J&J’s proposed settlement for talc would provide $400 million to US state AGs. Is Yardleys Talc Safe .

Johnson & Johnson (JNJ.N) has set aside $400 million to resolve U.S. state consumer protection actions as part of a broader $8.9 billion plan to settle allegations that its Baby Powder as well as other talc products cause cancer. Is yardleys talc safe.

J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay different types of cancer sufferers in the bankruptcy settlement. Is yardleys talc safe. J&J has claimed that its Talc products are safe, and do not cause cancer. J&J is seeking the second time to end more than 38,000 lawsuits filed in bankruptcy and prevent new cases from arising in the future.
LTL’s bankruptcy plan will pay $400 million into an additional trust to settle claims brought in state courts by attorneys general alleging that J&J was in violation of the state’s unfair commercial practices and consumer protection laws by misleading consumers regarding the dangers of its talc products.

Many states had initiated consumer protection actions against J&J prior to the first bankruptcy filing prevented those investigations from moving forward in 2021. Is yardleys talc safe. New Mexico and Mississippi had already initiated suit in the past against Johnson & Johnson before then, and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas in LTL’s court papers.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished in a joint move with cancer victims and those affected by cancer and the U.S. Justice Department’s bankruptcy watchdog. have argued that a profitable company such as J&J cannot benefit from bankruptcy protections meant for struggling debtors.
The first time LTL attempted to settle the lawsuits in bankruptcy was thrown out after similar arguments. In the end, a U.S. appeals court ruled that LTL had not been in “financial trouble” and thus not eligible under bankruptcy law. Is yardleys talc safe. LTL made a new bankruptcy application just over two hours after the dismissal, saying that the second bankruptcy was different as it was able to borrow less and more backing for an agreement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s latest bankruptcy violation of the law enforcement powers of the state by attempting unilaterally to cap the company’s liability for state consumer protection laws.

LTL’s filings for the new year also contained more information about the way in which the company will evaluate and settle cancer claims should the bankruptcy plan be approved.

The maximum amount under the settlement would be $500,000 for those diagnosed with mesothelioma terminal prior to age 45 and $260,000 for those who have been diagnosed with cancer of the ovary before age 45.

The proposed settlement will offer discounts based on the kind and severity of cancer, an individual’s age, history of the use of talc, and other aspects. Is yardleys talc safe. For instance someone who regularly used the talc product on a regular basis, had a family history of ovarian cancer, and was diagnosed with the stage 2 ovarian cancer when she was 55 may be eligible to receive a payout of $21,125 under the plan.

Judge decides J&J, talc opponents to participate in settlement talks.

Following another round of hearings in Johnson & Johnson’s effort to utilize a Texas Two-Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposing the move to conduct negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy attempt for LTL Management–a subsidiary established by J&J to handle the claims company proposed a settlement of $8.9 billion. Is yardleys talc safe. While one group of law firms representing plaintiffs support the settlement, a different group is opposed to the offer.

In the last week, an opposition group, known as”the Official Committee of Talc Claimants in the bankruptcy court, demanded to dismiss the case arguing that LTL can not be considered to be in financial trouble.

“The filing is a desperate and legally deficient attempt by a few of law firms to prevent claimants from voting on the resolution plan–a plan the vast majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Is yardleys talc safe. “The law firms behind the filing are pursuing financial interests which clash with, diverge from, and contravene those that their customers. We’ll soon submit an appeal an appeal to the appellate court.”

Is yardleys talc safe. Clay Thompson, a lawyer for MRHFM who includes more than mesothelioma victims who have filed lawsuits against J&J and J&J, has said that J&J’s second bankruptcy effort will fail.

“J&J issues press releases about how wonderful its plans are, but is requesting that details of the plan, such as what the individual sick individuals would be treated to,” Thompson said in a statement. “What do they have to hide?”

Kaplan has instructed both sides to devise a second arrangement plan under the oversight and supervision of mediators.

On February 20, 2022 Kaplan stated that J&J’s use of Chapter 11 to hasten a settlement that will free J&J from the thousands of lawsuits concerning its talcum products.

In the month of January, a federal appeals court ruled against the decision, deciding that the company could not be considered in “financial trouble.”

After J&J’s contest the U.S. Supreme Court was rejected at the end of April J&J filed for its second bankruptcy two hours after. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether to grant the second bankruptcy.

J&J’s unstoppable profit machine sputters after $6.9B settlement charge for talc.

