April 30, 2023 Update: When J&J first tried to bring the lawsuit over talcum powder into bankruptcy, it did so with an offer to reserve $2 billion to settle the case. The amount was absurdly low. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs agree to a bankruptcy settlement and they also have the support of a large portion of the talc plaintiffs and their lawyers. Does Johnson and Johnson talc cause cancer. But with 75% of plaintiffs of talc are required to approve bankruptcy plans It’s a long and difficult process because of the number of lawyers who have large inventory of baby powder litigations opposed to the settlement.
What are the solutions to the impasse? More billions.
April 25 2023, Update Talc Cancer victims have demanded a judge disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does Johnson and Johnson talc cause cancer. It was the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company was not eligible for bankruptcy relief as it had not demonstrated financial trouble.
The plaintiffs argue that LTL’s Second Chapter 11 case is an fraud on the bankruptcy system and it is being pursued in bad faith. J&J says the bankruptcy settlement receives “significant support” from the firms that represent about 60,000 potential plaintiffs. It’s fair to say that the plaintiffs’ attorneys and victims are divided over what they believe is an $8.9 billion offer for settlement.
April 21st, 2023 Update: A bankruptcy judge decided in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Judges expressed doubt about J&J’s ridiculous effort to revive its plan with the second bankruptcy case.
April 13 2023 Update: big update is about the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims involved in the MDL class action have promised to fight the settlement along with those who claim talc. Why? They believe it’s not enough to pay for 70,000 victims who have cancer. Does Johnson and Johnson talc cause cancer. They argue that J&J should negotiate a bigger settlement or pursue individuals’ claims if the current bankruptcy is thrown out.
However, there is a second lawyer group that isn’t part of the leadership in that class action. These lawyers have collectively amassed tens of thousands of cases. They want to settle the case now for what many argue is less than these victims deserve. Their argument seems to be twofold. First, they argue that the settlement of around 100 million dollars on average per plaintiff – is fair.
This is an argument that is difficult to prove. However, their second argument has more substance: the victims will now not wait and they want their money now.
April 12 2023 Update: Many are wondering if J&J is able to file for bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc litigations in a definitive manner. In other words, it thinks it can get a lower rate when there is an element of bankruptcy that puts pressure to settle. Does Johnson and Johnson talc cause cancer. Driving past hundreds of years of American time, the business claims that bankruptcy benefits all parties because it distributes settlements more fairly and more efficiently than trial courts which are where litigants get significant payouts, while others are left with nothing.
The essence in the 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming a subsidiary to take the legal liability and declare bankruptcy, which is what Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated that the subsidiary was not in financial difficulty due to the fact that J&J promises unlimited funding.
So J&J took advantage of the unlimited funding part of the deal and didn’t promise to offer unlimited funding for the litigation. J&J claims that its new financing agreements with its subsidiary will address concerns of the appellate court, while offering funds to pay claims. As if providing victims with lower amounts of money would resolve the overarching problem.
Lawyers representing cancer patients who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt: victims’ lawyers call this the biggest “fraudulent transaction that has occurred in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. However, it’s a means to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.
April 10, 2023, Update Bloomberg offers an informative article about a new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) over talc products in exchange for a share of any profits. J&J is now willing an offer of $8.9 billion to settle any lawsuits.
The involvement of the funders is publicly available because of a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The law is designed to address the growing calls for regulation of litigation funders. J&J has more than 60,000 claims when you include federal and state Baby Powder lawsuits. Third-party funding of mass tort cases is not without its pros and cons. However, there is no doubt that we are seeing how third-party funding could level the playing field between people and big companies in court.
April 4 2023 Update: It is enjoyable to see the worm turn in this case. J&J has taken another blow this week when the Third Circuit denied J&J’s request to continue the automatic stay as J&J appeals an order granting bankruptcy at the U.S. Supreme Court. It has frozen thousands of talcum cases and stopped any new lawsuits from getting filed ever since J&J initiated the controversial effort to spin the talc liabilities off into a bankrupt subsidiary over a year ago. Does Johnson and Johnson talc cause cancer. After the 3rd Circuit ruled that this bankruptcy was not valid some months ago, the stay was lifted. March 16, 2023 Update: with the bankruptcy stay now officially lifted, the first new cases were filed and incorporated into the class action for talcum powder MDL in just over a year. Seven new talc cases were brought into the MDL over the last month increasing the number of pending cases up to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) launch an investigation into the amount J&J product containing talc has cost the government over the decades.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the risks of its talc product for many years, while tax dollars were spent on treating people who suffered injuries from exposure to the chemicals.
