Johnson & Johnson (JNJ.N) has set the amount of $400 million for resolving U.S. state consumer protection actions as part of a larger $8.9 billion effort to settle allegations that it’s Baby Powder as well as other talc items cause cancer. Is talc safe for the butt.

J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company will pay various types of cancer patients in bankruptcy settlement. Is talc safe for the butt. J&J has stated that its products containing talc are safe and will not cause cancer. J&J is seeking the second time to end more than 38,000 lawsuits filed in bankruptcy, as well as prevent new lawsuits from arising in the near future.
LTL’s bankruptcy plan will pay $400 million into an additional trust to settle claims filed with state attorneys general alleging that J&J had violated the state’s unfair commercial practices and consumer protection laws by misinforming consumers about the safety of its talc products.

Many states had initiated consumer protection lawsuits against J&J prior to the time that LTL’s bankruptcy filing stopped those investigations from proceeding in 2021. Is talc safe for the butt. New Mexico and Mississippi had already brought actions against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas, according to LTL’s court filings.

New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL as well as cancer patients as well as The U.S. Justice Department’s bankruptcy watchdog. They have argued that a successful company like J&J is not eligible for bankruptcy protections aimed at struggling debtors.
The company’s initial attempt to resolve the bankruptcy-related lawsuits was thrown out after similar arguments. In the end, a U.S. appeals court determined that LTL did not have “financial trouble” and ineligible to receive bankruptcy relief. Is talc safe for the butt. LTL filed a second bankruptcy in just two hours following the dismissal, arguing its second attempt was different because it had less money available and had more support for an agreement.

New Mexico and Mississippi said in their motion to dismiss LTL’s renewed bankruptcy violates the law enforcement powers of the state by attempting unilaterally to cap LTL’s liability to state consumer protection actions.

LTL’s filings for the new year also contained more information on how the company would assess and settle cancer claims when the bankruptcy plan is approved.

The highest payments under the settlement will be $500,000 for people diagnosed with mesothelioma terminal prior to age 45, and $260,000 for those who have been diagnosed with cancer of the ovary before age 45.

From there, the proposed settlement applies discounts depending on the kind and severity of cancer, an individual’s age, history of talc use and other factors. Is talc safe for the butt. For example, a woman who used talc products on a weekly basis, who had the family history of ovarian cancer and was diagnosed Stage II cancer of the ovary by age 55 may qualify to receive a payout of $21,125 under the settlement plan.

Judge decides J&J, talc opponents to take part in settlement talks.

Following another round of hearings in Johnson & Johnson’s attempt to employ a Texas Two Step bankruptcy strategy for talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposed to the move to conduct settlement talks, Bloomberg reports.

With its second bankruptcy attempt for LTL management, a subsidiary founded by J&J to handle the claims company made a settlement offer of $8.9 billion. Is talc safe for the butt. While one firm representing plaintiffs agree with the settlement, a different group opposes the move.

Earlier this week, the opposition group, which is known as”the Official Committee of Talc Claimants in the bankruptcy court, demanded to disqualify the petition by asserting that LTL is not a factor in financial hardship.

“The filing is a desperate and legally ineffective attempt by a few of law firms to try to stop claimants from voting on the resolution, which that the vast majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc safe for the butt. “The law firms who filed their filing are financially oriented and have conflicts that conflict with, diverge from, and oppose the interests which their clientele. We’ll soon submit a response an appeal to the appellate court.”

Is talc safe for the butt. Clay Thompson, a lawyer for MRHFM, which boasts more than mesothelioma victims who have filed lawsuits against J&J, said that J&J’s second bankruptcy effort failed.

“J&J publishes press release about how great its plan is while simultaneously demanding that plan details–including what each sick person will receive,” Thompson said in an announcement. “What does the company have to cover up?”

Kaplan has commanded the parties to come up with another restructuring plan, with the supervision and supervision of mediators.

The court in February of 2022 Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that would free the company from the tens of thousands of claims related to its talcum-based products.

In January of this year an appeals court in the United States overturned the ruling, ruling that the firm could not be considered in “financial financial distress.”

The J&J’s plan to contest the U.S. Supreme Court was rejected at the end of April J&J applied for its first bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 calendar days to decide whether or not to approve to file for bankruptcy again.

J&J’s unstoppable profit engine sputters after $6.9B talc litigation charge.

