Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc lawsuits conclusively. Hyperbole is not exempt: victims’ lawyers call it the biggest “fraudulent transaction in United States history.”
Despite the legal jargon, J&J does not really think that the bankruptcy will endure. It is however a method of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
