“The filing is a desperate and legally deficient attempt by a few of law firms to prevent claimants from voting on the resolution plan, a plan that the overwhelming majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in a statement. Attorneys representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s decision. Hyperbole did not go unnoticed: victims’ lawyers call it the largest “fraudulent transaction of assets in United States history.”
In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.
