J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company will pay various types of cancer sufferers in a bankruptcy settlement. Is talc in eyeshadow dangerous. J&J has stated that its products containing talc are safe and don’t cause cancer. J&J is seeking the second time to end more than 38,000 lawsuits filed in bankruptcy and prevent new cases from coming forward in the future.
LTL’s bankruptcy plan would pay $400 million to an additional trust to settle claims made from state attorney generals claiming that J&J violated the state’s unfair commercial practices and consumer protection laws by misinforming consumers about the security of its talc-based products.

Many states had initiated consumer protection lawsuits against J&J prior to LTL’s bankruptcy filing stopped those investigations from taking place in 2021. Is talc in eyeshadow dangerous. New Mexico and Mississippi had already launched actions in the past against Johnson & Johnson before then, and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative requests or subpoenas, according to LTL’s court filings.

New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL along with cancer sufferers as well as their counterparts from the U.S. Justice Department’s watchdog on bankruptcy, who have argued that a profitable business like J&J cannot benefit from bankruptcy protections intended for people with debt problems.
The first attempt by LTL to resolve the bankruptcy cases was dismissed after similar arguments. The U.S. appeals court decided that LTL wasn’t in “financial difficulty” and was not eligible for bankruptcy protection. Is talc in eyeshadow dangerous. LTL declared bankruptcy a second time in just two hours following the decision to dismiss, arguing that the second bankruptcy was different as it had less money available and had more support for a settlement.

New Mexico and Mississippi said in their motion to dismiss that LTL’s latest bankruptcy violation of the state’s law enforcement authority by seeking to unilaterally limit the company’s liability for state consumer protection laws.

LTL’s recent filings also provided more information on how the company would evaluate and pay for cancer claims should the bankruptcy plan be approved.

The largest amount of money under the settlement will be $500,000 for those diagnosed with mesothelioma that is terminal before age 45, and $260,000 for patients diagnosed with cancer of the ovary prior to age 45.

The proposed settlement will offer discounts based on the severity and type of cancer, an individual’s age, previous using talc and other factors. Is talc in eyeshadow dangerous. For example an individual who was using talc products on a weekly basis, who had the family history of ovarian cancer and was diagnosed with an ovarian cancer stage II by age 55 may be eligible to receive a payout of $21,125 under the program.

Judge orders J&J and talc oppositionists to take part in settlement talks.

Following another hearing in Johnson & Johnson’s effort to employ a Texas Two Step bankruptcy strategy for talc litigation and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the plan to hold talks to reach a settlement, Bloomberg reports.

In its second bankruptcy effort for LTL Management, a subsidiary set up by J&J to handle the claims company proposed a settlement of $8.9 billion. Is talc in eyeshadow dangerous. While a group of law firms representing plaintiffs support the offer, another group is opposed to the offer.

This week, the opposition group, dubbed”The Official Committee of Talc Claimants, urged the bankruptcy court for dismissal of the matter asserting that LTL can not be considered financially distressed.

“The filing is a desperate and legally deficient attempt by a tiny number of law firms to prevent claimants from voting on the resolution plan, a plan that the overwhelming majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc in eyeshadow dangerous. “The law firms who filed these filings have interests in finance that clash with, diverge from, and are in opposition to the interests that their customers. We’ll be submitting an answer an appeal to the appellate court.”

Is talc in eyeshadow dangerous. Clay Thompson, a lawyer for MRHFM which is home to more than mesothelioma patients who have filed lawsuits against J&J and J&J, has said that J&J’s second bankruptcy attempt will fail.

“J&J sends out press releases about how great its plan is, while insisting that the plan’s details, including what each sick person will receive–be kept secret,” Thompson said in an email. “What does the company have to hide?”

Kaplan has directed the parties to develop a new arrangement plan under the oversight of two mediators.

The court in February of 2022 Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that would release J&J from the thousands of lawsuits over its talcum products.

However, in January of this year a federal appeals court overturned the decision, deciding that the company could not be considered to be in “financial difficulty.”

The J&J’s plan to appeal to the U.S. Supreme Court was denied on April 1, J&J declared bankruptcy about two hours after. In response, Kaplan froze the lawsuits for 60 days to decide whether to grant to file for bankruptcy again.

J&J’s unstoppable profit engine goes out of control after $6.9B settlement charge for talc.

With the Two Chapter 11 attempts, J&J has purchased 19 months of which cases have been on hold. Is talc in eyeshadow dangerous. The company is requesting that claimants take a vote to accept their settlement. J&J will require 75% support for the deal to pass.

