LTL’s bankruptcy plan will pay $400 million to an additional trust to settle claims made by state attorneys general alleging that J&J did not comply with the state’s unfair commercial practices as well as consumer protection laws through misleading consumers about the safety of its talc products.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy along with cancer sufferers as well as the U.S. Justice Department’s bankruptcy watchdog, who have argued that a successful business like J&J can’t benefit from bankruptcy protections aimed at the struggling debtors.
The first time LTL attempted to settle the bankruptcy cases was thrown out after similar arguments, when a U.S. appeals court decided that LTL did not have “financial distress” and was not eligible of bankruptcy protection. LTL had filed for bankruptcy again just over two hours after the dismissal, arguing the second bankruptcy was different in that it had less money available and more backing for an agreement.
New Mexico and Mississippi said in their motion to dismiss LTL’s renewed bankruptcy violates the law enforcement powers of the state by seeking to unilaterally limit the liability of the company for state consumer protection measures.

LTL’s new filings also included additional details about the way in which the company will evaluate and settle cancer claims should the bankruptcy plan be approved.

“The filing is a desperate and legally deficient attempt by a tiny number of law firms to stop claimants from deciding on the resolution plan – a plan the vast and growing majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Is makeup with talc bad. Clay Thompson, a lawyer for MRHFM which boasts more than mesothelioma clients who have filed lawsuits against J&J, said that the second bankruptcy attempt of J&J failed.
“J&J sends out press releases describing how fantastic its plans are, but is requesting that details of the plan, such as what individuals with illnesses would be treated to,” Thompson said in a statement. “What do they have to cover up?”
Kaplan has commanded the parties to devise a second arrangement plan under supervision of two mediators.
In February 2022, Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that would release the company from the tens of thousands of claims concerning its talcum products.
However, in the month of January, an appeals court of the federal government overturned the verdict, ruling that the business could not be considered to be in “financial distress.”
When J&J’s attempt to appeal to the U.S. Supreme Court was dismissed at the end of April J&J filed for its second bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 calendar days to decide whether to grant the second bankruptcy.

In addition to the gang of talc lawyers who panned the bankruptcy of the company, the U.S. Trustee which is a division from the U.S. Department of Justice is also submitting motions to dismiss LTL’s second bankruptcy.
In a letter filed this week, U.S. Trustee Andrew R. Vara wrote that the the bankruptcy court remain “open to honest, but naive debtors.” The doors “are not available to anyone that do not have a legitimate reason or want to abuse the bankruptcy process to hinder or delay their creditors.” Vara continued.

He also testified that his team advised J&J in 1971 of the presence of chrysotile asbestos within the talc produced by the company, although at just 0.1 percent. He also found more asbestos in 1976.
June 1st, 2023 Update: Is makeup with talc bad. The first trial since J&J has decided to separate its talc division and declare bankruptcy is an important point for the ongoing litigation controversy. The trial started yesterday in the harrowing case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma in the past year, a diagnosis lawyers on both sides believe is a grave tragedy.
Opening statements laid bare distinct differences between each side’s story. The plaintiff’s attorney took aim against Johnson & Johnson, alleging the use of deceitful tactics in research practices and throughout the litigation procedure. The attorney claims that, according to, the company tried to manipulate asbestos’ definition, in spite of internal documents dating from between 1978 and 1994 that showed fibers discovered in the tissue of the plaintiffs are included.
Johnson & Johnson’s uncertain $8.9 billion settlement deal hangs in the balance with the development of the trial. Despite the distinctive nature of this mesothelioma case and its unique challenges compared to other talcum powder lawsuits A verdict in favor of the plaintiff could be an enormous setback for J&J’s hopes for broad acceptance of their settlement proposal among plaintiffs.
May 31, 2023 Update: Johnson and Johnson’s bankrupted talc unit has strongly defended the second Chapter 11 filing in the face of challenges from talc injury claimants. In a written objection to the New Jersey bankruptcy court, it argued that the situation was vastly different from the first filing. It also emphasized the unprecedented commitment of $8.9 billion from J&J, the biggest settlement ever to be made in the history of a mass tort bankruptcy. Is makeup with talc bad. There was no mention of how the magnitude of the settlement signifies that it’s an equitable settlement. J&J also claimed support from numerous plaintiffs’ law firms that represent over the 60,000 plaintiffs. It is difficult to confirm but it’s likely to be false.
