J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay for different types of cancer patients in the bankruptcy settlement. April 13th 2023 Update: The most important news is the $8.9 billion over the course of 25 years of settlement. April 12, 2023 Update: People are looking for ways J&J could file for bankruptcy once more. The answer is complicated and convoluted. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc-related lawsuits definitively. In other words, it thinks it will pay less if there is the bankruptcy element which applies pressure to settle. Driving past hundreds of years of American past, the company claims that bankruptcy benefits all parties as it distributes settlements more fairly and more efficiently than trial courts which are where litigants get significant awards while others receive nothing.

April 10, 2023 Update: Bloomberg has an interesting piece on a law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a portion of any profits. J&J is now offering to pay $8.9 billion to settle lawsuits.

The involvement of funders is public knowledge because of the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rules aim to address the rising calls for the regulation of litigation funders.