With the 2 Chapter 11 attempts, J&J has bought 19 months during which cases have been held. Is yardleys talc safe. The company is requesting that claimants accept their settlement. J&J requires 75% support for the settlement to be approved.

In addition to the team of talc lawyers that criticized the company’s bankruptcy play and the U.S. Trustee which is a division from the U.S. Department of Justice, also filed an application to dismiss LTL’s second bankruptcy case.

In a letter filed this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy courts are “open to honest, but naive debtors.” The doors “are not open to parties who do not have a legitimate bankruptcy goal or who seek to use the bankruptcy process to hinder or delay their creditors,” Vara continued.

To its credit, J&J maintains there is no definitive evidence to suggest that its products containing talc, such as its famous baby powder, can cause cancer. J&J has adopted the products from the market and will first launch them to be available in North America in 2020–and the remainder of the globe later this year.

J&J intends to steer clear of the expense of going to court. It has won most of the cases that have been resolved during trial, however, certain losses have been punitive.
A high-profile trial in Missouri led to an $4.7 billion judgment against the drug manufacturer but was later reduced to $2.1 billion following appeals.

In all, J&J has lost nine trial cases in talc which are being appealed or settled. Out of 41 trials 32 have ended in the favor of J&J as well as mistrials or plaintiff verdict that was annulled upon appeal. Is yardleys talc safe. Additionally, the company has announced plans to settle more than 1,000 cases for $100 million, Bloomberg published at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Yardleys Talc Safe

June 2 2023 Update: At the asbestos talc case at the trial in California yesterday, technical issues halted the opening statements made by defense lawyers. Is yardleys talc safe. The jurors, attending at home via Zoom but did not hear Johnson and Johnson’s lawyer express doubts about the 70s research claiming asbestos was present in their product, but the proceedings abruptly ended.

In the meantime, the plaintiff could present an initial witness Arthur Langer. Langer explained that the existence of additional minerals along with talc is expected. He also testified that his team was notified by J&J in 1971 of the presence of chrysotile asbestos within the talc manufactured by the company, though in less than 0.1 percent. He also discovered more asbestos in the year 1976.

June 1st, 2023 Update Is yardleys talc safe. This is the first court trial that has taken place since J&J made the decision to split its Talc section and declaring bankruptcy is an important point within the ongoing litigation controversy. The trial started yesterday in the harrowing case of a young 24 year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma last year, an illness that lawyers on both sides of the argument agree is a tragic loss.

Opening statements revealed stark differences in each side’s story. The plaintiff’s attorney took aim at Johnson & Johnson, alleging the use of deceptive methods in their research practices as well as throughout the litigation procedure. As per the lawyer Johnson & Johnson attempted to alter the definition of asbestos, despite internal documents from the year 1978 and 1994 indicating that asbestos fibers that were found in the tissue of the plaintiffs are included.

Johnson & Johnson’s precarious $8.9 billion settlement is hanging in the balance with the development of the trial. Despite the distinct nature of this mesothelioma lawsuit and its distinct issues compared to the majority of talcum powder lawsuits ruling in favor of the plaintiff could result in a serious setback to J&J’s hope of gaining broad acceptance for their proposed settlement among plaintiffs.

May 31 2023: Update from Johnson & Johnson’s bankrupt talc division vigorously defended its Second Chapter 11 filing in the face of challenges from the talc injury plaintiffs. In an objection submitted to the New Jersey bankruptcy court, it argued that the situation differed fundamentally from the prior filing. It emphasized the unprecedented commitment of $8.9 billion from J&J the largest ever settlement in the history of a mass tort bankruptcy. Is yardleys talc safe. Not mentioned: how this amount means it is a fair settlement. J&J also claimed that it received support from various plaintiffs’ law companies representing over sixty thousand claimants. This is hard to verify but is probably incorrect.

May 24, 2023 Update: Since Johnson &J Johnson’s bankruptcy filing, the very first trial on the cosmetic talc products it claims to that contain asbestos is scheduled to begin jury selection on Monday in California with Alameda County Superior Court, the most favored location for plaintiffs. The plaintiff asserts that his mesothelioma was caused by asbestos exposure through J&J’s products, an allegation J&J denies. The trial also involves six retailers accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers in the 2nd J&J talc bankruptcy are fighting over who should be appointed to the role of the claims representative in the future, the role is crucially essential to the resolution of the talc claims. Is yardleys talc safe. Randi Ellis, a lawyer who frequently appears in MDLs across the country was appointed the claims representative in the initial bankruptcy. J&J’s defense group wants Ellis to be appointed to that role yet again, but the lawyers for the talc plaintiffs are protesting due to the fact that Ellis has conflicts of interest which should stop her from holding that position once more. The issue stems from the possibility that Ellis was involved in drafting the controversially litigated second bankruptcy, raising doubts about her ability to be neutral. It’s true that the bankruptcy will be dismissed in the end.

