Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc lawsuits conclusively. That is, it believes it can pay less should there be an element of bankruptcy that puts pressure to negotiate a settlement. Is talc safe to eat. Moving past hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlements more fairly and effectively than trial courts, where litigants are awarded significant awards while others receive nothing.
