J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company will pay various types of cancer victims in a bankruptcy settlement. April 13th, 2023 Update: The major story is that there’s an $8.9 billion over 25 years settlement offer. Lawyers representing cancer victims involved in MDL class action MDL collective action promised to fight the settlement along with those who claim talc. Why? These lawyers argue that J&J should seek a bigger settlement or litigate individual claims if the latest bankruptcy is thrown out.
There is a different group of lawyers outside of the leadership group in that class action. These lawyers have collectively amassed many thousands of cases. April 12 2023 Update: People are asking how J&J can file for bankruptcy again. The answer is complex and confusing. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc lawsuits conclusively. In other words, it believes it can pay less in the event of the bankruptcy element which applies pressure for a settlement. Is Johnson’s baby talc safe. In a quest to cover the 400-year span of American time, the business argues that bankruptcy benefits all parties because it distributes settlement payments more evenly and more efficiently than trial courts where some litigants receive significant awards while others receive nothing.
The gist of this 3rd Circuit decision was this is not a matter of one that makes a profit, but an entity to assume the legal liability and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. But it also said the company was financially difficulty due to the fact that J&J promises unlimited funding.

Lawyers representing cancer patients who oppose the deal counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed: victims’ lawyers call this the biggest “fraudulent transaction that has occurred in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023 update: Bloomberg provides an insightful piece on a law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) over talc products in exchange for a share of any settlements. J&J is now willing to pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public information because of an New Jersey court rule requiring the release of certain details about funding sources outside of the. The rule aims to tackle the growing demands for the regulation of litigation funders. J&J faces over 60,000 claims when you include federal and state infant powder litigation. Third-party funding in mass tort claims has both pros and cons.
