J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm will pay various types of cancer victims as part of a bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future lawsuits involving talc conclusively. Going back to the 400-year span of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlements more equally and effectively than trial courts where some litigants receive significant awards while others receive nothing.
The essence in the 3rd Circuit decision was this is not a case of one that makes a profit, but a subsidiary to take the legal liability and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared attorneys representing the victims claim it the most significant “fraudulent deal that has occurred in United States history.”
Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way to push for this $8.9 billion settlement, and to keep pressure on plaintiffs.

The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a share of any profits. J&J has now offered the payment of $8.9 billion to settle any lawsuits.
The involvement of the funders is made public because of the New Jersey court rule requiring the disclosure of certain information about funders outside the state.
