June 1, 2023 Update: Does talc actually cause cancer. The first trial since J&J made the decision to split its Talc division, and then declare bankrupt marks an important point for the ongoing lawsuit saga. Trial began yesterday in the heartbreaking case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma in the past year, which lawyers on both sides acknowledge is a grave tragedy.
Opening statements laid bare huge differences between the sides’ story. The plaintiff’s attorney took aim on Johnson & Johnson, alleging that the company employed deceitful strategies in its research practices as well as throughout the litigation process. In the words of attorney, Johnson & Johnson tried to alter the definition of asbestos, in spite of internal documents from between 1978 and 1994 that showed fibers discovered in the tissues of the plaintiff are part of.
Johnson &J’s highly uncertain $8.9 billion settlement deal hangs in the balance with the development of the trial. Despite the distinctive nature of this mesothelioma-related case and its distinctive issues in comparison to other talcum powder lawsuits, a verdict favoring the plaintiff could result in an enormous setback for J&J’s hope of gaining broad acceptance for their settlement proposal among plaintiffs.
May 31st 2023: Update from Johnson & Johnson’s bankrupt talc business is defending their 2nd Chapter 11 filing in the face of challenges from injured talc claimants. Does talc actually cause cancer. It was not mentioned how the amount of the settlement means it is a fair settlement. J&J also claimed that it received support from a variety of plaintiffs’ law companies representing over the 60,000 plaintiffs. This is difficult to verify but likely incorrect.

May 22, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are fighting over who should be chosen to fill the position of the claims representative in the future, the role is crucially essential to the resolution of the Talc claims. Does talc actually cause cancer. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States, was appointed as the claims representative in the previous bankruptcy. J&J’s defense attorneys want Ellis to be appointed in that position and again, but attorneys for the talc plaintiffs are objecting to the claim that Ellis has an interest conflict which would prohibit her from assuming that position again. The conflict stems from the issue that Ellis was involved in drafting the controversially contested second bankruptcy, which raises concerns about her capability to remain neutral. It’s true that this bankruptcy is likely to get dismissed anyway.
May 17th, 2023 Update: The pretend company J&J created for the talc bankruptcy told a New Jersey bankruptcy court that they had allocated $400 million to settle the claims made by states accusing the company of deceitful advertising regarding its talc products. Does talc actually cause cancer. It’s a $8.5 billion settlement for cancer victims. It’s difficult to imagine an eventuality where J&J can push these settlements for babies given these numbers. Although J&J’s $8.5 billion offer may seem like a lot initially, it may not look good when you do the math. This settlement proposal – by our rough calculations, would not pay victims much more than a median settlement of $100,000 per instance. It’s not enough.
May 15 2023 update: J&J may be in the middle of a lawsuit from an advocacy group that represents cancer victims. Does talc actually cause cancer. The group claims that J&J intentionally withdrew an $61.5 billion contract for funding together with its parent company, LTL Management LLC, in order to create a false sense of financial distress and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of right to compensation for victims. They are planning to study J&J’s actions as a result of the dismissal of LTL’s first bankruptcy suit.

The company’s recent $29 million verdict on the state of South Carolina forced it to file for bankruptcy protection, arguing for a fair distribution of assets between talc claimants rather than being confiscated from the receiver. Other talc suppliers have also been forced to file for bankruptcy as a result of litigation.
May 4, 2023 Update U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to restart settlement discussions with lawyers who have rejected the company’s proposed $8.9 billion agreement. It was in Trenton, New Jersey yesterday the parties appeared in court to discuss the next steps for this second case of bankruptcy and Judge Kaplan pushed more settlement talks.
This is the solution to resolve the claims of J&J. The baby powder settlement is likely to get done. Does talc actually cause cancer. But it will require additional money – perhaps billions of dollars – coming from Johnson & Johnson.
Lawyers have a split opinion on whether to take the proposal or not and not every client sees the issue in the same manner their lawyer does. A second bankruptcy proceeding is expected to fail with Judge Kaplan has scheduled a hearing in June to determine if she will close the case for the third time.
May 3 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) asked that J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block litigation over talc products. The committee representing talc claimants made a motion Tuesday requesting for the Third Circuit to consider their case and send it back the lower court with instructions for dismissing the bankruptcy. Does talc actually cause cancer. The committee also requested that the lawsuit against the halted torts of J&J allow the litigation to proceed.
LTL requested Chapter 11 protection once again after its bankruptcy filing was denied in the Third Circuit earlier this year, offering the possibility of an $8.9 billion payment. The committee believes that the recent decision allowing LTL’s third Chapter 11 to continue, in addition to halting trials against J&J is a reason for immediate Third Circuit review. The US Trustee also requested that it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a formal response in the appeals court, characterizing the filing as a “desperate and legally deficient move” by a small number of law firms that have conflicts of financial interests.
May 1st, 2023 Update: One question people keep asking is how the plaintiffs’ lawyers and their clients turn on $8.9 billion. Of course, that’s an immense amount of money. But there are plenty of victims. Does talc actually cause cancer. These are actually a good arguments for plaintiffs. We were reminded recently in two talc trials which ended in large verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon resulted in a verdict in the amount of $18.1 million. A month later, another talc mesothelioma case went to trial in South Carolina and resulted in a verdict of $29 million on behalf of the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc., one of the most prominent suppliers of talc in the U.S.
