J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay different types of cancer patients in the bankruptcy settlement. Is talc made from asbestos. J&J has claimed that its Talc products are safe and will not cause cancer. The company is trying for another time to settle more than 38,000 lawsuits brought in bankruptcy, and to prevent any new cases from being filed in the future.
LTL’s bankruptcy plan will pay $400 million into a separate trust for claims filed by state attorneys general claiming that J&J was in violation of state unfair business practices and consumer protection laws by misinforming consumers regarding the security of its talc-based products.

Many states had initiated consumer protection lawsuits against J&J prior to the time that LTL’s bankruptcy filing stopped these investigations from progressing in 2021. Is talc made from asbestos. New Mexico and Mississippi had already initiated lawsuits against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas in LTL’s court documents.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished in a joint move with cancer victims and the U.S. Justice Department’s bankruptcy watchdog. have argued that a profitable firm like J&J cannot benefit from bankruptcy protections meant for struggling debtors.
LTL’s first attempt at resolving the bankruptcy cases was dismissed following similar arguments. A U.S. appellate court determined that LTL did not have “financial financial distress” and was not eligible for bankruptcy protection. Is talc made from asbestos. LTL filed a second bankruptcy within two hours of the dismissal, saying that the second bankruptcy was different as it was able to borrow less and more support for the settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s bankruptcy renewal violates state law enforcement powers by seeking to unilaterally limit the liability of the company for state consumer protection actions.

LTL’s recent filings also provided more details on the way in which the company will evaluate and pay claims for cancer should the bankruptcy plan be approved.

The highest payments under the settlement will be $500,000 for people diagnosed with mesothelioma terminal prior to age 45 and $260,000 for those who have been diagnosed with advanced ovarian cancer prior to age 45.

The proposed settlement will offer discounts based on the type and severity of cancer, an individual’s years of age, their history of using talc and other factors. Is talc made from asbestos. For example someone who regularly used talc products weekly, had the family history of ovarian cancer, and was diagnosed with an ovarian cancer stage II at age 55 could be in line for a $21,125 payment under the plan.

Judge decides J&J, talc opponents to participate in settlement talks.

After another round of hearings in Johnson & Johnson’s effort to use a Texas Two-Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the firm and the people who opposed the move to conduct settlement talks, Bloomberg reports.

With its second bankruptcy attempt for LTL Management–a subsidiary established by J&J to settle claims – the company offered a settlement amounting to $8.9 billion. Is talc made from asbestos. While one group of law firms representing plaintiffs supports the deal, another group opposes the move.

In the last week, an opposition group, known as the Official Committee of Talc Claimants, urged the bankruptcy court to dismiss the case asserting that LTL cannot be regarded as to be in financial trouble.

“The filing is a desperate and legally deficient attempt by a tiny number of law firms to try to stop claimants from deciding on the resolution plan–a plan the vast majority of claimants support,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc made from asbestos. “The law firms involved in this filing have financial interests that conflict with, differ from and contravene those that their customers. We’ll soon submit an answer before the court of appeals.”

Is talc made from asbestos. Clay Thompson, a lawyer for MRHFM that includes more than mesothelioma victims who have filed lawsuits against J&J claimed that the company’s second bankruptcy try will fail.

“J&J publishes press release about how wonderful its plans are, but is insisting that the plan’s details, including what each sick person will receive,” Thompson said in an announcement. “What do J&J have to conceal?”

Kaplan has instructed both sides to come up with another arrangement plan under the supervision by two mediators.

The court in February of 2022 Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that would release J&J from the tens of thousands of claims over its talcum products.

However, in January of this year, a federal appeals court ruled against the ruling, ruling that the business could not be considered to be in “financial trouble.”

After J&J’s contest the U.S. Supreme Court was denied the same month, J&J applied for its first bankruptcy roughly two hours after. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether to grant another bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B settlement charge for talc.

In the Two Chapter 11 attempts, J&J has been able to buy 19 months in which cases were put on hold. Is talc made from asbestos. The company is requesting that claimants decide whether they want to accept the settlement. J&J will require 75% approval for the settlement to be approved.

In addition to the team of talc lawyers who criticised LTL’s bankruptcy plan and the U.S. Trustee, an arm belonging to the U.S. Department of Justice is also submitting an appeal to dismiss LTL’s bankruptcy second case.

