New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy, joining cancer victims as well as those affected by cancer and the U.S. Justice Department’s bankruptcy watchdog, who have argued that a profitable business like J&J does not qualify for bankruptcy protections meant for struggling debtors.
LTL’s first attempt at resolving the bankruptcy-related lawsuits was dismissed following similar arguments. The U.S. appellate court determined it was not LTL was not in “financial financial distress” and therefore not eligible under bankruptcy law. Does talc cause testicular cancer. LTL had filed for bankruptcy again within two hours of the decision to dismiss, arguing that its second attempt was different due to the fact that there was less money available and more backing for a settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s latest bankruptcy violation of state law enforcement powers by seeking to unilaterally limit the liability of the company in state consumer protection measures.

LTL’s filings for the new year also contained more information on how the company would assess and settle cancer claims if the bankruptcy plan is approved.

In its second bankruptcy effort for LTL management, a subsidiary founded by J&J to manage the claims company proposed a settlement of $8.9 billion. Does talc cause testicular cancer. While one firm representing plaintiffs is in favor of the proposal, another group opposes the move.

Earlier this week, the opposition group, known as the Official Committee of Talc Claimants in the bankruptcy court, demanded to disqualify the petition saying that LTL is not a factor in financial distress.

“The filing is a desperate and legally ineffective attempt by a handful of law firms to try to stop claimants from deciding on the resolution plan–a plan that the overwhelming majority of claimants support,” J&J’s litigation chief Erik Haas, said in a statement. Does talc cause testicular cancer. “The law firms behind these filings have interests in finance that conflict with, diverge from and contravene those that their customers. We’ll be submitting an answer an appeal to the appellate court.”

Does talc cause testicular cancer. Clay Thompson, a lawyer for MRHFM which includes more than mesothelioma victims who have filed lawsuits against J&J and J&J, has said that the company’s second bankruptcy try failed.

“J&J sends out press releases describing how fantastic its plans are, but is insisting that the plan’s details, including what individual sick people would actually be treated to,” Thompson said in the statement. “What is J&J’s plan to conceal?”

Kaplan has directed the parties to develop a new strategy for reorganization, under supervision and supervision of mediators.

On February 20, 2022 Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that would free the company from the tens of thousands of claims over its talcum products.

In the month of January, an appeals court in the United States overturned the decision, ruling that the firm could not be considered to be in “financial difficulty.”

In the event that J&J’s request to contest the U.S. Supreme Court was dismissed in April, J&J declared bankruptcy just two hours after. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether or not to accept to file for bankruptcy again.

J&J’s unstoppable profit machine sputters after $6.9B settlement charge for talc.

In the 2 Chapter 11 attempts, J&J has been able to buy 19 months in which cases have been suspended. Does talc cause testicular cancer. The company wants claimants to take a vote to accept their settlement. J&J will require 75% support in order for the agreement to be accepted.

In addition to the group of talc lawyers who panned the bankruptcy of the company and the U.S. Trustee, an arm from the U.S. Department of Justice, also filed motions to dismiss the second bankruptcy case of LTL.

In a letter filed this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy courts are “open to honest, but naive debtors.” The doors “are not available to anyone that don’t have a legitimate bankruptcy objective or seek to abuse the bankruptcy process to delay or hinder their creditors.” Vara continued.

For its part, J&J maintains there is no proof conclusive that their talc products, including its popular baby powder can cause cancer. J&J has adopted the products from the market and will first launch them for North America in 2020–and the remainder of the globe later this year.

J&J intends to steer clear of the costly business of going to court. It has won the majority of the cases that have been decided through trial, though some losses have been very punishing.
A well-known trial in Missouri resulted in a $4.7 billion judgment against the drug manufacturer and was later lowered to $2.1 billion following appeals.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does Talc Cause Testicular Cancer

June 2 2023 Update: In an asbestos talc court trial held at the trial in California yesterday, some technical issues disrupted the opening statements made by defense attorneys. Does talc cause testicular cancer. Jurors from home via Zoom but did not hear Johnson & Johnson’s lawyer voice his doubts about the 70s research that claimed asbestos was present in their product, but the trial was abruptly closed.

