You May be Entitled to Significant Compensation Is talc safe. Johnson & Johnson powders were proven to contain asbestos (a cancer causing agent) and the company failed to notify users of the cancer risk. $2 BILLION has already been awarded to claims. J&J’s proposed talc settlement will make payments of $440 million US state AGs. Is Talc Safe .

Johnson & Johnson (JNJ.N) has put aside $400 million to settle U.S. state consumer protection actions as part of its larger $8.9 billion settlement of allegations that it’s Baby Powder and other talc product causes cancer. Is talc safe.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm will pay various types of cancer victims as part of the bankruptcy settlement. Is talc safe. J&J has stated that its Talc products are safe, and do not cause cancer. The company is trying for another time to settle more than 38,000 cases in bankruptcy and stop new cases from coming forward in the near future.
The bankruptcy plan of LTL would pay $400 million into a separate trust for lawsuits filed by state attorneys general alleging that J&J had violated state unfair business practices and consumer protection laws through misleading consumers about the security of its talc-based products.

A number of states had already initiated consumer protection measures against J&J prior to the time that LTL’s bankruptcy filing prevented these investigations from progressing in 2021. Is talc safe. New Mexico and Mississippi had already brought suits with Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands in LTL’s court papers.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy along with cancer sufferers as well as The U.S. Justice Department’s bankruptcy watchdog, who have claimed that a lucrative business like J&J does not qualify for bankruptcy protections intended for the struggling debtors.
The company’s initial attempt to resolve the bankruptcy lawsuits was rejected after the same arguments. In the end, a U.S. appellate court determined in favor of LTL was not in “financial distress” and ineligible to receive bankruptcy relief. Is talc safe. LTL declared bankruptcy a second time just over two hours after the dismissal, saying that the second bankruptcy was different because it had less money and more support for a settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s bankruptcy renewal violates state law enforcement authorities in attempting to unilaterally limit the company’s liability for state consumer protection measures.

LTL’s filings for the new year also contained additional details about how the company would assess and pay cancer claims should the bankruptcy plan be approved.

The maximum amount under the settlement would be $500,000 to those diagnosed with mesothelioma that is terminal before age 45 and $260,000 for those who have been diagnosed with ovarian cancer that is terminal before age 45.

The proposed settlement offers discounts based on the severity and type of cancer, the patient’s age, the history of talc use and other factors. Is talc safe. For example someone who regularly used talc products on a weekly basis, who had a family history of ovarian cancer, and was diagnosed with the stage 2 ovarian cancer by age 55 might qualify to receive a payment of $21,125 under the program.

Judge ordains J&J and talc opponents to participate in settlement talks.

After another round of hearings in Johnson & Johnson’s attempt to implement a Texas Two-Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company as well as those who oppose the strategy to engage in negotiations to settle the matter, Bloomberg reports.

The second time it attempted to file for bankruptcy for LTL Management–a subsidiary established by J&J to settle claims – the company offered a settlement of $8.9 billion. Is talc safe. While a group of law firms representing plaintiffs agree with the offer, another group opposes the deal.

This week, the opposition group, which is known as”the Official Committee of Talc Claimants and urging the bankruptcy court for dismissal of the matter by arguing that LTL is not considered to be in financial distress.

“The filing is an unjust and legally flawed attempt by a tiny number of law firms to try to block claimants from voting on the resolution plan–a plan that the overwhelming majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc safe. “The law firms that are behind this filing have financial interests that are in conflict with, diverge from, and contravene those they represent. We’ll be submitting a response in the appeals court.”

Is talc safe. Clay Thompson, a lawyer for MRHFM that includes more than mesothelioma victims who have filed lawsuits against J&J for bankruptcy, told J&J’s second bankruptcy attempt failed.

“J&J sends out press releases describing how fantastic its plan is, while insisting that the details of its plan–including the treatment individuals with illnesses would receive–be kept secret,” Thompson said in an announcement. “What do J&J have to cover up?”

Kaplan has instructed the sides to devise a second arrangement plan under supervision and supervision of mediators.

In February 2022, Kaplan confirmed J&J’s use of Chapter 11 to hasten a settlement that would release the company from the hundreds of thousands of claims over its talcum products.

In January of this year, a federal appeals court overturned the decision, ruling that the company could not be considered to be in “financial financial distress.”

After J&J’s contest the U.S. Supreme Court was denied the same month, J&J was granted a second petition for bankruptcy about two hours later. In response, Kaplan froze the lawsuits for 60 days in order to determine whether to allow the second bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B cost of litigation involving talc.

