But there’s a separate group of lawyers that is not part of the leadership in this class action. They have amassed the equivalent of tens of thousands of lawsuits. This group wants to settle for what is believed to be lower than what the victims should be paid. Their argument seems to be twofold. Going back to more than 400 years in American time, the business claims that bankruptcy benefits all parties as it distributes settlement payments more evenly and effectively than trial courts where litigants are awarded significant award while others do not.
The gist of this 3rd Circuit decision was this is not a case – the profit-making company that has subsidiaries to meet the legal responsibility and declare bankruptcy, which is what Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled it was not financially trouble because J&J offered unlimited financing.
Thus, J&J took advantage of the unlimited funding part of the holding and didn’t promise that it would provide unlimited funds for litigation. J&J claims that its updated financing arrangements with its subsidiary addresses the appeals court’s concerns while still offering claim payment funds. It’s as if giving victims lesser money could solve the overarching problem.
Lawyers representing cancer victims who are against the agreement argue the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared attorneys representing the victims claim this the biggest “fraudulent transaction of assets in United States history.”

The involvement of funders is made public due to an New Jersey court rule requiring the release of certain details about funders outside the state. The law is designed to respond to the increasing calls for the regulation of litigation funders. J&J has more than 60,000 claims when you include state and federal baby powder lawsuits. Third-party funding in mass tort claims has pros and cons. However, there is no doubt that we are seeing how third-party funding could level the playing field between individual and big corporations in court.
April 4, 2023 Update: It is fun to watch the worm turn in this litigation. Steven Cohen (D-Ten.) accused J&J of not recognizing the risks of its talc products for years while tax dollars were used to treat those who were injured through exposure to the products. The suit comes just a few days after J&J’s major loss in the 3rd Circuit Court of Appeals.