With the two Chapter 11 attempts, J&J has bought 19 months during which the cases were held. Is talc safe for the butt. The company wants claimants to decide whether they want to accept the settlement. J&J would need 75% support for the deal to go through.

In addition to the group of talc lawyers that criticized the company’s bankruptcy and the U.S. Trustee, a branch that is part of the U.S. Department of Justice is also submitting an appeal to dismiss LTL’s second bankruptcy.

In a statement this week, U.S. Trustee Andrew R. Vara wrote that the bankruptcy courts are “open to honest, but naive debtors.” Those doors “are not open to parties that lack a legitimate bankruptcy reason or want to use the bankruptcy process to delay or hinder their creditors,” Vara continued.

In its own words, J&J maintains there is no proof conclusive that their talc products, including its iconic baby powder, can cause cancer. J&J has taken its products off of the market, first for North America in 2020–and the rest of the world later this year.

J&J intends to steer clear of the costly business of going to trial. It has prevailed in most of the cases that have been resolved during trial, however, certain losses have been harsh.
A high-profile trial in Missouri produced a $4.7 billion verdict against the drug maker that was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine talc trials that are either in appeal or resolved. Out of 41 trials, 32 ended with the favor of J&J, a mistrial or verdict of a plaintiff annulled after appeal. Is talc safe for the butt. The company also in 2020 moved to settle more than 1,000 cases worth the sum of $100 million. Bloomberg stated at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Safe For The Butt

June 2, 2023 Update: During the asbestos talc trial that took place in California yesterday, a couple of technical issues disrupted the opening statements made by defense attorneys. Is talc safe for the butt. Jurors from their homes via Zoom but did not hear Johnson and Johnson’s lawyer express doubt about the science of the 70s asserting the presence of asbestos in their product before the proceedings abruptly ended.

Meanwhile, the plaintiff could introduce the first of their witnesses, Arthur Langer. Langer explained that the existence of additional minerals along with the talc’s mineral content is inevitable. He testified that his team was notified by J&J in 1971 of the presence of chrysotile asbestos within the company’s talc, albeit with lower than 0.1 percent. He also discovered more asbestos in 1976.

June 1, 2023 Update: Is talc safe for the butt. The first trial since J&J made the decision to split its Talc segment and file for bankruptcy marks an important turning point within the ongoing litigation story. Trial began yesterday in the poignant case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma last year, a diagnosis lawyers on both sides acknowledge is a harrowing tragedy.

Opening statements laid bare distinct differences between each side’s narrative. The attorney for the plaintiff took aim on Johnson & Johnson, alleging the use of deceptive strategies in its research practices as well as throughout the litigation procedure. According to the attorney the company tried to manipulate asbestos’ definition, in spite of internal documents from between 1978 and 1994 that showed asbestos fibers found in tissue of the plaintiff are included.

Johnson & Johnson’s uncertain $8.9 billion settlement proposal hangs in the balance with the progression of this trial. Despite the particularity of this mesothelioma-related case and the unique issues it faces compared to the majority of talcum powder lawsuits, a verdict favoring the plaintiff could inflict a serious setback to J&J’s hopes of broad acceptance of their proposed settlement among plaintiffs.

May 31st 2023 Update: Johnson and Johnson’s bankrupt talc business strongly defended the 2nd Chapter 11 filing in the in the face of challenges from the talc injury plaintiffs. In an appeal to the New Jersey bankruptcy court, the company argued that the case was distinct from the previous filing. It also emphasized the unprecedented commitment of $8.9 billion from J&J, the largest ever settlement in an bankruptcy case involving mass torts. Is talc safe for the butt. There was no mention of how the magnitude of the settlement signifies that it’s an equitable settlement. J&J also claimed support from various plaintiffs’ law firms representing over the 60,000 plaintiffs. It is difficult to confirm but likely incorrect.

May 24 2023 Update: In the wake of Johnson and Johnson’s bankruptcy filing in 2021 filing, the very first trial regarding its cosmetic talc products that are believed to with asbestos content is scheduled to commence jury selection on Monday, May 24, California in Alameda County Superior Court, the most favored location for plaintiffs. The plaintiff claims that his mesothelioma was caused by asbestos exposure in J&J’s product and the company has denied. The trial also includes six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers in the 2nd J&J talc bankruptcy are in a dispute over who should be appointed to the role of a future claims representative. This is the role is crucially essential to the resolution of the talc claims. Is talc safe for the butt. Randi Ellis, a lawyer who is frequently involved in MDLs across the country, was appointed as the claims representative in the previous bankruptcy. J&J’s defense group wants Ellis to be named to the position and again, but attorneys for the talc plaintiffs have raised objections to the claim that Ellis has an interest conflict that should prevent her from being appointed to that post again. This conflict is rooted in the possibility that Ellis was apparently involved in drafting the controversially disputable second bankruptcy, which raises concerns about her capability to remain neutral. The reality is the bankruptcy will get dismissed anyway.

