Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future talc lawsuits conclusively. It believes that it will be less expensive if there is the bankruptcy element which applies pressure to negotiate a settlement. Does talc give you cancer. Going back to 400 years of American time, the business believes that bankruptcy is beneficial to all parties by distributing settlements more equally and efficiently than trial courts, where litigants are awarded significant awards while others receive nothing.
The main thrust of the 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming an affiliate to accept the legal liability and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. But it also said it was not in financial trouble due to the fact that J&J offered unlimited financing.
Then J&J decided to go with the unlimited funding aspect of the deal and didn’t make any promises that it would provide unlimited funds for cases. The company claims that updated financing arrangements with its subsidiary address the appeals court’s concerns, while providing funds for claims. As if providing victims with lesser money could solve the underlying issue.
Lawyers representing cancer victims who oppose the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the largest “fraudulent transfer that has occurred in United States history.”

J&J has now offered that it will pay $8.9 billion to settle lawsuits.

The rules aim to tackle the growing demands for regulation of the litigation funders. J&J faces over 60,000 claims when you take into account federal and state Baby Powder lawsuits. Third-party funding in mass tort claims has pros and cons. But there is no question that we are witnessing how third-party financing can help level the playing field between individual and big companies in court.
April 4 2023 Update: It’s fun to watch the worm turning in this lawsuit. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to maintain the automatic stay during the time that J&J appeals an appeal to the U.S. Supreme Court.
