Some states had started consumer protection actions against J&J prior to LTL’s bankruptcy filing stopped those investigations from moving forward in 2021. Does talc cause prostate cancer. New Mexico and Mississippi had already launched lawsuits for damages against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas according to court papers.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy, joining cancer victims as well as The U.S. Justice Department’s bankruptcy watchdog, who have argued that a profitable business like J&J is not eligible for bankruptcy protections designed for struggling debtors.
The first attempt by LTL to resolve the lawsuits in bankruptcy was thrown out after similar arguments, when a U.S. appellate court decided it was not LTL did not have “financial financial distress” and was not eligible of bankruptcy protection. Does talc cause prostate cancer. LTL made a new bankruptcy application less than two hours after the decision to dismiss, arguing that its second attempt was different in that there was less money available and had more support for an agreement.

New Mexico and Mississippi said in their motion to dismiss LTL’s new bankruptcy violates the state’s law enforcement authority in attempting to unilaterally limit LTL’s liability to state consumer protection actions.

LTL’s filings for the new year also contained additional details about how the company would assess and pay claims for cancer in the event that the bankruptcy plan is approved.

The largest amount of money under the settlement will be $500,000 for those diagnosed with mesothelioma terminal prior to age 45, and $260,000 for those diagnosed with cancer of the ovary before age 45.

From there, the proposed settlement applies discounts depending on the nature and severity of cancer, an individual’s age, the history of using talc and other factors. For instance someone who regularly used talc products on a weekly basis, who had an ancestral history of ovarian cancer and was diagnosed stage II ovarian cancer by age 55 may be eligible to receive a payment of $21,125 under the plan.

Judge orders J&J, talc opponents to engage in settlement talks.

After another round of hearings in Johnson & Johnson’s attempt to use a Texas Two-Step bankruptcy strategy to settle talc lawsuits, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposed to the plan to hold negotiations to settle the matter, Bloomberg reports.

In its second bankruptcy effort for LTL Management, a subsidiary set up by J&J to hold the claims–the company offered a settlement amounting to $8.9 billion. Does talc cause prostate cancer. While a group of law firms representing plaintiffs supports the settlement, a different group is against the settlement.

The previous week, the opposition group, called the Official Committee of Talc Claimants requested the bankruptcy court to dismiss this case argument that LTL can not be considered in financial distress.

“The filing is a desperate and legally deficient attempt by a tiny number of law firms to try to block claimants from voting on the resolution plan, a plan that the overwhelming majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in an announcement. Does talc cause prostate cancer. “The law firms behind these filings have interests in finance that conflict with, diverge from, and oppose the interests that their customers. We will be submitting an answer in the appeals court.”

Does talc cause prostate cancer. Clay Thompson, a lawyer for MRHFM which is home to more than mesothelioma victims who have filed lawsuits against J&J and J&J, has said that the company’s second bankruptcy try failed.

“J&J sends out press releases that boast about how amazing its plan is while simultaneously insisting that the details of its plan–including the treatment individual sick people would actually be treated to,” Thompson said in an email. “What does the company have to keep secret?”

Kaplan has directed the parties to create a restructuring plan, with the oversight by two mediators.

As of February 2022 Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that will free the company from the tens of thousands of claims over its talcum products.

In January of this year, an appeals court in the United States overturned the decision, ruling that the firm could not be considered to be in “financial difficulty.”

When J&J’s attempt to contest the U.S. Supreme Court was rejected on April 1, J&J filed for its second bankruptcy roughly two hours later. In response, Kaplan froze the lawsuits for 60 days to decide whether to allow an additional bankruptcy.

J&J’s omnipotent profit engine fails after $6.9B settlement charge for talc.

Through two Chapter 11 attempts, J&J has gotten 19 months of which cases have been on hold. Does talc cause prostate cancer. J&J wants the claimants to take a vote to accept their settlement. J&J needs 75% acceptance for the deal to go through.

Alongside the group of talc lawyers who panned the bankruptcy of the company, the U.S. Trustee, an arm that is part of the U.S. Department of Justice is also submitting an application to dismiss the second bankruptcy case of LTL.

In a statement this week, U.S. Trustee Andrew R. Vara wrote that the doors of the bankruptcy court remain “open to honest, but naive debtors.” Those doors “are not open to any parties that lack a legitimate bankruptcy goal or who seek to abuse the bankruptcy process to hinder or delay their creditors.” Vara continued.