May 17, 2023 Update: The pretend company J&J put together for the talc bankruptcy told an New Jersey bankruptcy court that they have allocated $400 million to settle the claims of states that accuse J&J of misleading marketing regarding its talc products. Is talc safe for the butt. So that makes it an $8.5 billion settlement for cancer sufferers. It is hard to imagine the scenario in which J&J will be able to push these settlements for babies in these figures. While J&J’s $8.5 billion offer seems like a lot initially, it will not look great when you look at the numbers. This settlement offer based on our rough calculations, would not pay victims much more than $100,000 per case. That is not enough.

May 15 2023, Update J&J is potentially facing a suit from an advocacy group representing cancer victims. Is talc safe for the butt. The group contends that J&J deliberately retracted a $61.5 billion fund-raising agreement with its subsidiary, LTL Management LLC, in order to create a false sense of financial distress and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move could be interpreted as a fraudulent transfer of right to compensation for victims. They plan to explore J&J’s actions following of the decision to dismiss the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: The following week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments in a motion dismiss the second bankruptcy application that was filed by J&J LTL Management, J&J’s subsidiary. LTL Management. In the meantime it has approved an order calling for both parties to participate in a new settlement mediation to see if a global settlement deal can reached.

May 5th, 2023: Update on Talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Is talc safe for the butt. Over 2,700 people have sued the firm, and it was spending $1 million a month for legal defense. The company’s recent $29 million settlement on the state of South Carolina forced it to seek bankruptcy protection, arguing for equitable distribution of assets to talc claimants, rather than being taken from the receiver. Other suppliers of talc have filed for bankruptcy due to the litigation.

May 4 2023, Update U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart talks with lawyers who rejected the company’s $8.9 billion deal. The court in Trenton, New Jersey yesterday, the parties appeared in court to discuss next steps in another bankruptcy proceeding. Judge Kaplan has pushed for further settlement talks.

This is the answer to settle these claims with J&J. A settlement for baby powder can be made. Is talc safe for the butt. But it’ll need additional money – perhaps billions of dollars coming from Johnson & Johnson.

Lawyers are split on whether to take the proposal or not and not all clients view the situation the same way their lawyer sees it. Second bankruptcy cases are likely to fail, the judge Kaplan has set a date for a hearing in June to determine whether to dismiss the bankruptcy for the second time.

May 3 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) demanded to have they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt litigation regarding talc-related products. The committee representing talc claimants filed a motion on Tuesday asking for the Third Circuit to consider their case and send it back the lower court with instructions for dismissing the bankruptcy. Is talc safe for the butt. The committee also requested that the halted tort litigation against J&J continue to continue.
LTL requested Chapter 11 protection once again after its first bankruptcy filing was denied in the Third Circuit earlier this year with a $8.9 billion deal. The committee says that the recent ruling allowing LTL’s third Chapter 11 to continue, in addition to halting trials against J&J, warrants urgent Third Circuit review. The US Trustee also asked that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a response to the appeals court declaring the filing a “desperate and legally flawed attempt” by a handful of law firms who have competing financial interests.
May 1st, 2023 Update: One question people keep asking is how could the plaintiffs’ lawyers and their clients turn around $8.9 billion. Of course, that’s quite a sum. But there are plenty of victims. Is talc safe for the butt. And these are really good claims for plaintiffs. We were reminded of this recently by two talc-related trials that resulted in big verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in the verdict of $18.1 million. A month later, another mesothelioma-related talc case went to trials at South Carolina and resulted in the verdict of $29 million for the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. which is one of the largest manufacturers of talc in U.S.
April 30 2023 Update: J&J first tried to bring the litigation over talcum powder into bankruptcy, it was met with an offer to reserve $2 billion to settle the case. It was a ridiculously small amount. There was no one among the talc victims who agreed with the proposal. However, this time, J&J has increased the offer to $8.9 if the talc plaintiffs accept a bankruptcy settlement and also has the support of a substantial section of the talc victims and their lawyers. Is talc safe for the butt. But 75% of the plaintiffs of talc are necessary for bankruptcy plan approval is not an easy task because of the number of lawyers who have huge inventories of baby powder-related lawsuits, opposed towards the agreement.