May 24, 2023 Update: Since Johnson & Johnson’s bankruptcy in 2021 filing, the first trial on the cosmetic talc products it claims to with asbestos content is scheduled to start jury selection on Monday, California at Alameda County Superior Court, a historically good court for plaintiffs. The trial also involves six retailers accused of selling talc products.
May 22nd, 2023 Update Lawyers involved in the 2nd J&J Talc bankruptcy are disputing who should be appointed to the post of the future claims representative, an important role critical to resolving claim for talc. Is makeup with talc bad. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States, was appointed as the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed to that role again, but lawyers for the talc plaintiffs are objecting on the grounds that Ellis has conflicts of interest that should prevent her from being appointed to that post in the future. This conflict is rooted in the fact that Ellis was believed to have been involved in the creation of the hotly disputable second bankruptcy, which raises questions about her ability to be neutral. In reality, the bankruptcy will get dismissed anyway.
May 17, 2023 Update The pretend company J&J made up to settle the talc litigation bankruptcy has informed a New Jersey bankruptcy court that they have set aside $400 million to settle claims brought by states accusing the company of deceitful advertising for its talc-based products. Is makeup with talc bad. This amounts to an $8.5 billion settlement for cancer victims. It is hard to imagine the scenario in which J&J can push the baby powder settlements in these figures. While J&J’s proposed $8.5 billion offer sounds like a lot of money initially, it may not look good when you do the math. This settlement proposal – by our estimates – will not be able to pay victims more than an average settlement $100,000 per case. That is not enough.
May 15th 2023 Update: J&J might be facing lawsuit by an advocacy group representing cancer patients. Is makeup with talc bad. The group contends that J&J deliberately retracted the $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, to simulate financial stress and confirm the unit’s Chapter 11 bankruptcy filing. The group claims this decision is a fraud transfer of the victims’ compensation rights. They are planning to study J&J’s actions after the announcement of the denial of the LTL’s bankruptcy case in its first instance.
May 10 2023 Update: Next week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments in a motion dismiss the second bankruptcy application that was filed by J&J subsidiaries LTL Management. Other talc suppliers have also been forced to file for bankruptcy as a result of legal proceedings.
May 4, 2023 update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who turned down the proposed $8.9 billion settlement offer. In Trenton, New Jersey yesterday, the parties appeared in court to discuss the next steps to take in the second bankruptcy case. Judge Kaplan has pushed for further settlement talks.
This is the way to settle these claims for J&J. A baby powder settlement could get done. Is makeup with talc bad. But it will require more money, more billions of dollars of Johnson & Johnson.
Lawyers are divided over whether or not to agree with the proposal and not all clients see the issue the same way their lawyer sees it. A second bankruptcy proceeding is bound to fail and Judge Kaplan has scheduled a hearing in June to determine if she will close the case for the third time.
May 3, 2023 Update A group of cancer patients who have sued Johnson & Johnson (J&J) asked an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation over talc products. The committee representing talc claimants submitted a motion on Tuesday requesting to the Third Circuit to consider their appeal and return the case an earlier court with instructions to dismiss the bankruptcy. Is makeup with talc bad. The committee also requested that the stopped tort litigation against J&J allow the litigation to continue.
LTL filed for Chapter 11 protection once again following its bankruptcy filing that was rejected in the Third Circuit earlier this year with the possibility of an $8.9 billion deal. The committee believes that the recent ruling, which allows LTL’s second Chapter 11 to continue, while also halting trials against J&J should be subject to immediate Third Circuit review. The US Trustee also requested that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a reply to the appeals court saying that the filing is an “desperate and legally insufficient attempt” by a select group of law firms who have competing financial interests.
May 1 2023 Update: One most frequently asked question is how could plaintiffs and their lawyers be able to turn on $8.9 billion. That’s of course an enormous amount of money. However, there are lots of victims. Is makeup with talc bad. They are a great case for plaintiffs. We have been reminded of this recently when two talc cases ended in large verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon was settled with an award that was $18.1 million. A month later, another talc mesothelioma case went to the court within South Carolina and resulted in the verdict of $29 million for the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. one of the most prominent producers of talc in the U.S.
April 30th, 2023 Update: When J&J first attempted to drag the talcum powder lawsuit into bankruptcy, it was met with an offer to reserve $2 billion for settlements. The sum was ridiculously low. None of the talc plaintiffs supported the offer. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims are willing to accept bankruptcy settlements and they have the support of a substantial portion of the talc plaintiffs as well as their lawyers. Is makeup with talc bad. However, 75% of plaintiffs of talc are required for bankruptcy plan approval, it a tough road since there are so many lawyers with massive stocks of baby powder lawsuits opposed in favor of the deal.