In addition to the team of talc lawyers that criticized the company’s bankruptcy in the U.S. Trustee, the U.S. Trustee is an arm that is part of the U.S. Department of Justice, also filed motions to dismiss LTL’s second bankruptcy.

In a statement this week, U.S. Trustee Andrew R. Vara wrote that the the bankruptcy court are “open to honest, but naive debtors.” Those doors “are not available to anyone who do not have a legitimate bankruptcy purpose or that seek to use bankruptcy to delay or hinder their creditors,” Vara continued.

For its part, J&J maintains there is no definitive evidence to suggest that its Talc-based products, such as its famous baby powder, cause cancer. J&J has taken its products off of the market–first to be available in North America in 2020–and the rest of the world this year.

J&J is determined to stay clear of the costly business of going to court. J&J has won most of the cases that have been decided during trial, however, certain losses have been extremely punitive.
A highly publicized trial in Missouri produced an $4.7 billion judgment against the drug manufacturer that was later reduced to $2.1 billion after appeals.

Overall, J&J has lost nine cases involving talc, which are appealing or resolved. Out of 41 trials 32 ended with winning for J&J either through a mistrial or verdict of a plaintiff annulled on appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc In Eyeshadow Dangerous

June 2 2023 Update: At an asbestos talc court trial held at the trial in California yesterday, technical issues halted the opening statement by the defense lawyers. Is talc in eyeshadow dangerous. Jurors who were watching at home via Zoom and hearing the Johnson and Johnson’s lawyer express skepticism about the 70s science that claimed asbestos was present in their product prior to the session abruptly ended.

In the meantime, the plaintiff had the opportunity to present the first of their witnesses, Arthur Langer. Langer explained that the existence of other minerals in talc is expected. He claimed that his group informed J&J in the year 1971 about the presence of chrysotile asbestos the talc manufactured by the company, though with less than 0.1 percent. He also discovered more asbestos in the year 1976.

June 1st, 2023 Update Is talc in eyeshadow dangerous. This is the first court trial that has taken place since J&J took the decision to disband its Talc division and declare bankruptcy is an important point within the ongoing litigation story. The trial started yesterday in the heartbreaking case of a young, 24-year-old plaintiff who was diagnosed with an extremely rare and aggressive form of mesothelioma last year. a diagnosis lawyers on both sides of the argument agree is a tragedy of a different kind.

Opening statements revealed distinct differences between each side’s narrative. The attorney representing the plaintiff took aim on Johnson & Johnson, alleging that the company employed deceitful techniques in its research practices and throughout the litigation process. As per the lawyer the company attempted to manipulate asbestos’ definition, in spite of internal documents from 1978 and 1994 showing that asbestos fibers in the tissue of the plaintiffs are included.

Johnson & Johnson’s precarious $8.9 billion settlement offer hangs in the balance as we progress of this trial. Despite the particularity of the mesothelioma trial and its distinct issues compared to other talcum powder lawsuits, a verdict favoring the plaintiff could result in the company with a major setback in its expectations of widespread acceptance of the settlement they have proposed among plaintiffs.

May 31st, 2023 Update: Johnson & Johnson’s bankrupted talc unit has vigorously defended the Second Chapter 11 filing in the face of challenges from the talc injury plaintiffs. In an opposition filed with the New Jersey bankruptcy court, J&J’s subsidiary claimed that the filing was fundamentally different from the prior filing. The subsidiary emphasized the record-breaking commitment of $8.9 billion to J&J the largest settlement ever made in any bankruptcy case that involves mass tort. Is talc in eyeshadow dangerous. There was no mention of how the magnitude of the settlement implies that it is an equitable settlement. J&J also claimed support from a variety of plaintiffs’ law firms that represent over the 60,000 plaintiffs. This is difficult to verify but likely incorrect.

May 24 2023 Update: As of Johnson & Johnson’s bankruptcy in 2021 filing, the first trial regarding the cosmetic talc products it claims to comprised of asbestos is set to begin jury selection on Monday, California within the Alameda County Superior Court, the most favored jurisdiction for plaintiffs. The plaintiff claims his mesothelioma was triggered by asbestos exposure through J&J’s products, an allegation the company is denying. The trial also involves six retailers accused of selling talc products.

May 22nd, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are fighting over who should be appointed to the role of future claims representative, a role that is critically critical to resolving claims involving talc. Is talc in eyeshadow dangerous. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States was appointed as the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed to this position and again, but attorneys for the talc plaintiffs have raised objections to the claim that Ellis has a conflict of interest which should stop her from taking on that role in the future. The dispute stems from reality that Ellis was reportedly involved in the drafting of the highly contesting second bankruptcy, raising doubts about her ability to be neutral. In reality, the bankruptcy will be dismissed regardless.