To its credit, J&J maintains there is no proof conclusive that their Talc products, which includes its famous baby powder, cause cancer. J&J has adopted the products of the market–first on North America in 2020–and the rest of the world later this year.

J&J seeks to avoid the cost of going to trial. The company has won the majority of the cases that have been decided at trial, but certain losses have been extremely severe.
A well-known trial in Missouri ended in an $4.7 billion judgment against the drug manufacturer that was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial involving talc that are on appeal or have been concluded. Of the 41 trials, 32 ended with the favor of J&J or a mistrial, or verdict for a plaintiff that was dismissed in appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does Talc Cause Prostate Cancer

June 2 2023 Update: In the trial for asbestos-containing talc which took place in California yesterday, a couple of technical issues disrupted the opening statements of the defense attorneys. Does talc cause prostate cancer. Jurors who were watching from home on Zoom, did hear Johnson &Johnson’s lawyer express doubt about the science of the 70s claiming asbestos was present in their product, but the proceedings abruptly ended.

Meanwhile, the plaintiff had the opportunity to introduce the first of their witnesses, Arthur Langer. Langer explained that the existence of other minerals with the talc’s mineral content is inevitable. He testified that his team advised J&J in 1971 of the presence of chrysotile asbestos the talc of the company, but at lesser than 0.1 percent. He also uncovered more asbestos in the year 1976.

June 1, 2023 Update: Does talc cause prostate cancer. The first trial since J&J decided to spin off its Talc division and declare bankruptcy marks an important moment for the ongoing litigation story. The trial started yesterday in the poignant case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma last year, an illness that lawyers on both sides acknowledge is a grave tragedy.

Opening statements laid bare huge differences between the sides’ story. The plaintiff’s attorney took aim towards Johnson & Johnson, alleging that the company employed deceitful strategies in its research practices as well as throughout the litigation process. According to the attorney Johnson & Johnson attempted to alter asbestos’ definition, in spite of internal documents from between 1978 and 1994 that showed fibers discovered in the plaintiff’s tissue are included.

Johnson & Johnson’s precarious $8.9 billion settlement proposal hangs in the balance with the course of this trial. Despite the distinctive nature of this mesothelioma lawsuit and its unique challenges compared to other talcum powder lawsuits and a decision in favor of the plaintiff could be an unintended setback to Johnson & J’s hopes for broad acceptance of their proposed settlement with plaintiffs.

May 31 2023: Update from Johnson & Johnson’s bankrupted talc unit has was able to defend the two-time Chapter 11 filing in the facing challenges from talc injury claimants. In a written objection to the New Jersey bankruptcy court, the company argued that the case differed fundamentally from the previous filing. It highlighted the extraordinary commitment of $8.9 billion from J&J as the largest settlement ever made in the history of a mass tort bankruptcy. Does talc cause prostate cancer. The issue is not discussed: whether the magnitude of the settlement means it is a fair settlement. J&J also claimed that it received support from a variety of plaintiffs’ law firms representing more than sixty thousand claimants. This is not easy to confirm but it’s likely to be false.

May 24 2023 Update: Following Johnson & Johnson’s bankruptcy in 2021 filing, the very first trial concerning its cosmetic talc items allegedly containing asbestos is set to start jury selection on Monday, California with Alameda County Superior Court, which is a well-known jurisdiction for plaintiffs. The plaintiff claims his mesothelioma was triggered by asbestos exposure resulting from J&J’s products and that the company has denied. The trial also involves six retailers accused of selling talc-containing products.

May 22, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are currently battling over who should be chosen to fill the position of future claims representative, the role is crucially essential in resolving the claim for talc. Does talc cause prostate cancer. Randi Ellis, a lawyer who is frequently involved in MDLs across the country was appointed as the claims representative in the initial bankruptcy. J&J’s defense team wants Ellis to be appointed to that role and again, but attorneys for the talc plaintiffs are protesting to the claim that Ellis has an unrelated conflict of interest which should stop her from assuming that position in the future. This conflict is rooted in the issue that Ellis was reportedly involved in drafting the hotly contested second bankruptcy, which raises concerns about her capacity to be neutral. In reality, this bankruptcy will likely to be tossed out anyway.

