April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy again. The answer is complex and convoluted. Let’s try to clarify it simply.
Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc-related lawsuits definitively. In other words, it believes that it will be less expensive in the event of a bankruptcy element that creates pressure to settle. Does talc powder have asbestos. Moving past hundreds of years of American time, the business claims that bankruptcy benefits everyone by dispersing settlements more fairly and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.
The essence in the 3rd Circuit decision was this is not a case – the profit-making company that has a subsidiary to take the legal burden and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. But it also said that the entity was in financial difficulty due to the fact that J&J assured it of unlimited funding.
So J&J did not hesitate to take advantage of the funding unlimited part of the holding and did not promise that it would provide unlimited funds for cases. The company claims that updated financing arrangements with its subsidiary addresses the appeals court’s concerns while still offering claim payment funds. As if providing victims with less money would solve the problem at hand.
Attorneys representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole did not go unnoticed the lawyers representing victims call it the largest “fraudulent transaction in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it is a way of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023, Update Bloomberg has an interesting article on a new law of New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.
The funders’ involvement is public knowledge because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. The law is designed to tackle the growing demands for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you take into account state and federal infant powder litigation. Third-party funding in mass tort claims has both pros and cons. This automatic stay froze hundreds of cases involving talcum powder and stopped new lawsuits from arising ever since J&J started the controversial process to spin talc-related liabilities off into a bankrupt company over one year in the past. February 25, 2023 Update: A Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J product containing talc has cost the government over the decades.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products for decades while tax dollars were utilized to treat people injured by exposure to the product. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
