There is a different group of lawyers outside of the leadership in that class action. The lawyers collectively have accumulated the equivalent of tens of thousands of lawsuits. The group is seeking to settle today for what is believed to be less than the victims deserve. The argument they make is two-fold. First, they argue the settlement – which amounts to an average of $100,000 per plaintiff – is fair.
This argument isn’t easy to make. However, their second argument has more teeth: victims can now not wait and they want their money now.
April 12 2023 Update: People are seeking out how J&J can go through bankruptcy once more. The answer is complex and complicated. Let’s try to simplify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc-related lawsuits definitively. In other words, it believes it can pay less should there be an element of bankruptcy that puts pressure to negotiate a settlement. Is talc in makeup cancer. Driving past the 400-year span of American history, the company asserts that bankruptcy benefits all parties because it distributes settlement payments more equitably and effectively than trial courts, in which some litigants receive substantial settlements while others get nothing.
The essence in this 3rd Circuit decision was this isn’t a case that involves a profitable company making a subsidiary to take the legal risk and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled that the entity was financially distress because J&J offered unlimited financing.
This is why J&J jumped on the unlimited funding portion of the deal but did not pledge to provide unlimited funding for lawsuits. The company claims that new financing agreements with its subsidiary address appeals court’s concerns while still offering claim payment funds. As if providing victims with less money would solve the underlying issue.
Attorneys representing cancer patients who oppose the deal counter the agreement with what is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier decision. Hyperbole is not exempt: victims’ lawyers call it the most significant “fraudulent transaction of assets in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement and keep pressure on plaintiffs.
April 10 2023, Update Bloomberg is running an intriguing report on a brand new law within New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. J&J is now willing to pay $8.9 billion to settle lawsuits.
The involvement of the funders is publicly available due to a New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to address the rising calls for regulation of the litigation funders. J&J has more than 60,000 claims when you add up federal and state infant powder litigation. Third-party financing in mass tort cases has its pros and pros and. However, there is no doubt that we are witnessing how third-party funding could level the playing field between individuals and large corporations in the courtroom.
April 4, 2023 Update: It is enjoyable to see the worm turn in this lawsuit. J&J took another hit this week when they were denied by the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals a bankruptcy ruling before the U.S. Supreme Court. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc product for long while tax dollars spent on treating people who suffered injuries from exposure to the chemicals.
