Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. Going back to more than 400 years in American past, the company claims that bankruptcy benefits all parties because it distributes settlements more equally and efficiently than trial courts, in which some litigants receive substantial awards while others receive nothing.

Hyperbole is not exempt: victims’ lawyers call it the biggest “fraudulent move ever in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of pushing this $8.9 billion settlement through and maintain the pressure on plaintiffs.
