Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc-related lawsuits definitively. Going back to 400 years of American history, the company asserts that bankruptcy benefits all parties by distributing settlements more fairly and efficiently than trial courts, which are where litigants get significant award while others do not.
The basic tenet in this 3rd Circuit decision was this isn’t a case that involves a profitable company making a subsidiary to take the legal risk and declare bankruptcy – something Congress considered when it was drafting the Bankruptcy Code. Steven Cohen (D-Ten.) accused J&J of not recognizing the risks of its talc product for long while tax dollars spent on treating people who suffered injuries from exposure to the products.