May 17th, 2023 Update: The pretend company J&J made up to settle the talc litigation bankruptcy informed a New Jersey bankruptcy court that they have set aside $400 million to settle allegations made by states who accuse the company of misleading advertising for its talc product. Is yardleys talc safe. That’s an $8.5 billion settlement to cancer victims. It’s difficult to envision the scenario in which J&J can get the baby powder settlements at these numbers. While J&J’s proposed $8.5 billion offer may seem like a lot of money initially, it does not look very appealing when you do the math. The proposed settlement based on our rough calculations would not provide victims with much more than an average settlement $100,000 per case. That is not enough.

May 15th, 2023 Update: J&J might be facing suit from an advocacy group representing cancer patients. Is yardleys talc safe. The group claims that J&J deliberately withdrew the $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, to create the appearance of financial hardship and verify the unit’s Chapter 11 bankruptcy filing. The group argues that this act amounts to a fraudulent transfer of rights of compensation for victims. They intend to investigate J&J’s actions in the wake of the decision to dismiss LTL’s first bankruptcy case.

May 10 2023 Update: Next week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy petition filed from J&J LTL Management, J&J’s subsidiary. LTL Management. In the meantime the bankruptcy has issued an Order requiring both sides to take part in a new settlement negotiation in the hope that it will be possible to reach a global settlement agreement been reached.

May 5th 2023 Update: Talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer from asbestos exposure. Is yardleys talc safe. More than 2700 people have filed lawsuits against the firm and the company was spending $1 million a month for legal defense. The company’s latest $29 million verdict on the state of South Carolina forced it to file for bankruptcy protection, arguing for equitable distribution of assets between talc claimants rather than being taken over in the hands of the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of the litigation.

May 4, 2023, Update U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to relaunch negotiations with lawyers who turned down the proposed $8.9 billion settlement offer. At Trenton, New Jersey yesterday the parties appeared before a judge to discuss next steps in their second bankruptcy matter and Judge Kaplan pushed more settlement talks.

This is the answer to settle these claims with J&J. The baby powder settlement is likely to be completed. Is yardleys talc safe. But it’ll need more money – more billions of dollars – from Johnson & Johnson.

Lawyers are divided over whether or not to accept the plan and not all clients see the issue the same way their lawyer sees it. Second bankruptcy cases are expected to fail the judge Kaplan has set a date for a hearing in June to decide if he will discharge the bankruptcy for the 2nd time.

May 3, 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) demanded that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail the litigation surrounding talc-based products. The group representing claimants for talc filed a motion on Tuesday, asking that the Third Circuit to consider their case and then send it back before a court of lower jurisdiction with instructions to dismiss the bankruptcy. Is yardleys talc safe. They also requested that the stoppage of tort litigation against J&J continue to proceed.
LTL filed for Chapter 11 protection once again after its first bankruptcy filing was rejected in the Third Circuit earlier this year and offered a $8.9 billion settlement. The committee believes that the recent ruling allowing LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J should be subject to urgent Third Circuit review. The US Trustee has also requested the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a response in the appeals court, declaring the filing a “desperate and legally deficient plan” by a select group of law firms with conflicting financial interests.
May 1st, 2023 Update: One frequently asked question is how could the plaintiffs’ lawyers and their clients turn down $8.9 billion. That’s of course an immense amount of money. But there are plenty of victims. Is yardleys talc safe. These are an excellent case for plaintiffs. We were reminded of this recently when two talc cases ended in large verdicts for plaintiffs. In February, a talcum powder mesothelioma trial in Oregon was settled with the verdict that was $18.1 million. The following month, a second talc mesothelioma case went to trial on the other side of South Carolina and resulted in a verdict of $29million for the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc. which is one of the most prominent suppliers of talc within the U.S.
April 30 2023 Update: In the year 2023, when J&J first attempted to drag the talcum powder lawsuit into bankruptcy, they came with an offer to reserve $2 billion for settlements. It was a ridiculously small amount. None of the talc plaintiffs were in favor of it. This time, however, J&J has increased the offer to $8.9 if the talc plaintiffs accept a bankruptcy settlement and they also have the support of a substantial part of the talc-related plaintiffs as well as their lawyers. Is yardleys talc safe. However, 75% of plaintiffs in the talc category, which is required for bankruptcy plan approval is a difficult road due to the sheer number of lawyers with massive stocks of baby powder litigations opposed towards the agreement.