What could solve the impasse? More billions.
April 25, 2023 Update Talc Cancer victims have sought a court order to reject the Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc safe for the butt. It was the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that LTL was not a candidate for bankruptcy relief as it had not demonstrated financial distress.

The claimants contend that the second Chapter 11 case is an overreach of the bankruptcy system and it’s being conducted in bad faith. J&J asserts that the bankruptcy settlement has “significant support” from the firms that represent approximately 60,000 people who are claiming. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over this $8.9 billion deal.

April 21st, 2023 Update A bankruptcy judge has decided in favor of Johnson & Johnson must face new lawsuits alleging that the company sold baby powder that was contaminated and causing cancer. Even though trials for the talc lawsuits have been suspended for at least 60 days but new lawsuits can be filed and lawyers may begin to prepare their cases. Is talc safe for the butt. Judges expressed doubt about J&J’s pathetic attempt to revive its plan with a second bankruptcy case.

April 13th 2023 update: the most important story is that there’s an $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer victims who are part of the MDL collective action vowed to fight the settlement alongside those who claim talc. Why? They argue that it’s too little money for the 70 000 cancer patients. Is talc safe for the butt. These lawyers argue that J&J should seek a bigger settlement or settle individuals’ claims if the current bankruptcy is dismissed.

However, there is a second group of lawyers outside of the leadership in group action. The lawyers collectively have accumulated many thousands of cases. They want to settle in what many believe to be less than these victims deserve. The argument they make is twofold. First, they argue that the settlement – about 100 million dollars on average per plaintiff – is fair.

That is a hard argument to make. The second argument is more force: the victims can not afford to wait any longer and need the money immediately.

April 12 2023 Update: Some people are looking for ways J&J can go through bankruptcy once more. The answer is complex and complicated. But let’s try to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. It believes it can pay less in the event of a bankruptcy component that applies pressure to negotiate a settlement. Is talc safe for the butt. Driving past hundreds of years of American time, the business believes that bankruptcy is beneficial to all parties because it distributes settlement payments more evenly and efficiently than trial courts, where some litigants receive significant payouts, while others are left with nothing.

The essence in the 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming an entity to assume the legal responsibility and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. It also clarified that the entity was in financial difficulty due to the fact that J&J assured it of unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding portion of the agreement and didn’t promise to offer unlimited funding for lawsuits. The company claims that its new financing agreements with its subsidiary will address concerns of the appellate court, while providing funds for claims. In the hope that offering victims lower amounts of money would resolve the underlying issue.

Attorneys representing cancer victims who do not agree with the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed the lawyers representing victims call it the most significant “fraudulent transaction of assets in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. However, it’s a means to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10 2023 update: Bloomberg has an interesting article on a new law of New Jersey that is shedding new light on litigation funding in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) over talc products in exchange for a percentage of any settlements. J&J has now offered the payment of $8.9 billion in settlements for all lawsuits.

The involvement of funders is public knowledge due to the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rules aim to respond to the increasing calls for the regulation of litigation funders. J&J faces over 60,000 claims when you include state and federal child powder-related lawsuits. Third-party funding of mass tort cases has both pros and cons. But there is no question that we are seeing how third-party funding could level the playing field between individuals and big corporations in court.

April 4 2023 Update: It’s pleasing to see the worm turn in this litigation. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals an appeal before the U.S. Supreme Court. Automatic stays have frozen thousands of talcum powder cases and prevented new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc debts into a bankrupt company over a year earlier. Is talc safe for the butt. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient just a few months ago the stay was lifted. J&J had hoped to have it continue in the meantime of an appeal to the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that for the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay being in effect, the first new cases were filed and incorporated into the class action involving talcum powder MDL within a year. Seven new talc cases were included in the MDL in the past month which brings the total number of cases pending to 37,522.

February 25, 2023 Update This morning, a Congressmen from Tennessee is now requesting that be the U.S. Government Accountability Office (GAO) begin an investigation into how much J&J products containing talc have cost the government in the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the dangers of its talc products over years while tax dollars were utilized to treat people injured by exposure to the products. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is talc safe for the butt. J&J needs to start making reasonable settlement proposals for victims in order getting this behind it. It is a stain on one of the most prestigious businesses.

February 14 2023 Update: During an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