Through Two Chapter 11 attempts, J&J has gotten 19 months of which cases were placed on hold. Is talc safe. The company would like claimants to decide whether they want to accept the settlement. J&J will require 75% support in order for the agreement to be accepted.

In addition to the gang of talc attorneys who have panned the company’s bankruptcy and the U.S. Trustee is an arm of the U.S. Department of Justice has also filed a motion to dismiss LTL’s second bankruptcy case.

In a filing this week, U.S. Trustee Andrew R. Vara wrote that the bankruptcy are “open to honest but unfortunate debtors.” Those doors “are not open to parties that don’t have a legitimate bankruptcy goal or who seek to use the bankruptcy process to delay or hinder their creditors.” Vara continued.

In its own words, J&J maintains there is no conclusive evidence that its Talc products, which includes the famous baby powder, cause cancer. J&J has taken its products off of the market, first on North America in 2020–and the rest of the world next year.

J&J seeks to avoid the expense of going to trial. J&J has won most of the cases decided through trial, though certain losses have been harsh.
A highly-publicized trial in Missouri ended in an $4.7 billion verdict against the drug company, which was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine cases involving talc, which are being appealed or settled. Of the 41 trials, 32 of them ended in the favor of J&J, a mistrial or verdict of a plaintiff reversed upon appeal. Is talc safe. The company also in 2020 sought to settle more than 1,000 cases for $100 million, Bloomberg published at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Safe

June 2 2023 Update: In the asbestos talc case which took place in California yesterday, technical issues disrupted the opening statements made by defense attorneys. Is talc safe. The jurors, attending from their homes via Zoom however, heard Johnson &Johnson’s lawyer express doubt about the 70s research affirming the presence of asbestos in their product before the proceedings abruptly ended.

Meanwhile, the plaintiff had the opportunity to present its first expert witness Arthur Langer. Langer explained that the existence of other minerals alongside talc is inevitable. He claimed that his group advised J&J in the year 1971 of the presence of chrysotile asbestos in the company’s talc, albeit with lower than 0.1 percent. The asbestos was discovered by him in 1976.

June 1, 2023 Update: Is talc safe. The first trial since J&J made the decision to split its Talc division, and then declare bankrupt marks an important turning point of the ongoing litigation saga. The trial started yesterday in the harrowing case of a young, 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma in the past year, which both sides believe is a tragedy of a different kind.

Opening statements revealed the sharp differences in the two sides’ narrative. The attorney representing the plaintiff took aim towards Johnson & Johnson, alleging the use of misleading techniques in its research practices and throughout the litigation process. In the words of attorney Johnson & Johnson tried to alter the definition of asbestos, in spite of internal documents from the year 1978 and 1994 indicating that asbestos fibers found in tissue of the plaintiff are included.

Johnson & Johnson’s uncertain $8.9 billion settlement deal hangs in the balance with the course of this trial. Despite the unique nature of the mesothelioma trial and its unique challenges compared to other talcum powder lawsuits, a verdict favoring the plaintiff could be the company with a major setback in its hopes for broad acceptance of the settlement they have proposed among plaintiffs.

May 31st, 2023 Update: Johnson & Johnson’s bankrupt talc unit strongly defended it’s 2nd Chapter 11 filing in the face of challenges from injured talc claimants. In a written objection to the New Jersey bankruptcy court, the company argued that the filing was distinct from the prior filing. The subsidiary emphasized the record-breaking commitment of $8.9 billion from J&J which is the biggest settlement ever to be made in a mass tort bankruptcy case. Is talc safe. The issue is not discussed: whether the size of the settlement means it is an equitable settlement. J&J also claimed support from a variety of plaintiffs’ law firms representing over sixty thousand claimants. This is difficult to verify but is probably incorrect.

May 24 2023 Update: As of Johnson and Johnson’s bankruptcy filing in 2021 filing, the very first trial concerning its cosmetic talc products that are believed to with asbestos content is scheduled to start jury selection Monday, May 24, California at Alameda County Superior Court, an historically reliable place for plaintiffs. The plaintiff claims his mesothelioma is the result of asbestos exposure resulting from J&J’s products and the company is denying. The trial also includes six retailers who are accused of selling talc-based products.

