J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay different types of cancer patients in the bankruptcy settlement. April 13 2023: Update on the big announcement is an $8.9 billion over the next 25 years settlement offer. April 12 2023 Update: People are wondering if J&J is able to file for bankruptcy once more. The answer is complex and complex. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc lawsuits conclusively. As if offering victims lesser money could solve the underlying issue.
Attorneys representing cancer patients who oppose the deal counter this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole is not exempt by the victims’ lawyers, who call it the biggest “fraudulent move in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way of trying to push this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10 2023, Update Bloomberg is running an intriguing article about a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of profits. J&J is now offering an offer of $8.9 billion to settle all lawsuits.
The funders’ involvement is made public because of a New Jersey court rule requiring the release of certain details about funders outside the state. The rule aims to respond to the increasing calls for regulation of litigation funders. J&J has more than 60,000 claims when you take into account federal and state infant powder litigation. Third-party financing in mass tort cases has its pros and cons. There is no doubt that we are seeing how third-party funding can level the playing field between people and large corporations in the courtroom.
April 4, 2023 Update: It’s fun to watch the worm turning in this case. J&J has taken another blow this week, when they were denied by the Third Circuit denied J&J’s request to extend the automatic stay in the meantime that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. The automatic stay has frozen thousands of talcum powder cases and prevented the filing of new lawsuits ever since J&J started the controversial process to spin the talc liability into a bankrupt subsidiary more than a year in the past. February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J Talc products have cost the government in the decades.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc product for years while tax dollars were utilized to treat people injured by exposure to the product. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