In the meantime, the plaintiff had the opportunity to present its first expert witness Arthur Langer. Langer explained that the existence of other minerals in talc is inevitable. He claimed that his group had notified J&J in the year 1971 about the presence of asbestos chrysotile in the company’s talc, albeit with just 0.1 percent. The asbestos was discovered by him in the year 1976.

June 1st, 2023 Update Does talc cause testicular cancer. This is the first court trial that has taken place since J&J decided to spin off its Talc section and declaring bankruptcy marks an important moment for the ongoing lawsuit controversy. Trial started on Monday in the harrowing trial of a young plaintiff, diagnosed with an aggressive and rare form of mesothelioma last year. a diagnosis lawyers on both sides believe is a harrowing tragedy.

Opening statements revealed the distinct differences between each side’s story. The attorney representing the plaintiff took aim towards Johnson & Johnson, alleging the use of misleading methods in their research practices as well as throughout the litigation procedure. According to the attorney Johnson & Johnson attempted to alter asbestos’ definition, despite internal documents dating back to between 1978 and 1994 that showed asbestos fibers in the tissues of the plaintiff are part of.

Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the course of this trial. Despite the unique nature of the mesothelioma trial and the unique issues it faces compared to other lawsuits involving talcum powder ruling in favor of the plaintiff could cause an unintended setback to Johnson & J’s hope of gaining broad acceptance for the settlement they have proposed among plaintiffs.

May 31st, 2023 Update: Johnson & Johnson’s bankrupted talc unit has strongly defended it’s Second Chapter 11 filing in the opposition of talc injury claimants. In an objection submitted to the New Jersey bankruptcy court, J&J’s subsidiary claimed that the situation was distinct from the previous filing. It highlighted the extraordinary commitment to $8.9 billion by J&J the largest ever settlement in an bankruptcy case involving mass torts. Does talc cause testicular cancer. The issue is not discussed: whether the magnitude of the settlement implies that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal firms that represent over sixty thousand claimants. This is hard to verify but likely incorrect.

May 24 2023 Update: As of Johnson and Johnson’s bankruptcy filing in 2021 filing, the very first trial involving its cosmetic talc products that are believed to that contain asbestos is scheduled to commence jury selection on Monday in California within the Alameda County Superior Court, a historically good jurisdiction for plaintiffs. Plaintiff claims that mesothelioma is the result of asbestos exposure through J&J’s products and J&J denies. The trial also involves six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers involved in the second J&J talc bankruptcy are now disputing who should be appointed to the position of future claims representative. This is which is vitally essential in resolving the Talc claims. Does talc cause testicular cancer. Randi Ellis, a lawyer who regularly appears in MDLs across the country was appointed as the claims representative in the first bankruptcy. J&J’s defense attorneys want Ellis to be appointed to this position in the future, however lawyers representing the talc plaintiffs are protesting because Ellis has conflicts of interest which should stop her from assuming that position once more. The issue stems from the fact that Ellis was apparently involved in the drafting of the highly contested second bankruptcy, which raises questions about her capacity to be neutral. The reality is the bankruptcy will be tossed out anyway.

May 17, 2023 Update: The pretend company J&J formed to settle the talc litigation bankruptcy has informed the New Jersey bankruptcy court that they have set aside $400 million to settle claims made by states accusing the company of deceptive advertising for its talc-based products. Does talc cause testicular cancer. That’s an $8.5 billion settlement for cancer victims. It is hard to imagine any scenario in which J&J can get the baby powder settlements in these figures. Although J&J’s $8.5 billion offer may seem like a large sum initially, it does not appear appealing when you look at the numbers. The settlement plan based on our rough calculations – would not be able to pay victims more than $100,000 per case. This isn’t enough.

