May 1 2023 Update: One common question that people ask is how could plaintiffs and their attorneys turn around $8.9 billion. Of course, that’s a lot of money. There are a lot of victims. Is talc safe for joch itch. These are an excellent cases for plaintiffs. We were reminded of this last week in two talc trials which have resulted in huge verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in a verdict that was $18.1 million. A month later, another mesothelioma trial involving talc was held for the court in South Carolina and resulted in a verdict of $29 million for the plaintiff. However, this time, J&J has increased the offer to $8.9 If the talc plaintiffs agree to a bankruptcy settlement and also has the support of a substantial segment of the talc plaintiffs as well as their lawyers. Is talc safe for joch itch. But with 75% of talc plaintiffs, which is necessary for bankruptcy plan approval is not an easy task due to the sheer number of lawyers with large collections of baby powder-related lawsuits, opposed to the settlement.
What is the solution to this impasse? More billions.
April 25, 2023 Update Talc patients have sought a court order to disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc safe for joch itch. It was the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company wasn’t eligible for bankruptcy relief as it had not demonstrated financial trouble.
The plaintiffs argue that LTL’s second Chapter 11 case is an overreach of the bankruptcy system, and that it’s being conducted in bad faith. J&J states that the bankruptcy settlement has “significant support” from the firms that represent about 60,000 potential claimants. It is fair to say that plaintiffs’ lawyers and the victims are split over the $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge has decided the company Johnson & Johnson must face new lawsuits alleging that the company sold a baby powder that contained a chemical that causes cancer. The judge expressed skepticism over J&J’s attempt to revive its strategy with a second bankruptcy trial.
April 13 2023 Update: most important announcement is an $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer patients in MDL class action MDL collective action vowed to fight the settlement along with the talc claimants. Why? They argue that it’s not enough to pay for those suffering from cancer who are 70,000. Is talc safe for joch itch. These lawyers argue that J&J should seek a bigger settlement or litigate individual claims in the event that the latest bankruptcy is dismissed.
But there is another group of lawyers that is not part of the leadership of the class action. These lawyers have amassed hundreds of thousands of cases. This group wants to settle today for what is believed to be less than these victims deserve. Their argument appears to be two-fold. They argue that the settlement of around the equivalent of $100,000 per plaintiff – is fair.
That is a hard argument to present. But their second argument has more substance: the victims will no longer wait and want the money immediately.
April 12 2023 Update: Some people are seeking out how J&J can go through bankruptcy again. The answer is complicated and complicated. Let’s try to simplify it clearly.
Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc litigations in a definitive manner. It believes it can pay less when there is a bankruptcy element that creates pressure to settle. Is talc safe for joch itch. In a quest to cover 400 years of American past, the company argues that bankruptcy benefits all parties because it distributes settlement payments more equitably and effectively than trial courts where some litigants receive significant settlements while others get nothing.
The main thrust of this 3rd Circuit decision was this isn’t a case that involves an enterprise that is profitable, forming an entity to assume the legal responsibility and declare bankruptcy, which is what Congress considered when it was drafting the Bankruptcy Code. However, it also stated that the entity was financially crisis due to the fact that J&J promised unlimited funding.
Thus, J&J jumped on the funding unlimited part of the holding and did not promise that it would provide unlimited funds for cases. The company claims that its updated financing arrangements with its subsidiary will address concerns of the appellate court, while supplying funds for claim payments. As if offering victims lesser money could solve the underlying issue.
Attorneys representing cancer victims who oppose the agreement counter this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous decision. Hyperbole was not spared the lawyers representing victims call this the biggest “fraudulent transfer of assets in United States history.”
Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way to push for this $8.9 billion settlement to keep pressure on plaintiffs.
April 10 2023 update: Bloomberg offers an informative piece on a law that has been passed in New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of settlements. J&J is now offering that it will pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is publicly available because of the New Jersey court rule requiring the release of certain details about funders outside the state. This rule is intended to address the growing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you take into account state and federal child powder-related lawsuits. Third-party funding of mass tort cases has its pros and pros and. But there is no question that we are seeing how third-party financing can help level the playing field for individuals and big companies in the courtroom.
April 4 2023 Update: It is enjoyable to see the worm turn in this case. J&J has taken another blow this week when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals a bankruptcy ruling to the U.S. Supreme Court. The automatic stay has halted hundreds of cases involving talcum powder and stopped any new lawsuits from arising ever since J&J started the controversial process to spin the talc liabilities off into a bankrupt subsidiary over a year ago. Is talc safe for joch itch. After it was decided that the 3rd Circuit ruled that this bankruptcy was invalid only a few months back, the stay was revoked. J&J was hoping to have it continue in the meantime of the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to hear the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay having been officially lifted, the very first new cases have been filed and transferred into the class action involving talcum powder MDL in the space of a year. Seven new talc lawsuits were added to the MDL over the last month which brings the total number of cases in the pending process up to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J Talc products have cost the government in the years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the risks of its talc-based products for long while tax dollars utilized to treat people injured by exposure to the products. The lawsuit comes just a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Is talc safe for joch itch. J&J must begin making fair settlement offers to victims to to put all of this behind. It is a stain on one of the most prestigious companies.
