new cases were filed and incorporated into the talcum powder class action MDL in over one year. Seven new talc lawsuits have been included in the MDL over the last month increasing the number of cases pending to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J product containing talc has cost the government in the decades.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products over years while tax dollars were spent on treating people who suffered injuries from exposure to the chemicals. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Does cuticura talc contain asbestos. J&J should begin to make reasonable settlement proposals to victims to the process of putting all this behind. This is a blemish on one of the greatest firms.
February 14 2023 Update: At an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
