April 13th 2023 update: the major news is the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims involved in MDL class action MDL Class Action have promised to fight the settlement along with those who claim talc. Why? Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. Going back to hundreds of years of American time, the business asserts that bankruptcy benefits everyone by dispersing settlements more equally and effectively than trial courts where litigants are awarded significant settlements while others get nothing.
The main thrust in the 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming subsidiaries to meet the legal burden and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. Lawyers representing cancer patients who are against the agreement argue this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s ruling. The hyperbole wasn’t spared: victims’ lawyers call it the most significant “fraudulent deal of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of settlements. J&J is now offering that it will pay $8.9 billion to settle lawsuits.
The funders’ involvement is publicly available due to a New Jersey court rule requiring the release of certain details about funding sources outside of the. In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc-based products for many years, while tax dollars were used to treat those who were injured through exposure to the products.