May 22, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are in a dispute over who should be appointed to the post of the future claims representative, an important role essential to the resolution of the Talc claims. Is talc safe. Randi Ellis, a lawyer who is frequently involved in MDLs across the country, was appointed as the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed to this position and again, but attorneys for the talc plaintiffs are protesting because Ellis has an interest conflict which would prohibit her from being appointed to that post again. The conflict stems from the possibility that Ellis was involved in drafting the controversially contesting second bankruptcy, raising doubts about her ability to be neutral. In reality, the bankruptcy will be dismissed regardless.

May 17, 2023 Update The pretend company J&J put together to settle the talc litigation bankruptcy disclosed to a New Jersey bankruptcy court that they have allocated $400 million to settle the claims of states that accuse J&J of misleading marketing for its talc product. Is talc safe. It’s a $8.5 billion settlement to cancer victims. It’s difficult to imagine an eventuality where J&J could push the settlements of baby powder through at these numbers. Although J&J’s $8.5 billion offer seems like a large sum at first, it does not look good when you consider the math. This settlement offer based on our rough calculations would not pay victims much more than $100,000 per instance. It’s not enough.

May 15 2023 Update J&J is potentially facing a lawsuit by an advocacy group representing cancer victims. Is talc safe. The group claims J&J deliberately retracted a $61.5 billion funding agreement that it had with its company subsidiary LTL Management LLC, to create the appearance of financial hardship and confirm the unit’s Chapter 11 bankruptcy filing. The group argues that this act amounts to a fraudulent transfer of right to compensation for victims. They plan to explore J&J’s actions after the announcement of the denial of LTL’s first bankruptcy case.

May 10 2023 Update: The following week this week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy petition filed by J&J LTL Management, J&J’s subsidiary. LTL Management. In the meantime it has approved an Order that requires both parties to take part in a new settlement mediation to see if it will be possible to reach a global settlement agreement reached.

May 5th, 2023 Update: The talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer due to asbestos exposure. Is talc safe. Over 2,700 people have sued the company and it has been paying $1 million per month for legal defense. The company’s most recent $29 million settlement on the state of South Carolina forced it to pursue bankruptcy protection, and arguing for equitable distribution of assets among talc claimants instead of being taken in the hands of the receiver. Other suppliers of talc have filed for bankruptcy due to legal proceedings.

May 4, 2023 Update U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to resume negotiations with lawyers who rejected Johnson & Johnson’s $8.9 billion deal. In Trenton, New Jersey yesterday the parties appeared before a judge to discuss the next steps for this second case of bankruptcy. Judge Kaplan encouraged further settlement talks.

This is the solution to settle these claims with J&J. A settlement for baby powder can be achieved. Is talc safe. However, it will require more money – more billions of dollars – from Johnson & Johnson.

Lawyers have a split opinion on whether to take the proposal or not and not every client sees this issue the same way their attorney does. This second case of bankruptcy is bound to fail and Judge Kaplan has scheduled a hearing in June to determine if she will remove the bankruptcy after the second.

May 3 2023 Update: A group of cancer victims suing Johnson & Johnson (J&J) demanded an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation over talc products. The group of talc claimants filed a motion on Tuesday, asking for the Third Circuit to consider their case and then send it back the lower court with instructions to discharge the bankruptcy. Is talc safe. They also asked that the halted tort litigation against J&J allow the litigation to proceed.
LTL filed for Chapter 11 protection once again after its first bankruptcy filing was rejected by the Third Circuit earlier this year which offered the possibility of an $8.9 billion deal. The committee says that the recent ruling which allowed LTL’s second Chapter 11 to continue, as well as halting the trials against J&J should be subject to the immediate Third Circuit review. The US Trustee also asked that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a response in the appeals court, declaring the filing a “desperate and legally deficient move” by a handful of law firms who have conflicting financial interests.
May 1st 2023 Update: One most frequently asked question is how could plaintiffs and their lawyers be able to turn on $8.9 billion. Of course, that is an enormous amount of money. There are a lot of victims. Is talc safe. And these are really good case for plaintiffs. We were reminded of this recently by two talc-related trials that have resulted in huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to an award of $18.1 million. In the same month, a different mesothelioma trial involving talc was held for the court within South Carolina and resulted in a verdict of $29 million to the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. One of the top manufacturers of talc in U.S.
April 30, 2023 Update: When J&J initially attempted to pull the lawsuit over talcum powder into bankruptcy, they came with an offer to put aside $2 billion for settlements. It was a ridiculously small amount. There was no one among the talc victims who were in favor of the offer. This time around, however, J&J has increased the offer to $8.9 if the talc plaintiffs are willing to accept bankruptcy settlements and they also have the support of a substantial segment of the talc plaintiffs and their attorneys. Is talc safe. But with 75% of talc plaintiffs, which is required to approve bankruptcy plans It’s a long and difficult process because of the number of lawyers who have large stocks of baby powder lawsuits opposed in favor of the deal.