May 17, 2023 Update The fake company J&J formed for the talc bankruptcy told an New Jersey bankruptcy court that they have allocated $400 million as a settlement for claims of states that accuse the company of misleading advertising for its talc products. Does talc cause prostate cancer. So that makes it an $8.5 billion settlement for cancer victims. It’s difficult to imagine an eventuality where J&J could push the settlements of baby powder through given these numbers. While J&J’s $8.5 billion offer may seem like a lot at first, it does not look very appealing when you do the math. The proposed settlement based on our estimates – will not offer victims anything more than a median settlement of $100,000 per case. It’s not enough.

May 15, 2023 Update J&J might be facing suit from an advocacy group representing cancer victims. Does talc cause prostate cancer. The group contends that J&J deliberately withdrew a $61.5 billion funding agreement that it had with its company subsidiary LTL Management LLC, to simulate financial distress and confirm the unit’s Chapter 11 bankruptcy filing. The group asserts this action is a fraud transfer of the rights of victims’ compensation. They are planning to study J&J’s actions in the wake of the decision to dismiss the first bankruptcy case of LTL.

May 10 2023 Update: Next week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to reject the second bankruptcy filing by J&J subsidiaries LTL Management. In the meantime, however, the bankruptcy has issued an Order that requires both parties to participate in a new settlement mediation to see if a global settlement deal can come to fruition.

May 5th 2023 Update: The talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Does talc cause prostate cancer. Over 2,700 people have sued the firm and it has been paying $1 million per month for legal defense. The company’s most recent $29 million verdict at the Supreme Court of South Carolina forced it to seek bankruptcy protection, arguing for equitable distribution of assets to talc claimants, rather than being confiscated by the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of litigation.

May 4 2023 update: U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to resume talks on settlement with lawyers who have rejected the proposed $8.9 billion settlement offer. It was in Trenton, New Jersey yesterday the parties appeared in court to discuss the next steps to take in this second case of bankruptcy. Judge Kaplan encouraged further settlement talks.

This is the solution to resolve these claims for J&J. The baby powder settlement is likely to be completed. Does talc cause prostate cancer. But it will require more money – more billions of dollars – by Johnson & Johnson.

Lawyers have a split opinion on whether or not to agree with the proposal and not all clients view the situation the same way their lawyer does. A second bankruptcy proceeding is destined to fail as Judge Kaplan has scheduled a hearing in June to determine whether to discharge the bankruptcy for the 2nd time.

May 3 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) requested to have they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation regarding talc-related products. The group representing claimants for talc submitted a motion on Tuesday, asking for the Third Circuit to consider their case and then send it back before a court of lower jurisdiction with instructions to dismiss the bankruptcy. Does talc cause prostate cancer. They also requested that the stoppage of tort litigation against J&J continue to proceed.
LTL requested Chapter 11 protection once again after its bankruptcy filing was rejected in the Third Circuit earlier this year, offering the possibility of an $8.9 billion agreement. The committee argues that the recent ruling allowing LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J and J&J, requires an immediate Third Circuit review. The US Trustee requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement to the appeals court saying that the filing is a “desperate and legally deficient plan” by a few of law firms that have different financial interests.
May 1 2023 Update: A most frequently asked question is how the plaintiffs’ lawyers and their clients turn on $8.9 billion. Of course, that’s an enormous amount of money. But there are plenty of victims. Does talc cause prostate cancer. They are a great cases for plaintiffs. We were reminded of this last week when two talc cases led to huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in the verdict worth $18.1 million. The following month, a second mesothelioma trial involving talc was held for trial on the other side of South Carolina and resulted in a verdict of $29million in favor of plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc. which is one of the top suppliers of talc within the U.S.
April 30 2023 Update: In the year 2023, when J&J first tried to bring the talcum powder litigation into bankruptcy, it did so with an offer to set aside $2 billion for settlements. The amount was absurdly low. All of the talc plaintiffs believed in the offer. However, this time, J&J has increased the offer to $8.9 if the talc plaintiffs are willing to accept bankruptcy settlements and they have the support of a large portion of the talc plaintiffs and their attorneys. Does talc cause prostate cancer. But 75% of the plaintiffs in the talc category, which is required for bankruptcy plan approval, it a tough road since there are so many lawyers with massive stocks of baby powder-related lawsuits, opposed in favor of the deal.

