Lawyers representing cancer victims who do not agree with the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the most significant “fraudulent deal in United States history.”
Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of trying to push this $8.9 billion settlement through and maintain the pressure on plaintiffs.
