April 13 2023: Update on the most important story is that there’s an $8.9 billion over the next 25 years offer for settlement. April 12 2023 Update: Many are looking for ways J&J is able to file for bankruptcy again. The answer is complicated and confusing. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc-related lawsuits definitively. In other words, it believes that it will be less expensive should there be a bankruptcy component that applies pressure to negotiate a settlement. Is talc in medication safe. Moving past hundreds of years of American past, the company argues that bankruptcy benefits all parties as it distributes settlements more fairly and efficiently than trial courts, where some litigants receive significant award while others do not.
The essence in the 3rd Circuit decision was this is not a case – one that makes a profit, but a subsidiary to take the legal burden and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. But it also said that the entity was in financial difficulty because J&J assured it of unlimited funding.
Thus, J&J took advantage of the unlimited funding part of the contract and didn’t promise that it would provide unlimited funds for lawsuits. J&J claims that its new financing agreements with its subsidiary address appeals court’s concerns, while offering claim payment funds. As if offering victims lower amounts of money would resolve the overarching problem.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now requesting that be the U.S. Government Accountability Office (GAO) initiate an investigation to determine how much J&J products containing talc have cost the government in the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc products over decades while tax dollars were spent on treating people who suffered injuries from exposure to the product.
