J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company intends to pay different types of cancer victims as part of the bankruptcy settlement. It’s trying for a second time to resolve more than 38,000 lawsuits in bankruptcy and stop new cases from coming forward in the future.
The bankruptcy plan of LTL would pay $400 million into an additional trust to settle claims made from state attorney generals claiming that J&J was in violation of state unfair business practices and consumer protection laws by misleading consumers about the quality of its talc products.

May 22nd, 2023 Update Lawyers involved in the second J&J talc bankruptcy are in a dispute over who should be chosen to fill the position of the claims representative in the future, the role is crucially important to resolving the Talc claims. The group claims J&J intentionally withdrew a $61.5 billion financing agreement together with its parent company, LTL Management LLC, to simulate financial stress and validate the unit’s Chapter 11 bankruptcy filing. LTL requested Chapter 11 protection once again following its bankruptcy filing that was rejected by the Third Circuit earlier this year, offering a $8.9 billion agreement. April 13th, 2023 Update: most important announcement is an $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer victims involved in the MDL collective action vowed to fight the settlement along with the talc claimants. Why? They argue that J&J could negotiate a greater settlement or pursue individual claims if the latest bankruptcy is declared unconstitutional.
However, there is a second group of lawyers outside of the top leadership in that class action. These lawyers have amassed tens of thousands of cases. The group is seeking to settle the case now in what many believe to be lower than what the victims should be paid. The argument they make is two-fold. First, they argue that the settlement, which is about 100,000 dollars per plaintiff – is fair.
It’s a difficult argument to make. However, their second argument has more substance: the victims will not afford to wait any longer and need the money immediately.
April 12 2023 Update: People are wondering if J&J can go through bankruptcy once more. The answer is complicated and convoluted. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future lawsuits involving talc conclusively. Driving past the 400-year span of American history, the company believes that bankruptcy is beneficial to all parties by distributing settlements more fairly and efficiently than trial courts, where litigants are awarded significant settlements while others get nothing.
The gist in the 3rd Circuit decision was this isn’t a case that involves a profitable company making an affiliate to accept the legal liability and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified it was not financially difficulty because J&J promises unlimited funding.
This is why J&J decided to go with the funding unlimited part of the contract and didn’t promise to offer unlimited funding for lawsuits. As if offering victims lower amounts of money would resolve the overall issue.

They counter with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. The funders’ involvement is made public because of a New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. March 16 2023 Update: with the bankruptcy stay now fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in the space of a year. Seven new talc-related lawsuits were added to the MDL in the last month, bringing the total number of cases in the pending process up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) begin an investigation into the amount J&J products containing talc have cost the government in the decades.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc products over many years, while tax dollars were used to treat those who were injured through exposure to the product. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
