J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company plans to pay different kinds of cancer victims as part of a bankruptcy settlement. It’s trying for the second time to end more than 38,000 lawsuits brought in bankruptcy, and to prevent any new cases from arising in the near future.

April 13th 2023 Update: The most important announcement is an $8.9 billion over the course of 25 years of settlement. Lawyers representing cancer victims within MDL class action MDL Class Action have pledged to challenge the settlement talc claimants. Why? Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc lawsuits conclusively. Moving past 400 years of American history, the firm argues that bankruptcy benefits all parties because it distributes settlements more equally and efficiently than trial courts, where litigants are awarded significant awards while others receive nothing.
The main thrust of the 3rd Circuit decision was this isn’t a case that involves one that makes a profit, but an affiliate to accept the legal liability and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any wins. J&J is now willing that it will pay $8.9 billion to settle any lawsuits.
The involvement of funders is public knowledge due to the New Jersey court rule requiring the release of certain details about funding sources outside of the. The rule aims to tackle the growing demands for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state infant powder litigation. Third-party funding in mass tort claims has its pros and cons. April 4, 2023 Update: It’s interesting to watch the worm turning in this legal battle. The automatic stay has frozen the cases of talcum powder in a number of years and stopped any new lawsuits from being filed ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt subsidiary more than a year in the past.