May 17th, 2023 Update: The pretend company that J&J formed to settle the talc litigation bankruptcy has informed an New Jersey bankruptcy court that they have allocated $400 million to settle claims made by states accusing the company of deceitful advertising for its talc-based products. Is talc in eyeshadow dangerous. That’s an $8.5 billion settlement for cancer patients. It is hard to imagine a scenario where J&J could push these baby powder settlements through given these numbers. While J&J’s proposed $8.5 billion offer seems like a lot at first, it does not look very appealing when you look at the numbers. This settlement offer based on our rough calculations would not pay victims much more than $100,000 per case. It’s not enough.

May 15, 2023 update: J&J is potentially facing a lawsuit brought by an advocacy group representing cancer patients. Is talc in eyeshadow dangerous. The group argues that J&J intentionally canceled an $61.5 billion funding agreement with its subsidiary, LTL Management LLC, to create the appearance of financial hardship and confirm the unit’s Chapter 11 bankruptcy filing. The group claims that this move is equivalent to a fraudulent transfer of the rights of compensation for victims. They plan to explore J&J’s actions following of the dismissal of LTL’s first bankruptcy case.

May 10 2023 Update: During the next week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy application that was filed by J&J LTL Management, J&J’s subsidiary. LTL Management. However, in the meantime the bankruptcy has issued an Order calling for both parties to participate in a new settlement negotiation to see if an international settlement agreement can be reached.

May 5 2023 Update: The talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Is talc in eyeshadow dangerous. Over 2,700 individuals have sued the company and it is spending $1 million a month on legal defense. The company’s latest $29 million verdict at the Supreme Court of South Carolina forced it to seek bankruptcy protection, arguing for an equitable distribution of assets to talc claimants, rather than being taken by the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of litigation.

May 4 2023 update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to relaunch talks with lawyers who rebuffed the company’s $8.9 billion agreement. It was in Trenton, New Jersey yesterday, the parties appeared before a judge to discuss next steps for the second bankruptcy case and Judge Kaplan has pushed for further settlement talks.

This is the best way to settle these claims for J&J. A settlement for baby powder can be completed. Is talc in eyeshadow dangerous. But it’ll need additional money – perhaps billions of dollars coming from Johnson & Johnson.

Lawyers are split on whether or not to accept the plan and not all clients view the situation the same way their attorney does. This second case of bankruptcy is bound to fail, and Judge Kaplan has set a date for a hearing in June to decide whether to dismiss the bankruptcy for the second time.

May 3 2023 Update: A group representing cancer patients suing Johnson & Johnson (J&J) requested an order from they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation surrounding talc-based products. The group representing claimants for talc filed a motion on Tuesday requesting for the Third Circuit to consider their case and then send it back before a court of lower jurisdiction, with instructions to discharge the bankruptcy. Is talc in eyeshadow dangerous. They also asked that the lawsuit against the halted torts of J&J allow the litigation to proceed.
LTL has filed for Chapter 11 protection once again after its bankruptcy filing was rejected by the Third Circuit earlier this year, offering an $8.9 billion settlement. The committee says that the recent decision allowing LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J should be subject to an immediate Third Circuit review. The US Trustee also requested that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a formal response to the appeals court declaring the filing an “desperate and legally deficient plan” by a handful of law firms that have conflicts of financial interests.
May 1 2023 Update: One question people keep asking is how plaintiffs and their lawyers be able to turn off $8.9 billion. Of course, that’s an enormous amount of money. But there are a lot of victims. Is talc in eyeshadow dangerous. And these are really good cases for plaintiffs. We were reminded recently by two talc-related trials that resulted in big verdicts for plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon led to a verdict that was $18.1 million. The following month, a second talc mesothelioma case went to hearing in South Carolina and resulted in a verdict of $29million for the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc., one of the largest manufacturers of talc in U.S.
April 30, 2023 Update: When J&J first tried to bring the lawsuit over talcum powder into bankruptcy, it did so with an offer to reserve $2 billion to settle the case. The sum was ridiculously low. All of the talc plaintiffs were in favor of the proposal. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims are willing to accept bankruptcy settlements and they also have the backing of a significant portion of the talc plaintiffs and their lawyers. Is talc in eyeshadow dangerous. However, 75% of plaintiffs of talc are required to approve bankruptcy plans is not an easy task since there are so many lawyers with large inventory of baby powder-related lawsuits, opposed against the proposed settlement.

