J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay for different types of cancer patients in bankruptcy settlement. April 12 2023 Update: Some people are asking how J&J can file for bankruptcy once more. The answer is complex and confusing. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future lawsuits involving talc conclusively. In other words, it thinks it can get a lower rate when there is a bankruptcy component that applies pressure to negotiate a settlement. Is baby powder talc. Moving past 400 years of American past, the company asserts that bankruptcy benefits all parties because it distributes settlements more fairly and more efficiently than trial courts which are where litigants get significant payouts, while others are left with nothing.
The basic tenet of this 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an affiliate to accept the legal burden and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. Lawyers representing cancer patients who oppose the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole did not go unnoticed: victims’ lawyers call it the biggest “fraudulent move of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. But it’s a way of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any wins. The involvement of the funders is publicly available due to a New Jersey court rule requiring the disclosure of certain information about outside funding backers.
