Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future lawsuits involving talc conclusively. In other words, it thinks it can get a lower rate when there is a bankruptcy component that applies pressure to negotiate a settlement. Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. But it’s a way of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.
