What could solve the impasse? More billions.
April 25, 2023 update: Talc cancer claimants have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January and said that the company was not eligible for bankruptcy relief because it failed to show financial trouble.

J&J says the bankruptcy settlement receives “significant support” from companies representing approximately 60,000 people who are claiming. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on their disagreement over the $8.9 billion amount of settlement offered.
April 21st, 2023 Update: A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits alleging that it sold baby powder that was contaminated and causing cancer. There is a different group of lawyers outside of the leadership in group action. The lawyers collectively have accumulated hundreds of thousands of cases. This group wants to settle now in what many believe to be far less than what these victims deserve. The argument they make is twofold. They argue that the settlement of around 100,000 dollars per plaintiff is fair.
That is a hard argument to argue. The second argument is more teeth: victims can no longer wait and want to get their money right now.
April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy once more. The answer is complex and confusing. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc lawsuits conclusively. It thinks it will pay less should there be a bankruptcy component that applies pressure to negotiate a settlement. Is non talc powder safe. In a quest to cover 400 years of American time, the business argues that bankruptcy benefits all parties by distributing settlements more equally and efficiently than trial courts, in which some litigants receive substantial settlements while others get nothing.
The gist in the 3rd Circuit decision was this is not a case of a profitable company making an entity to assume the legal liability and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. But it also said that the subsidiary was not financially distress due to the fact that J&J offered unlimited financing.
This is why J&J did not hesitate to take advantage of the unlimited funding part of the contract and didn’t promise to offer unlimited funding for the litigation. The company claims that revised financing arrangements with its subsidiary will address concerns of the appellate court, while supplying funds for claim payments. As if offering victims less money will solve the problem at hand.
Lawyers representing cancer patients who oppose the agreement counter the agreement with what is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared by the victims’ lawyers, who call this the biggest “fraudulent transfer ever in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of trying to push this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10, 2023, Update Bloomberg offers an informative piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the Class action suit. J&J is now offering to pay $8.9 billion to settle all lawsuits.
The involvement of the funders is publicly available because of an New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to address the growing calls for regulation of litigation funders. J&J faces over 60,000 claims when you add up federal and state Baby Powder lawsuits. Third-party financing in mass tort cases is not without its pros and pros and. However, there is no doubt that we are witnessing the ways that third-party funding can even the playing field between individuals and big companies in court.
April 4, 2023 Update: It’s enjoyable to see the worm turning in this case. J&J took another hit this week, when the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy ruling before the U.S. Supreme Court. Seven new talc-related lawsuits were joined to the MDL during the month of March and brought the total number of cases pending to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now calling for authorities from the U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J product containing talc has cost the government in the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc-based products for many years, while tax dollars were spent treating those injured by exposure to the chemicals. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
