Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc litigations in a definitive manner. That is, it believes it can pay less if there is a bankruptcy component that applies pressure to negotiate a settlement. Is asbestos found in talc. Going back to more than 400 years in American history, the firm argues that bankruptcy benefits all parties because it distributes settlements more fairly and more efficiently than trial courts where some litigants receive significant award while others do not.
