Randi Ellis, a lawyer who frequently appears in MDLs all over the nation was appointed as the claims representative during the first bankruptcy. J&J’s defense group wants Ellis to be appointed to this position yet again, but the lawyers for the talc plaintiffs are objecting because Ellis has an unrelated conflict of interest that should prevent her from being appointed to that post again. May 1 2023 Update: A most frequently asked question is how the plaintiffs’ lawyers and their clients turn off $8.9 billion. Of course, that is an immense amount of money. However, there are lots of victims. Is powder with talc safe. These are actually a good claims for plaintiffs. We have been reminded of this recently when two talc cases resulted in big verdicts for the plaintiffs. April 25, 2023 Update: Talc Cancer victims have demanded a judge dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Is powder with talc safe. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not a candidate for bankruptcy relief as it failed to show financial stress.
The claimants contend that LTL’s second Chapter 11 case is an fraud on the bankruptcy system, and that it’s being pursued in bad faith. April 13, 2023 Update: The big update is about the $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer patients within MDL class action MDL class action have pledged to fight the settlement with talc claimants. Why? They argue that it’s not enough to pay for those suffering from cancer who are 70,000. Is powder with talc safe. The lawyers say that J&J could negotiate a greater settlement or pursue individual claims if the most recent bankruptcy is declared unconstitutional.
There is a different group of lawyers that is not part of the leadership group in that class action. They have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle today for what is believed to be far less than what these victims deserve. Their argument seems to be twofold. First, they argue that the settlement – which amounts to the equivalent of $100,000 per plaintiff – is fair.
That is a hard argument to make. But their second argument has more force: victims should now not wait and they want their money now.
April 12, 2023 Update: People are looking for ways J&J is able to file for bankruptcy once more. The answer is complex and convoluted. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc lawsuits conclusively. That is, it believes it can pay less when there is a bankruptcy element that creates pressure to settle. Is powder with talc safe. Going back to the 400-year span of American time, the business claims that bankruptcy benefits all parties by distributing settlements more fairly and effectively than trial courts which are where litigants get significant payouts, while others are left with nothing.
The essence of this 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming an entity to assume the legal risk and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. However, it also stated the company was in financial trouble due to the fact that J&J offered unlimited financing.
Then J&J decided to go with the unlimited funding portion of the agreement and didn’t make any promises to offer unlimited funding for lawsuits. The company claims that revised financing arrangements with its subsidiary address the appeals court’s concerns while still supplying funds for claim payments. As if offering victims lesser money could solve the overall issue.
Attorneys representing cancer victims who are against the agreement argue this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt by the victims’ lawyers, who call it the biggest “fraudulent transaction that has occurred in United States history.”
In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023, Update Bloomberg offers an informative article about a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any settlements. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.
The involvement of funders is made public because of a New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to respond to the increasing calls for regulation of litigation funders. J&J faces over 60,000 claims when you include federal and state infant powder litigation. Third-party funding of mass tort cases has pros and pros and. However, there is no doubt that we are seeing how third-party funding could level the playing field between individuals as well as large corporations in court.
April 4, 2023 Update: It is pleasing to see the worm turning in this case. J&J suffered another setback this week, when it was found that the Third Circuit denied J&J’s request to maintain the automatic stay during the time that J&J appeals an order granting bankruptcy in the U.S. Supreme Court. Automatic stays have stopped hundreds of cases involving talcum powder and prevented new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc liability off into a bankrupt subsidiary more than a year in the past. Is powder with talc safe. When the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was lifted. J&J wanted to see it continue in the meantime of hearing the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay having been officially lifted, the first new cases were filed and incorporated into the talcum powder class action MDL in the space of a year. Seven new talc cases were added to the MDL over the last month which brings the total number of cases that are pending to 37,522.
February 25, 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) begin an investigation into the amount J&J product containing talc has cost the government over the many years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc product for decades while tax dollars were used to treat those who were injured through exposure to the chemicals. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Is powder with talc safe. J&J needs to start making reasonable settlement proposals to victims to the process of putting all this behind it. It is a stain on one of the world’s greatest firms.