In a statement this week, U.S. Trustee Andrew R. Vara wrote that the the bankruptcy court remain “open to honest, but naive debtors.” Those doors “are not open to any parties that lack a legitimate bankruptcy purpose or that seek to abuse the bankruptcy process to delay or hinder their creditors,” Vara continued.

To its credit, J&J maintains there is no evidence conclusive that its products containing talc, such as its famous baby powder, cause cancer. J&J has been taking the products of the market first in North America in 2020–and the remainder of the globe later this year.

J&J wants to avoid the expense of going to court. J&J has won the majority of cases decided through trial, though some losses have been very punishing.
A high-profile trial in Missouri led to an $4.7 billion verdict against the drugmaker that was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial involving talc that are being appealed or concluded. Out of 41 trials 32 of them ended in an outcome for J&J either through a mistrial or verdict of a plaintiff annulled in appeal. Is talc made from asbestos. Separately, the company in 2020 negotiated to settle over 1000 cases for the sum of $100 million. Bloomberg announced at that time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Made From Asbestos

June 2, 2023 Update: During the trial for asbestos-containing talc that took place in California yesterday, a few technical glitches interrupted the opening statement by the defense attorneys. Is talc made from asbestos. Jurors watching from home via Zoom, did hear Johnson & Johnson’s lawyer expressing skepticism about the 70s science affirming the presence of asbestos in their product, but the trial was abruptly closed.

In the meantime, the plaintiff was able to introduce the first of their witnesses, Arthur Langer. Langer said that the presence of other minerals in talc is inevitable. He testified that his team had notified J&J in 1971 about the presence of chrysotile asbestos in the company’s talc, albeit at lower than 0.1 percent. The asbestos was discovered by him in 1976.

June 1st, 2023 Update: Is talc made from asbestos. This is the first court trial that has taken place since J&J took the decision to disband its talc segment and file for bankruptcy marks an important moment within the ongoing litigation controversy. Trial began yesterday in the tragic trial of a young plaintiff who was diagnosed with a rare and aggressive type of mesothelioma in the past year, which both sides agree is a grave tragedy.

Opening statements laid bare huge differences between the sides’ story. The plaintiff’s attorney took aim at Johnson & Johnson, alleging that the company employed deceitful techniques in its research practices and throughout the litigation process. According to the attorney Johnson & Johnson tried to alter the definition of asbestos despite internal documents from the year 1978 and 1994 indicating that asbestos fibers found in tissue of the plaintiffs are included.

Johnson &J’s highly uncertain $8.9 billion settlement deal hangs in the balance as we development of the trial. Despite the particularity of the mesothelioma trial and its distinctive issues in comparison to the majority of talcum powder lawsuits A verdict in favor of the plaintiff could be an enormous setback for J&J’s hopes for broad acceptance of their settlement proposal among plaintiffs.

May 31st 2023: Update from Johnson & Johnson’s bankrupted talc unit has is defending it’s 2nd Chapter 11 filing in the in the face of challenges from talc injury claimants. In an opposition filed with the New Jersey bankruptcy court, it argued that the filing was vastly different from the previous filing. It also emphasized the unprecedented commitment of $8.9 billion to J&J the biggest settlement ever to be made in a mass tort bankruptcy case. Is talc made from asbestos. The issue is not discussed: whether the size of the settlement implies that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal companies representing over 600,00 claimants. This is difficult to verify however it is likely to be incorrect.

May 24 2023 Update: In the wake of Johnson &J Johnson’s bankruptcy filing, the very first trial concerning its cosmetic talc items allegedly with asbestos content is scheduled to begin jury selection on Monday in California with Alameda County Superior Court, which is a well-known jurisdiction for plaintiffs. The plaintiff asserts that his mesothelioma was caused by asbestos exposure in J&J’s product, an allegation the company does not deny. The trial also involves six retailers who are accused of selling talc-based products.

May 22nd, 2023 Update: Lawyers in the 2nd J&J talc bankruptcy are disputing who should be appointed to the position of future claims representative. This is a role that is critically critical to resolving claim for talc. Is talc made from asbestos. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States, was appointed as the claims representative in the initial bankruptcy. J&J’s defense team would like Ellis to be appointed to this position yet again, but the lawyers for the talc plaintiffs have raised objections to the claim that Ellis has an interest conflict that should prevent her from taking on that role for the second time. This conflict is rooted in the issue that Ellis was apparently involved in drafting the hotly contested second bankruptcy, raising doubts about her capacity to be neutral. It’s true that the bankruptcy will be dismissed regardless.