What is the solution to this impasse? More billions.
April 25, 2023, Update Talc plaintiffs have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc in eyeshadow dangerous. The 3rd Circuit dismissed its first Chapter 11 case in January and said that the company wasn’t eligible to receive bankruptcy relief because it had not demonstrated financial distress.

The plaintiffs argue that LTL’s Second Chapter 11 case is an fraud on the bankruptcy system, and that the case is being handled in bad good faith. J&J asserts that the bankruptcy settlement receives “significant backing” from the firms that represent about 60,000 potential people who are claiming. It is fair to say that the plaintiffs’ attorneys and victims ‘ lawyers are divided on this $8.9 billion amount of settlement offered.

April 21, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that it sold baby powder that was contaminated and causing cancer. While trials in the talc lawsuits have been suspended for a minimum of 60 days and new lawsuits are able to be filed and lawyers are able to begin preparing their cases. Is talc in eyeshadow dangerous. Judges expressed doubt about J&J’s ridiculous effort to relaunch its strategy in a second bankruptcy case.

April 13th, 2023 Update: big announcement is an $8.9 billion over 25 years of settlement. Lawyers representing cancer victims within MDL class action MDL collective action promised to fight the settlement with the talc claimants. Why? They believe it’s too little money for the more than 70,000 cancer victims. Is talc in eyeshadow dangerous. They argue that J&J should negotiate a bigger settlement or pursue individual claims in the event that the latest bankruptcy is thrown out.

But there is another group of lawyers that is not part of the top leadership in this class action. The lawyers collectively have accumulated many thousands of cases. They want to settle today with what they believe is lower than what the victims should be paid. The argument they make is two-fold. The first is that they claim the settlement of around an average of $100,000 per plaintiff – is fair.

This is an argument that is difficult to argue. However, their second argument has more force: the victims can not afford to wait any longer and need their money today.

April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy again. The answer is complex and complex. However, let’s attempt to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only method to resolve both current and future talc-related lawsuits definitively. Also, it thinks it can get a lower rate if there is the bankruptcy element which applies pressure for a settlement. Is talc in eyeshadow dangerous. Driving past the 400-year span of American time, the business claims that bankruptcy benefits everyone by dispersing settlement payments more equitably and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.

The basic tenet in this 3rd Circuit decision was this is not a case – one that makes a profit, but a subsidiary to take the legal responsibility and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, the court also ruled that the entity was financially crisis because J&J offered unlimited financing.
Then J&J did not hesitate to take advantage of the funding unlimited part of the deal and didn’t promise that it would provide unlimited funds for cases. The company says that its modified financing arrangements with its subsidiary addresses the appeals court’s concerns, while offering claim payment funds. As if offering victims lower amounts of money would resolve the underlying issue.

Attorneys representing cancer victims who are against the agreement argue the agreement with what is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared the lawyers representing victims call it the most significant “fraudulent move ever in United States history.”

Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way to push for this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023 Update Bloomberg is running an intriguing piece on a law that has been passed within New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of wins. J&J has now offered that it will pay $8.9 billion in settlements for all lawsuits.

The funders’ involvement is made public due to the New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to address the rising calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine federal and state baby powder lawsuits. Third-party funding in mass tort claims has its pros and pros and. But there is no question that we are seeing how third-party funding could level the playing field for individuals and large corporations in the courtroom.

April 4 2023 Update: It’s enjoyable to see the worm turn in this case. J&J was hit again this week when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals a bankruptcy decision at the U.S. Supreme Court. Automatic stays have froze thousands of talcum cases and stopped any new lawsuits from being filed ever since J&J began the controversial plan to spin the talc debts into a bankrupt subsidiary more than a year back. Is talc in eyeshadow dangerous. When the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was revoked. J&J had hoped to have it remain in effect until its SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that the Supreme Court is willing even to hear the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay being officially lifted, the first new cases have been filed and transferred into the talcum powder class action MDL in the space of a year. Seven new talc-related lawsuits were joined to the MDL in the last month, bringing the total number of cases pending to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J product containing talc has cost the government in the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc products over decades while tax dollars were spent on treating people who suffered injuries from exposure to the products. This lawsuit comes a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.

Is talc in eyeshadow dangerous. J&J should begin to make reasonable settlements to victims to begin to put all of this behind. This is a disgrace to one of the world’s greatest businesses.

February 14 2023 Update: In an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