What could solve the impasse? More billions.
April 25 2023 Update Talc Cancer victims have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Is makeup with talc bad. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief since it had not demonstrated financial distress.
The plaintiffs argue that the third Chapter 11 case is an overreach of the bankruptcy system and it’s being conducted in bad good faith. J&J claims the bankruptcy settlement has “significant support” from firms representing approximately 60,000 claimants. It is fair to say that plaintiffs’ lawyers and victims ‘ lawyers are not united over what they believe is an $8.9 billion offer for settlement.
April 21st, 2023 Update A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. Although trials for talc lawsuits are paused for at least 60 calendar days, new lawsuits can be filed, and lawyers may begin to prepare their cases. Is makeup with talc bad. The judge expressed his doubts about J&J’s ridiculous effort to relaunch its strategy in the second bankruptcy case.
April 13, 2023 update: the biggest announcement is an $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer patients who are part of MDL class action MDL class action have pledged to fight the settlement along with talc claimants. Why? They feel it’s too little money for the 70 000 cancer patients. Is makeup with talc bad. These lawyers argue that J&J should negotiate a bigger settlement or litigate individual claims if the latest bankruptcy is dismissed.
There is a different set of lawyers who are not part of the top leadership in that class action. They have amassed tens of thousands of cases. The group is seeking to settle the case now for what many argue is lower than what the victims should be paid. Their argument appears to be twofold. They argue that the settlement – which amounts to 100,000 dollars per plaintiff – is fair.
This argument isn’t easy to prove. The second argument is more substance: the victims will not afford to wait any longer and need their money now.
April 12 2023 Update: Many are seeking out how J&J could file for bankruptcy again. The answer is complex and complicated. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc litigations in a definitive manner. That is, it thinks it can get a lower rate if there is a bankruptcy component that applies pressure to settle. Is makeup with talc bad. Going back to the 400-year span of American past, the company argues that bankruptcy benefits all parties by distributing settlements more equally and effectively than trial courts in which some litigants receive substantial settlements while others get nothing.
The essence in this 3rd Circuit decision was this is not a matter of the profit-making company that has subsidiaries to meet the legal burden and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. But it also said that the entity was financially crisis due to the fact that J&J promised unlimited funding.
This is why J&J jumped on the unlimited funding portion of the agreement and didn’t promise to offer unlimited funding for litigation. J&J claims that its modified financing arrangements with its subsidiary address concerns of the appellate court, while supplying funds for claim payments. As if providing victims with lesser money could solve the overall issue.
Attorneys representing cancer victims who oppose the deal counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared the lawyers representing victims call it the biggest “fraudulent move of assets in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it’s a way of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023, Update Bloomberg is running an intriguing article on a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of wins. J&J is now willing to pay $8.9 billion to settle lawsuits.
The funders’ involvement is public information because of the New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to respond to the increasing calls for regulation of the litigation funders. J&J faces over 60,000 claims when you take into account federal and state child powder-related lawsuits. Third-party funding of mass tort cases has its pros and pros and. However, there is no doubt that we are seeing how third-party financing can help level the playing field between people as well as large corporations in the courtroom.
April 4, 2023 Update: It is fun to watch the worm turn in this legal battle. J&J took another hit this week when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay while J&J appeals an order granting bankruptcy in the U.S. Supreme Court. It has halted the cases of talcum powder in a number of years and stopped the filing of new lawsuits ever since J&J started the controversial process to spin talc-related liabilities into a bankrupt subsidiary more than a year ago. Is makeup with talc bad. After it was decided that the 3rd Circuit ruled that this bankruptcy was not legal just a few months ago the stay was lifted. J&J had hoped to have it remain in effect until an appeal to the SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that the Supreme Court is willing even to consider the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay now fully lifted, the first new cases were filed and incorporated into the talcum powder class action MDL in just over a year. Seven new talc-related lawsuits were added to the MDL over the last month which brings the total number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now demanding that The U.S. Government Accountability Office (GAO) begin an investigation into how much J&J talc products have cost the government in the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of not recognizing the risks of its talc products for years while tax dollars were spent treating those injured by exposure to the product. This lawsuit comes a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Is makeup with talc bad. J&J has to begin making reasonable settlement proposals to victims, in order the process of putting all this behind it. It is a stain on one of the top companies.
February 14 2023 Update: During an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
