Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc litigations in a definitive manner. Moving past more than 400 years in American history, the firm argues that bankruptcy benefits all parties as it distributes settlements more fairly and effectively than trial courts which are where litigants get significant settlements while others get nothing.

J&J is now offering to pay $8.9 billion to settle any lawsuits.