May 15, 2023 Update: J&J is potentially facing a lawsuit by an advocacy group representing cancer patients. Does talc cause testicular cancer. The group claims that J&J deliberately withdrew the $61.5 billion contract for funding with its subsidiary, LTL Management LLC, to create the appearance of financial hardship and validate the unit’s Chapter 11 bankruptcy filing. The group asserts this action could be interpreted as a fraudulent transfer of right to compensation for victims. They will investigate J&J’s actions as a result of the decision to dismiss LTL’s first bankruptcy suit.

May 10 2023 Update: Next week this week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy petition filed that was filed by J&J subsidiary LTL Management. In the meantime, this bankruptcy court has issued an order that requires both parties to participate in a new settlement mediation to see if an international settlement agreement can be reached.

May 5th 2023 Update: The talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products caused cancer through asbestos exposure. Does talc cause testicular cancer. Over 2,700 individuals have sued the firm and it has been spending $1 million a month for legal defense. The company’s recent $29 million verdict at the Supreme Court of South Carolina forced it to file for bankruptcy protection, arguing for a fair distribution of assets between the claimants of talc instead of being seized in the hands of the receiver. Other suppliers of talc have declared bankruptcy because of lawsuits.

May 4, 2023 update: U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to reopen settlement discussions with lawyers who rejected the company’s proposed $8.9 billion offer for settlement. At Trenton, New Jersey yesterday, the parties appeared before a judge to discuss next steps in the second bankruptcy case and Judge Kaplan was pushing for more settlement discussions.

This is the solution to settle these claims with J&J. A baby powder settlement could be achieved. Does talc cause testicular cancer. However, it’ll require additional money – perhaps billions of dollars – coming from Johnson & Johnson.

Lawyers are split on whether to accept the proposal and not every client sees this issue the same way their lawyer views it. Second bankruptcy cases are bound to be a failure and Judge Kaplan has set a date for a hearing in June to decide whether to remove the bankruptcy after the second.

May 3, 2023 Update: A group of cancer victims who are suing Johnson & Johnson (J&J) requested for J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop litigation regarding talc-related products. The group of talc claimants made a motion Tuesday requesting that the Third Circuit to consider their appeal and return the case the lower court with instructions to dismiss the bankruptcy. Does talc cause testicular cancer. They also requested that the stopped tort litigation against J&J be allowed to proceed.
LTL applied for Chapter 11 protection once again following the bankruptcy filing it made earlier was rejected by the Third Circuit earlier this year, offering a $8.9 billion payment. The committee believes that the recent decision allowing LTL’s second Chapter 11 to continue, in addition to halting trials against J&J, warrants an immediate Third Circuit review. The US Trustee also asked that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a response to the appeals court declaring the filing a “desperate and legally deficient effort” by a handful of law firms who have different financial interests.
May 1 2023 Update: A common question that people ask is how could plaintiffs and their lawyers turn around $8.9 billion. Of course, that’s quite a sum. But there are a lot of victims. Does talc cause testicular cancer. These are an excellent case for plaintiffs. We were reminded recently when two talc cases have resulted in huge verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon was settled with an award worth $18.1 million. In the same month, a different mesothelioma talc case was brought to hearing at South Carolina and resulted in an award of $29 million to the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. one of the most prominent suppliers of talc within the U.S.
April 30th 2023 Update: In the year 2023, when J&J first attempted to drag the talcum powder litigation into bankruptcy, it came with an offer to reserve $2 billion to settle the case. The amount was absurdly low. All of the talc plaintiffs believed in the offer. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims will allow a bankruptcy settlement and they also have the support of a large segment of the talc plaintiffs and their lawyers. Does talc cause testicular cancer. But 75% of the plaintiffs who are a talc, which is required for bankruptcy plan approval It’s a long and difficult process with so many lawyers with huge collections of baby powder lawsuits opposed in favor of the deal.