What are the solutions to the impasse? More billions.
April 25, 2023, Update Talc cancer claimants have sought a court order to reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc safe. It was the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief because it was unable to demonstrate financial trouble.

The claimants contend that the 2nd Chapter 11 case is an fraud on the bankruptcy system and it’s being pursued in bad good faith. J&J asserts that the bankruptcy settlement has “significant support” from the firms that represent approximately 60,000 plaintiffs. It’s fair to say that the plaintiffs’ attorneys and victims ‘ lawyers are not united over this $8.9 billion settlement offer.

April 21st, 2023 Update: A bankruptcy judge has ruled the company Johnson & Johnson must face new lawsuits alleging that the company offered a baby powder with a contaminant that caused cancer. Although trials for talc lawsuits are paused for a minimum period of 60 days but new lawsuits can be filed and lawyers will begin preparing their cases. Is talc safe. Judges expressed skepticism about J&J’s attempt to revive its strategy by filing a second bankruptcy case.

April 13th 2023 Update: biggest update is about the $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer patients involved in MDL class action MDL collective action pledged to fight the settlement along with talc claimants. Why? They believe it’s too little money for the those suffering from cancer who are 70,000. Is talc safe. The lawyers say that J&J should negotiate a bigger settlement or settle individuals’ claims if the current bankruptcy is declared unconstitutional.

There is a different lawyer group that isn’t part of the leadership group in group action. They have amassed many thousands of cases. This group wants to settle now in what many believe to be lower than what the victims should be paid. Their argument is twofold. They argue that the settlement, which is about the equivalent of $100,000 per plaintiff is fair.

It’s a difficult argument to make. But their second argument has more substance: the victims will no longer wait and want to get their money right now.

April 12, 2023 Update: People are wondering if J&J could file for bankruptcy again. The answer is complex and complicated. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc litigations in a definitive manner. In other words, it believes that it will be less expensive if there is the bankruptcy element which applies pressure to settle. Is talc safe. Moving past the 400-year span of American past, the company asserts that bankruptcy benefits everyone by dispersing settlements more equally and effectively than trial courts where some litigants receive significant payouts, while others are left with nothing.

The gist in the 3rd Circuit decision was this is not a matter of the profit-making company that has an affiliate to accept the legal responsibility and declare bankruptcy – Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated the company was in financial crisis because J&J promises unlimited funding.
Then J&J decided to go with the unlimited funding portion of the deal and did not promise to offer unlimited funding for lawsuits. The company claims that revised financing arrangements with its subsidiary address appeals court’s concerns while still providing funds for claims. In the hope that offering victims less money will solve the overarching problem.

Lawyers representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared: victims’ lawyers call it the largest “fraudulent transfer in United States history.”

Despite all the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10 2023 Update: Bloomberg has an interesting article on a new law of New Jersey that is shedding new light on litigation funding in the suit for class actions. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a percentage of any wins. J&J has now offered to pay $8.9 billion to settle any lawsuits.

The funders’ involvement is made public due to the New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to tackle the growing demands for the regulation of lawsuit funders. J&J has more than 60,000 claims when you combine federal and state Baby Powder lawsuits. Third-party financing in mass tort cases has pros and pros and. But there is no question that we are seeing how third-party funding could level the playing field between people and large corporations in the courtroom.

April 4 2023 Update: It is pleasing to see the worm turning in this lawsuit. J&J suffered another setback this week when the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals an appeal in the U.S. Supreme Court. This automatic stay froze thousands of talcum powder cases and prevented new lawsuits from being filed ever since J&J began the controversial plan to spin the talc liabilities off into a bankrupt company over a year in the past. Is talc safe. When it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient a few months ago, the stay was lifted. J&J wanted to see it continue in the meantime of an appeal to the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: With the bankruptcy stay in effect, the first new cases have been filed and transferred into the class action involving talcum powder MDL in the space of a year. Seven new talc lawsuits have been brought into the MDL in the last month, bringing the total number of cases pending to 37,522.

February 25 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) initiate an investigation into the cost J&J talc products have cost the government in the decades.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products for decades while tax dollars were spent treating those injured by exposure to the products. The demand comes just weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is talc safe. J&J needs to start making fair settlement offers to victims to begin getting this behind it. It is a stain on one of the greatest businesses.

February 14 2023 Update: At a hearing today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