May 17, 2023 Update The pretend company J&J put together to settle the talc litigation bankruptcy has informed an New Jersey bankruptcy court that they have designated $400 million as a settlement for allegations made by states who accuse the company of misleading advertising regarding its talc products. Is talc made from asbestos. That’s an $8.5 billion settlement for cancer victims. It’s difficult to envision an eventuality where J&J can push these baby powder settlements through given these numbers. While J&J’s $8.5 billion offer might seem like a lot initially, it may not appear appealing when you look at the numbers. This settlement offer based on our estimates – will not provide victims with much more than a median settlement of $100,000 per instance. This isn’t enough.

May 15 2023, Update J&J may be in the middle of a suit from an advocacy group representing cancer patients. Is talc made from asbestos. The group claims that J&J intentionally canceled an $61.5 billion fund-raising agreement with its subsidiary, LTL Management LLC, to create the appearance of financial hardship and verify the unit’s Chapter 11 bankruptcy filing. The group asserts this action is equivalent to a fraudulent transfer of rights of victims’ compensation. They will investigate J&J’s actions after the announcement of the decision to dismiss LTL’s first bankruptcy case.

May 10 2023 Update: The following week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy filing that was filed by J&J subsidiary LTL Management. In the meantime LTL Management has filed an Order which requires both sides to take part in a new settlement mediation to see if the global settlement can be been reached.

May 5th, 2023: Update on Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer from asbestos exposure. Is talc made from asbestos. Over 2,700 people have sued the company and it has been spending $1 million a month to defend itself. The company’s recent $29 million settlement on the state of South Carolina forced it to file for bankruptcy protection, arguing for an equitable distribution of assets to talc claimants, rather than being seized from the receiver. Other suppliers of talc have declared bankruptcy because of lawsuits.

May 4 2023 Update: U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to reopen negotiations with lawyers who turned down the company’s $8.9 billion settlement offer. In Trenton, New Jersey yesterday, the parties gathered in court to discuss the next steps for their second bankruptcy matter and Judge Kaplan has pushed for further settlement talks.

This is the way to resolve these claims for J&J. A settlement for baby powder can be made. Is talc made from asbestos. However, it will require additional money – perhaps billions of dollars – from Johnson & Johnson.

Lawyers are split on whether or not to accept the plan and not every client views this issue the same way their attorney does. The second bankruptcy case is expected to fail and Judge Kaplan has scheduled a hearing for June to determine if she will close the case for the third time.

May 3, 2023 Update A group of cancer patients who have sued Johnson & Johnson (J&J) asked to have the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation surrounding talc-based products. The group of talc claimants has filed a motion this week asking that the Third Circuit to consider their case and to send it back an earlier court with instructions for dismissing the bankruptcy. Is talc made from asbestos. The committee also requested that the stoppage of tort litigation against J&J continue to continue.
LTL applied for Chapter 11 protection once again following its bankruptcy filing that was denied by the Third Circuit earlier this year which offered a $8.9 billion payment. The committee believes that the recent ruling which allowed LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J is a reason for urgent Third Circuit review. The US Trustee has also requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg declaring that J&J plans to file a response in the appeals court, characterizing the filing as an “desperate and legally flawed plan” by a small number of law firms who have conflicting financial interests.
May 1 2023 Update: A question people keep asking is how could plaintiffs and their attorneys turn down $8.9 billion. Of course, it’s an immense amount of money. But there are plenty of victims. Is talc made from asbestos. These are an excellent cases for plaintiffs. We were reminded of this recently when two talc cases led to huge verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon resulted in the verdict of $18.1 million. A month later, another talc mesothelioma case went to trial in South Carolina and resulted in an award of $29 million to the plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc. one of the most prominent producers of talc in the U.S.
April 30th 2023 Update: When J&J initially tried to take the talcum powder lawsuit into bankruptcy, it did so with an offer to set aside $2 billion for settlements. The sum was ridiculously low. None of the talc plaintiffs agreed with the offer. This time around, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they are willing to accept bankruptcy settlements and they also have the support of a large portion of the talc plaintiffs as well as their lawyers. Is talc made from asbestos. But 75% of the plaintiffs who are a talc, which is necessary for bankruptcy plan approval is not an easy task since there are so many lawyers with vast inventory of baby powder-related lawsuits, opposed to the settlement.