What can be done to end the impasse? More billions.
April 25, 2023 Update Talc patients have sought a court order to reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does talc cause testicular cancer. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not eligible for bankruptcy relief since it was unable to demonstrate financial distress.

The plaintiffs argue that the second Chapter 11 case is an fraud on the bankruptcy system and it’s being conducted in bad faith. J&J claims the bankruptcy settlement has “significant support” from firms representing approximately 60,000 claimants. It’s safe to say plaintiffs’ lawyers and victims ‘ lawyers are not united over this $8.9 billion amount of settlement offered.

April 21, 2023 Update: A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits claiming that the company sold baby powder that was contaminated and causing cancer. While trials in the lawsuits involving talc are delayed for at least 60 calendar days and new lawsuits are able to be filed, and lawyers may begin to prepare their cases. Does talc cause testicular cancer. Judges expressed skepticism about J&J’s attempt to relaunch its strategy in a second bankruptcy trial.

April 13th 2023 Update: The major news is the $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer victims within MDL class action MDL collective action pledged to challenge the settlement talc claimants. Why? They think it is not enough money for 70 000 cancer patients. Does talc cause testicular cancer. These lawyers argue that J&J could negotiate a greater settlement or litigate individuals’ claims if the current bankruptcy is dismissed.

However, there is a second group of lawyers that is not part of the leadership in the class action. These lawyers have collectively amassed many thousands of cases. This group wants to settle now in what many believe to be less than these victims deserve. Their argument appears to be two-fold. The first is that they claim the settlement of around 100 million dollars on average per plaintiff – is fair.

That is a hard argument to argue. The second argument is more teeth: victims can not afford to wait any longer and need the money immediately.

April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy again. The answer is complex and convoluted. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future talc lawsuits conclusively. It thinks it can get a lower rate if there is a bankruptcy component that applies pressure to settle. Does talc cause testicular cancer. In a quest to cover hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlements more fairly and effectively than trial courts, in which some litigants receive substantial award while others do not.

The gist in this 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming subsidiaries to meet the legal liability and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. It also clarified it was not financially trouble because J&J promised unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding aspect of the holding and didn’t make any promises to provide unlimited funding for litigation. The company claims that new financing agreements with its subsidiary address the appeals court’s concerns while still providing funds for claims. As if offering victims less money will solve the underlying issue.

Lawyers representing cancer patients who do not agree with the agreement counter the agreement with what is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared: victims’ lawyers call it the most significant “fraudulent move that has occurred in United States history.”

Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way to push for this $8.9 billion settlement, and to keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any profits. J&J is now willing the payment of $8.9 billion to settle lawsuits.

The involvement of funders is publicly available because of a New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to address the rising calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include state and federal infant powder litigation. Third-party funding for mass tort lawsuits has its pros and cons. However, there is no doubt that we are seeing how third-party financing can help level the playing field between people and big corporations in court.

April 4, 2023 Update: It is interesting to watch the worm turning in this case. J&J was hit again this week when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals a bankruptcy decision before the U.S. Supreme Court. It has frozen hundreds of cases involving talcum powder and stopped new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc debts into a bankrupt company over one year earlier. Does talc cause testicular cancer. When the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was revoked. J&J wanted to see it continued pending hearing the SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: With the bankruptcy stay being in effect, the first new cases have been filed and transferred into the class action involving talcum powder MDL in just over a year. Seven new talc lawsuits were brought into the MDL in the last month, bringing the total number of cases that are pending to 37,522.

February 25, 2023 Update This morning, a Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J products containing talc have cost the government over the many years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the risks of its talc products for decades while tax dollars were utilized to treat people injured by exposure to the product. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.

Does talc cause testicular cancer. J&J has to begin making reasonable settlements to victims to getting this behind it. It’s a mark on one of the most prestigious companies.

February 14 2023 Update: At an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
