J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm plans to pay different kinds of cancer victims as part of an arrangement for bankruptcy. The company is trying for a second time to resolve more than 38,000 cases in bankruptcy, as well as prevent new lawsuits from being filed in the future.

The group claims that J&J deliberately retracted the $61.5 billion contract for funding that it had with its company subsidiary LTL Management LLC, in order to create a false sense of financial distress and to validate the company’s Chapter 11 bankruptcy filing. April 13, 2023 Update: The major announcement is an $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims in the MDL group action vowed to fight the settlement alongside those who claim talc. Why? They think it is not enough for those suffering from cancer who are 70,000. Is talc safe for skin. These lawyers argue that J&J should negotiate a larger settlement or settle individual claims if the most recent bankruptcy is declared unconstitutional.

However, there is a second set of lawyers who are not part of the top leadership in group action. They have amassed the equivalent of tens of thousands of lawsuits. They want to settle in what many believe to be less than these victims deserve. Their argument is two-fold. The first is that they claim the settlement – which amounts to an average of $100,000 per plaintiff – is fair.

This is an argument that is difficult to prove. The second argument is more substance: the victims will be no longer patient and demand to get their money right now.

April 12 2023 Update: People are looking for ways J&J is able to file for bankruptcy again. The answer is complex and complex. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc litigations in a definitive manner. That is, it thinks it will pay less if there is the bankruptcy element which applies pressure to negotiate a settlement. Is talc safe for skin. So J&J did not hesitate to take advantage of the unlimited funding portion of the holding and did not promise to offer unlimited funding for lawsuits. The company claims that new financing agreements with its subsidiary addresses the concerns of the appeals court while providing funds for claims. It’s as if giving victims less money will solve the problem at hand.

Lawyers representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. Hyperbole did not go unnoticed: victims’ lawyers call it the most significant “fraudulent transaction in United States history.”

Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method to try and push the $8.9 billion settlement and keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg has an interesting article on a new law within New Jersey that is shedding new light on litigation funding in the class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of settlements. J&J is now willing the payment of $8.9 billion to settle all lawsuits.

The involvement of the funders is public information due to an New Jersey court rule requiring the release of certain details regarding outside funding backers. The law is designed to respond to the increasing calls for the regulation of litigation funders. J&J faces over 60,000 claims when you combine state and federal baby powder lawsuits. Third-party funding of mass tort cases has its pros and pros and. But there is no question that we are seeing the ways that third-party funding can even the playing field between people and big companies in court.

April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that the Supreme Court is willing even to hear the appeal? Low.
March 16 2023 Update: with the bankruptcy stay now officially lifted, the very first new cases were filed and incorporated into the talcum powder class action MDL in just over a year. Seven new talc lawsuits have been brought into the MDL over the last month, bringing the total number of cases in the pending process up to 37,522.

February 25, 2023 Update This morning, a Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) initiate an investigation into the cost J&J product containing talc has cost the government over the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc-based products for decades while tax dollars were spent on treating people who suffered injuries from exposure to the chemicals. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
