April 13, 2023 update: the biggest story is that there’s an $8.9 billion over the next 25 years offer for settlement. April 12 2023 Update: Many are looking for ways J&J is able to file for bankruptcy again. The answer is complex and convoluted. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc lawsuits conclusively. That is, it believes it can pay less in the event of the bankruptcy element which applies pressure to settle. Is talc makeup bad. Driving past hundreds of years of American time, the business claims that bankruptcy benefits all parties as it distributes settlements more equally and effectively than trial courts where litigants are awarded significant payouts, while others are left with nothing.

The basic tenet of the 3rd Circuit decision was this is not a matter of the profit-making company that has an affiliate to accept the legal liability and declare bankruptcy Congress thought of when drafting its Bankruptcy Code. The hyperbole wasn’t spared the lawyers representing victims call it the largest “fraudulent transfer of assets in United States history.”

In spite of the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.