April 30th, 2023 Update: When J&J initially tried to take the lawsuit over talcum powder into bankruptcy, it came with an offer to put aside $2 billion for settlements. This was an absurdly low amount. All of the talc plaintiffs believed in the proposal. This time, J&J has increased the offer to $8.9 in the event that the talc victims will allow a bankruptcy settlement and they also have the support of a substantial portion of the talc plaintiffs as well as their lawyers. Does talc actually cause cancer. But 75% of the plaintiffs of talc are required for bankruptcy plan approval is not an easy task with so many lawyers with huge inventory of baby powder-related lawsuits, opposed to the settlement.
What could solve the impasse? More billions.
April 25 2023 update: Talc cancer claimants have demanded a judge reject the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, saying the company is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Does talc actually cause cancer. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief since it failed to show financial stress.
The claimants assert that the second Chapter 11 case is an overreach of the bankruptcy system, and that it’s being conducted in bad good faith. J&J states that the bankruptcy settlement has “significant support” from companies representing about 60,000 potential claimants. It is fair to say that plaintiffs’ lawyers and victims are divided over their disagreement over the $8.9 billion offer for settlement.
April 21st, 2023 Update A bankruptcy judge ruled that Johnson & Johnson must face new lawsuits alleging that it sold baby powder that was contaminated and causing cancer. Although the trials for the talc lawsuits have been suspended for a minimum period of 60 days and new lawsuits are able to be filed and lawyers can begin preparing their cases. Does talc actually cause cancer. Judges expressed doubt about J&J’s absurd attempt to relaunch its strategy in another bankruptcy case.
April 13th 2023: Update on the biggest news is the $8.9 billion over 25 years offer for settlement. Lawyers representing cancer patients in MDL class action MDL collective action promised to fight the settlement along with Talc claimants. Why? They think it is not enough to pay for 70,000 victims who have cancer. Does talc actually cause cancer. They argue that J&J should negotiate a larger settlement or even litigate individual claims if the most recent bankruptcy is dismissed.
But there’s a separate group of lawyers that is not part of the top leadership in the class action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle for what is believed to be less than these victims deserve. Their argument appears to be two-fold. First, they argue the settlement, which is about 100 million dollars on average per plaintiff – is fair.
This argument isn’t easy to make. But their second argument has more substance: the victims will no longer wait and want the money immediately.
April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy once more. The answer is complex and confusing. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc-related lawsuits definitively. Also, it believes it can pay less should there be a bankruptcy component that applies pressure to negotiate a settlement. Does talc actually cause cancer. Driving past more than 400 years in American history, the company claims that bankruptcy benefits all parties by distributing settlements more fairly and more efficiently than trial courts where some litigants receive significant payouts, while others are left with nothing.
The basic tenet of the 3rd Circuit decision was this isn’t a case that involves one that makes a profit, but subsidiaries to meet the legal burden and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. It also clarified the company was in financial trouble because J&J promised unlimited funding.
So J&J jumped on the unlimited funding part of the contract and didn’t make any promises to fund unlimited litigation. J&J claims that its modified financing arrangements with its subsidiary addresses the concerns of the appellate court, while offering claim payment funds. As if offering victims lower amounts of money would resolve the overarching problem.
Attorneys representing cancer victims who oppose the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous decision. Hyperbole is not exempt attorneys representing the victims claim it the most significant “fraudulent move in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. However, it’s a means to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10, 2023 Update Bloomberg offers an informative piece on a law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any profits. J&J is now offering an offer of $8.9 billion to settle any lawsuits.
The funders’ involvement is made public due to a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. This rule is intended to respond to the increasing calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine federal and state baby powder lawsuits. Third-party funding in mass tort claims is not without its pros and pros and. But there is no question that we are seeing how third-party financing can help level the playing field for individuals and big corporations in court.
April 4 2023 Update: It is fun to watch the worm turning in this case. J&J took another hit this week when the Third Circuit denied J&J’s request to extend the automatic stay as J&J appeals a bankruptcy ruling at the U.S. Supreme Court. The automatic stay has frozen thousands of talcum cases and stopped new lawsuits from arising ever since J&J launched the controversial attempt to spin talc-related liabilities off into a bankrupt subsidiary over one year in the past. Does talc actually cause cancer. When the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was lifted. J&J wanted to see it continued pending its SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that for the Supreme Court is willing even to accept the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay having been in effect, the first new cases have been filed and transferred into the Talcum Powder class action MDL within a year. Seven new talc-related lawsuits were joined to the MDL during the month of March which brings the total number of cases that are pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) initiate an investigation into the amount J&J products containing talc have cost the government over the years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the risks of its talc products over years while tax dollars were spent treating those injured by exposure to the chemicals. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Does talc actually cause cancer. J&J has to begin making fair settlement offers for victims in order to put all of this behind it. This is a blemish on one of the most prestigious companies.
February 14 2023 Update: In the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
