May 1 2023 Update: A question people keep asking is how could the plaintiffs’ lawyers and their clients turn around $8.9 billion. Of course, it’s an enormous amount of money. But there are plenty of victims. Does liquid talc cause cancer. These are actually a good cases for plaintiffs. We were reminded recently when two talc cases resulted in big verdicts for the plaintiffs. April 30th 2023 Update: In the year 2023, when J&J first attempted to drag the talcum powder lawsuit into bankruptcy, it came with an offer to set aside $2 billion to settle the case. It was a ridiculously small amount. None of the talc plaintiffs believed in the offer. The 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief because it failed to show financial trouble.
The claimants contend that the second Chapter 11 case is an fraud on the bankruptcy system and it’s being pursued in bad good faith. J&J asserts that the bankruptcy settlement has “significant backing” from the firms that represent about 60,000 potential plaintiffs. It is fair to say that the plaintiffs’ attorneys and victims are divided over this $8.9 billion settlement offer.

Judges expressed skepticism about J&J’s ridiculous effort to revive its strategy by filing the second bankruptcy case.
April 13th 2023 Update: biggest news is the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer patients who are part of the MDL group action vowed to fight the settlement with talc claimants. Why? They believe it’s not enough for 70,000 victims who have cancer. Does liquid talc cause cancer. The lawyers say that J&J could negotiate a greater settlement or litigate individual claims in the event that the latest bankruptcy is thrown out.
But there’s a separate group of lawyers that is not part of the top leadership in the class action. These lawyers have collectively amassed hundreds of thousands of cases. The group is seeking to settle for what many argue is lower than what the victims should be paid. Their argument seems to be two-fold. First, they argue the settlement – which amounts to 100 million dollars on average per plaintiff – is fair.
This argument isn’t easy to present. But their second argument has more teeth: victims can be no longer patient and demand the money immediately.
April 12 2023 Update: Many are wondering if J&J could file for bankruptcy once more. The answer is complex and complicated. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future talc litigations in a definitive manner. Also, it thinks it will pay less in the event of a bankruptcy component that applies pressure to settle. Does liquid talc cause cancer. Going back to hundreds of years of American history, the company argues that bankruptcy benefits all parties by distributing settlement payments more equitably and more efficiently than trial courts where some litigants receive significant payouts, while others are left with nothing.
The gist of this 3rd Circuit decision was this isn’t a case that involves a profitable company making an entity to assume the legal burden and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. It also clarified it was not financially distress due to the fact that J&J promised unlimited funding.
Thus, J&J did not hesitate to take advantage of the funding unlimited part of the deal and didn’t promise that it would provide unlimited funds for lawsuits. J&J claims that its modified financing arrangements with its subsidiary addresses the concerns of the appeals court while offering funds to pay claims. As if providing victims with lesser money could solve the overarching problem.
Lawyers representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole did not go unnoticed: victims’ lawyers call it the most significant “fraudulent transfer of assets in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10 2023 Update: Bloomberg offers an informative report on a brand new law of New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any settlements. J&J has now offered to pay $8.9 billion to settle lawsuits.
The involvement of funders is publicly available because of a New Jersey court rule requiring the release of certain details regarding outside funding backers. The law is designed to address the growing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you take into account state and federal baby powder lawsuits. Third-party financing in mass tort cases has pros and cons. However, there is no doubt that we are witnessing how third-party funding can level the playing field between people and big companies in court.
April 4 2023 Update: It is enjoyable to see the worm turning in this lawsuit. J&J has taken another blow this week when an appeals court in the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals a bankruptcy ruling to the U.S. Supreme Court. This automatic stay frozen the cases of talcum powder in a number of years and prevented the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt subsidiary over a year in the past. Does liquid talc cause cancer. After the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was revoked. J&J wanted to see it stayed in place until an appeal to the SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to take up the appeal? Low.

Seven new talc lawsuits have been brought into the MDL over the last month increasing the number of cases pending to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee is now calling for authorities from the U.S. Government Accountability Office (GAO) initiate an investigation to determine how much J&J product containing talc has cost the government in the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc-based products for years while tax dollars were utilized to treat people injured by exposure to the product.
