J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm plans to pay different kinds of cancer victims as part of a bankruptcy settlement. April 13th, 2023 update: the biggest story is that there’s an $8.9 billion over 25 years of settlement. Lawyers representing cancer victims involved in the MDL collective action vowed to challenge the settlement talc claimants. Why? Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future lawsuits involving talc conclusively. Lawyers representing cancer patients who oppose the deal counter the agreement with what is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier decision. Hyperbole did not go unnoticed: victims’ lawyers call it the biggest “fraudulent transfer that has occurred in United States history.”
In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way of trying to push this $8.9 billion settlement, and to keep the pressure on plaintiffs.
