Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc litigations in a definitive manner. The hyperbole wasn’t spared: victims’ lawyers call it the biggest “fraudulent transfer of assets in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