What could solve the impasse? More billions.
April 25, 2023, Update Talc patients have requested a judge to reject their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Does talc cause prostate cancer. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible to receive bankruptcy relief because it failed to show financial stress.

The plaintiffs argue that the third Chapter 11 case is an fraud on the bankruptcy system and it is being pursued in bad faith. J&J states that the bankruptcy settlement receives “significant backing” from companies representing about 60,000 potential claimants. It’s fair to say that plaintiffs’ lawyers and victims ‘ lawyers are divided on the $8.9 billion offer for settlement.

April 21st, 2023 Update A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Although the trials for Talc lawsuits are suspended for a minimum of 60 days and new lawsuits are able to be filed and lawyers are able to begin preparing their cases. Does talc cause prostate cancer. The judge expressed his doubts about J&J’s ridiculous effort to relaunch its strategy in a second bankruptcy trial.

April 13th 2023 update: the big announcement is an $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer victims within MDL class action MDL collective action vowed to fight the settlement alongside talc claimants. Why? They think it is not enough money for more than 70,000 cancer victims. Does talc cause prostate cancer. These lawyers argue that J&J should negotiate a larger settlement or litigate individuals’ claims if the current bankruptcy is declared unconstitutional.

There is a different lawyer group that isn’t part of the leadership of that class action. These lawyers have collectively amassed tens of thousands of cases. They want to settle today for what is believed to be less than these victims deserve. Their argument is two-fold. First, they argue the settlement – which amounts to 100 million dollars on average per plaintiff is fair.

This argument isn’t easy to present. The second argument is more substance: the victims will no longer wait and want to get their money right now.

April 12 2023 Update: Some people are seeking out how J&J could file for bankruptcy once more. The answer is complex and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc lawsuits conclusively. Also, it believes that it will be less expensive should there be an element of bankruptcy that puts pressure to settle. Does talc cause prostate cancer. Moving past the 400-year span of American past, the company claims that bankruptcy benefits all parties by distributing settlements more fairly and more efficiently than trial courts where some litigants receive significant settlements while others get nothing.

The gist in the 3rd Circuit decision was this isn’t a case that involves a profitable company making a subsidiary to take the legal responsibility and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. However, the court also ruled it was not financially distress because J&J promises unlimited funding.
Then J&J decided to go with the unlimited funding part of the deal and didn’t make any promises that it would provide unlimited funds for lawsuits. The company claims that its new financing agreements with its subsidiary addresses the concerns of the appellate court, while offering claim payment funds. As if offering victims less money will solve the problem at hand.

Lawyers representing cancer victims who do not agree with the agreement counter this argument by saying that it is the legal argument. Does talc cause prostate cancer. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole did not go unnoticed: victims’ lawyers call it the largest “fraudulent deal ever in United States history.”

Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. However, it’s a means of pushing this $8.9 billion settlement and keep pressure on plaintiffs.

April 10 2023 update: Bloomberg has an interesting piece on a law that has been passed within New Jersey that is shedding new light on litigation funding in the baby powder plaintiffs in the class action. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any profits. J&J has now offered an offer of $8.9 billion to settle lawsuits.

The funders’ involvement is public knowledge because of the New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to address the rising calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine state and federal infant powder litigation. Third-party funding of mass tort cases is not without its pros and cons. There is no doubt that we are witnessing how third-party funding could level the playing field between individuals and big companies in the courtroom.

April 4 2023 Update: It is fun to watch the worm turn in this litigation. J&J suffered another setback this week when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. Automatic stays have frozen thousands of talcum powder cases and stopped the filing of new lawsuits ever since J&J initiated the controversial effort to spin talc-related liabilities into a bankrupt company over a year earlier. Does talc cause prostate cancer. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was removed. J&J wanted to see it remain in effect until its SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay being fully lifted, the first new cases were filed and incorporated into the class action for talcum powder MDL within a year. Seven new talc lawsuits were brought into the MDL over the last month which brings the total number of cases in the pending process up to 37,522.

February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J product containing talc has cost the government in the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the risks of its talc-based products for long while tax dollars spent on treating people who suffered injuries from exposure to the chemicals. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Does talc cause prostate cancer. J&J has to begin making reasonable settlement offers for victims in order getting this behind it. It’s a mark on one of the top firms.

February 14 2023 Update: At the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