What is the solution to this impasse? More billions.
April 25 2023 Update: Talc patients have demanded a judge reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc made from asbestos. The 3rd Circuit dismissed its first Chapter 11 case in January and said that the company wasn’t eligible to receive bankruptcy relief because it failed to show financial distress.

The claimants assert that the third Chapter 11 case is an misuse of the bankruptcy system and that it’s being conducted in bad faith. J&J states that the bankruptcy settlement is backed by “significant backing” from the firms that represent around 60,000 people who are claiming. It’s safe to say that plaintiffs’ lawyers and victims ‘ lawyers are not united over the $8.9 billion amount of settlement offered.

April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that it sold a baby powder that contained a chemical that causes cancer. Even though trials for Talc lawsuits are suspended for a minimum of 60 days and new lawsuits are able to be filed and lawyers may begin to prepare their cases. Is talc made from asbestos. The judge expressed skepticism over J&J’s attempt to revive its strategy by filing a second bankruptcy trial.

April 13 2023: Update on the big announcement is an $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer victims within the MDL class action have promised to fight the settlement along with those who claim talc. Why? They believe it’s not enough for 70 000 cancer patients. Is talc made from asbestos. These lawyers believe that J&J should negotiate a larger settlement or settle individual claims if the latest bankruptcy is declared unconstitutional.

But there’s a separate lawyer group that isn’t part of the leadership in that class action. These lawyers have amassed many thousands of cases. They want to settle the case now for what many argue is far less than what these victims deserve. Their argument is twofold. First, they argue the settlement – about the equivalent of $100,000 per plaintiff – is fair.

That is a hard argument to make. But their second argument has more substance: the victims will no longer wait and want their money today.

April 12 2023 Update: People are wondering if J&J is able to file for bankruptcy once more. The answer is complex and complex. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc lawsuits conclusively. Also, it believes that it will be less expensive if there is an element of bankruptcy that puts pressure to settle. Is talc made from asbestos. Driving past 400 years of American history, the firm argues that bankruptcy benefits all parties by distributing settlement payments more equitably and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.

The main thrust in this 3rd Circuit decision was this is not a case – the profit-making company that has an affiliate to accept the legal risk and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. But it also said that the subsidiary was not financially crisis because J&J promised unlimited funding.
So J&J jumped on the unlimited funding aspect of the holding and didn’t make any promises to offer unlimited funding for lawsuits. J&J claims that its modified financing arrangements with its subsidiary address the appeals court’s concerns while still offering claim payment funds. As if offering victims lesser money could solve the underlying issue.

Attorneys representing cancer patients who oppose the deal counter this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole is not exempt by the victims’ lawyers, who call it the biggest “fraudulent move in United States history.”

In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way of trying to push this $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10 2023, Update Bloomberg is running an intriguing article about a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of profits. J&J is now offering an offer of $8.9 billion to settle all lawsuits.

The funders’ involvement is made public because of a New Jersey court rule requiring the release of certain details about funders outside the state. The rule aims to respond to the increasing calls for regulation of litigation funders. J&J has more than 60,000 claims when you take into account federal and state infant powder litigation. Third-party financing in mass tort cases has its pros and cons. There is no doubt that we are seeing how third-party funding can level the playing field between people and large corporations in the courtroom.

April 4, 2023 Update: It’s fun to watch the worm turning in this case. J&J has taken another blow this week, when they were denied by the Third Circuit denied J&J’s request to extend the automatic stay in the meantime that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. The automatic stay has frozen thousands of talcum powder cases and prevented the filing of new lawsuits ever since J&J started the controversial process to spin the talc liability into a bankrupt subsidiary more than a year in the past. Is talc made from asbestos. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient some months ago, the stay was revoked. J&J had hoped to have it stayed in place until the SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that the Supreme Court is willing even to accept the appeal? Low.
March 16 2023 Update: with the bankruptcy stay being officially lifted, the first new cases were filed and incorporated into the talcum powder class action MDL in just over a year. Seven new talc cases were joined to the MDL during the month of March and brought the total number of cases that are pending to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J Talc products have cost the government in the decades.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc product for years while tax dollars were utilized to treat people injured by exposure to the product. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is talc made from asbestos. J&J should begin to make fair settlement offers for victims in order to put all of this behind. This is a blemish on one of the world’s greatest businesses.

February 14 2023 Update: In the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