What is the solution to this impasse? More billions.
April 25 2023 Update: Talc Cancer victims have requested a judge to reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is yardleys talc safe. It was the 3rd Circuit dismissed its first Chapter 11 case in January and said that the company was not eligible for bankruptcy relief since it failed to show financial trouble.

The plaintiffs argue that the third Chapter 11 case is an abuse of the bankruptcy system, and that the case is being handled in bad good faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from the firms that represent approximately 60,000 claimants. It’s safe to say that the plaintiffs’ attorneys and the victims are split over this $8.9 billion settlement offer.

April 21, 2023 Update: A bankruptcy judge ruled in favor of Johnson & Johnson must face new lawsuits alleging that it offered a baby powder with a contaminant that caused cancer. Although trials for the lawsuits involving talc are delayed for at least 60 days however, new lawsuits may be filed and lawyers may begin to prepare their cases. Is yardleys talc safe. Judges expressed doubt about J&J’s absurd attempt to relaunch its strategy in a second bankruptcy trial.

April 13th 2023 update: the major news is the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims involved in MDL class action MDL Class Action have promised to fight the settlement along with those who claim talc. Why? They feel it’s not enough money for those suffering from cancer who are 70,000. Is yardleys talc safe. The lawyers say that J&J could negotiate a greater settlement or settle individual claims if the latest bankruptcy is declared unconstitutional.

However, there is a second set of lawyers who are not part of the leadership group in that class action. The lawyers collectively have accumulated tens of thousands of cases. They want to settle now for what is believed to be less than the victims deserve. Their argument appears to be two-fold. First, they argue that the settlement of around an average of $100,000 per plaintiff – is fair.

This argument isn’t easy to argue. The second argument is more substance: the victims will now not wait and they want the money immediately.

April 12 2023 Update: People are looking for ways J&J is able to file for bankruptcy once more. The answer is complex and convoluted. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. Also, it thinks it will pay less when there is a bankruptcy element that creates pressure for a settlement. Is yardleys talc safe. Going back to hundreds of years of American time, the business asserts that bankruptcy benefits everyone by dispersing settlements more equally and effectively than trial courts where litigants are awarded significant settlements while others get nothing.

The main thrust in the 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming subsidiaries to meet the legal burden and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled that the subsidiary was not in financial distress because J&J promises unlimited funding.
Thus, J&J took advantage of the funding unlimited part of the holding and didn’t make any promises to fund unlimited the litigation. J&J claims that its revised financing arrangements with its subsidiary addresses the appeals court’s concerns, while providing funds for claims. In the hope that offering victims lower amounts of money would resolve the overarching problem.

Lawyers representing cancer patients who are against the agreement argue this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s ruling. The hyperbole wasn’t spared: victims’ lawyers call it the most significant “fraudulent deal of assets in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023 Update Bloomberg offers an informative piece on a law that has been passed within New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of settlements. J&J is now offering that it will pay $8.9 billion to settle lawsuits.

The funders’ involvement is publicly available due to a New Jersey court rule requiring the release of certain details about funding sources outside of the. The law is designed to address the growing calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up state and federal baby powder lawsuits. Third-party funding for mass tort lawsuits has pros and cons. There is no doubt that we are seeing how third-party funding can level the playing field between people and big companies in the courtroom.

April 4 2023 Update: It is enjoyable to see the worm turning in this lawsuit. J&J took another hit this week, when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals an appeal before the U.S. Supreme Court. This automatic stay froze thousands of talcum cases and stopped new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc debts off into a bankrupt subsidiary over a year back. Is yardleys talc safe. When it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was revoked. J&J wanted to see it continue in the meantime of an appeal to the SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay having been fully lifted, the first new cases were filed and incorporated into the class action for talcum powder MDL within a year. Seven new talc-related lawsuits were included in the MDL in the last month increasing the number of cases that are pending to 37,522.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that The U.S. Government Accountability Office (GAO) launch an investigation into how much J&J products containing talc have cost the government in the many years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc-based products for many years, while tax dollars were used to treat those who were injured through exposure to the products. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is yardleys talc safe. J&J needs to start making fair settlement offers to victims to begin to put all of this behind. It’s a mark on one of the greatest companies.

February 14 2023 Update: At the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
