There is a different group of lawyers that is not part of the leadership in this class action. These lawyers have amassed many thousands of cases. They want to settle in what many believe to be less than these victims deserve. Their argument appears to be two-fold. First, they argue the settlement, which is about 100 million dollars on average per plaintiff is fair.

In other words, it believes it can pay less in the event of the bankruptcy element which applies pressure to settle. Does pure cornstarch baby powder have talc in it. In a quest to cover the 400-year span of American history, the company argues that bankruptcy benefits all parties because it distributes settlements more fairly and more efficiently than trial courts which are where litigants get significant awards while others receive nothing.
The main thrust in this 3rd Circuit decision was this is not a matter of the profit-making company that has subsidiaries to meet the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. But it also said that the subsidiary was not financially trouble because J&J promised unlimited funding.
Then J&J decided to go with the unlimited funding portion of the deal and did not promise to provide unlimited funding for litigation. J&J claims that its revised financing arrangements with its subsidiary will address appeals court’s concerns while still supplying funds for claim payments. It’s as if giving victims less money would solve the overarching problem.
Lawyers representing cancer patients who are against the agreement argue this with what you conclude is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s ruling. They exchanged for a share of any wins. J&J is now offering to pay $8.9 billion to settle all lawsuits.
The involvement of funders is publicly available because of the New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to address the growing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you include federal and state infant powder litigation. Third-party funding of mass tort cases has both pros and pros and. But there is no question that we are seeing how third-party financing can help level the playing field for individuals and big corporations in court.
April 4 2023 Update: It’s pleasing to see the worm turn in this legal battle. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc products for long while tax dollars used to treat those who were injured through exposure to the chemicals.
